A swimming coach in Britain recently fell on the wrong side of that distinction when he inadvertently sent crude text messages to every contact on his cell phone -- including minors -- landing himself in jail for causing or inciting a child to engage in sexual activity, the Telegraph reports.
Craig Daniel Evans, 24, served three months of a year and a half sentence in a Birmingham prison for the text messages he meant to send to his girlfriend. The lewd notes asking his lover for "skin on skin" sex were delivered to a pair of his swim students, ages 13 and 14 years old, according to The Sun.
This week, the court ruled that Evans' "misguided use of his BlackBerry" made it "difficult to conclude that he was targeting anyone," the Daily Mail reports.
The judge added that "The facts of this case are rather unusual. Messages... were sent to every single contact in his phone, including members of his own family."
The judge suspended the sentence.
