Jana Winter's Lawyers Argue To See James Holmes' Notebook

DENVER -- Lawyers for Fox News reporter Jana Winter say she would agree not to report on the contents of the Colorado theater shooting suspect's notebook if they're allowed to see it in their battle to protect her sources.

In a filing released Friday, Winter's attorneys say they should get to see the notebook that James Holmes sent a psychiatrist before the July 2012 shootings.

Holmes is accused of killing 12 people and injuring 70.

Citing unidentified law-enforcement sources, Winter reported the notebook contained violent drawings.

Holmes' lawyers say the leak violated a gag order. They say officers who denied being Winters' sources may have lied, undermining their credibility as trial witnesses.

Prosecutors and the defense oppose letting Winter's lawyers see the notebook. Prosecutors say that would allow it to be public.
