Vito Fossella, New York Republican, Won't Run For Re-Election: Report

The AP is reporting that Republican Congressman Vito Fossella will not run for re-election after revelations that he fathered a child with his mistress and was arrested for drunk driving:

New York Rep. Vito Fossella will not seek re-election after a series of damaging revelations about a child from an extramarital affair, two people familiar with the decision told The Associated Press.


Both people spoke on condition of anonymity because they were not authorized to make the announcement public. Fossella was expected to make the announcement Tuesday.

Fossella, 43, has admitted to fathering a daughter with a Virginia woman.

The congressman's secret relationship with the woman, Laura Fay, was revealed after he was arrested for drunken driving May 1. Fossella was stopped after running a red light, and he told officers he was going to see his sick daughter, according to police.

From checking the NY State statues, I believe that Fossello chose (and from pressure from fellow Repubicans on the State and Fed level) to stay to the end of his term because if he were to resign now the seat would be vacant until the general election in fall. The Governor cannot appoint a temporary replacement (who would have a leg up to run in the general election) and he is in the 2nd year of his term. If a NYS Congressmember leaves by certain dates in the 1st year of in office or slightly into the 2nd year, they can be replaced in a special election. The NYS Governor can replace a US Senator if they end their term in an odd numbered year and some other conditions and replaced in the next even year general election.
While Rep. Fossella should resign now for his dispicable personal beheavior, to do so would mean his district wouldn't have a member in Congress for a while. I do hope he is replaced by a Demo - but they better be clean too!

Thanks for the thoughtful post. I' m a New Yorker, and there is no way a Democrat is going to get that seat.
Having said that, Congressman Fosello (R) was there for the 9/11 workers. He was a strong voice in Washington, and a big help to New Yorkers.

BTW, Blue Collar Tradesman and Liberal to the bone.

Fosella is Italian- Molinari is italian - I am an italian and I can speak to the fact that Italian men think nothing of having mistresses. They are also racists . I know, I grew up in a racist italian .home and a neighborhood full of italian racists. They love to talk about how much they love their families but think nothing of cheating on them.

They are also racists of the worst kind. Hippocrits - the whole lot of them

I happen to be an black guy who went to catholic HS in "da"" Bronx. I had a lot of friends Irish, and Italian. I was invited into their homes for Sunday dinners and other functions many times. Sure I had my share of the "n" word from the ignorant, but for the most part those who accepted me are loving Americans and human beings. Try not to paint a broad sweep. Hell HarlemFree Thought. I am glad you had a different experience. It does give me some hope. I wish I could attribute their ignorance to lack of education but that was not the case in my family and neighborhood.

However, I stand by my statement. I am sure the italians you met are exceptions to the rule.

As you're Italian, you must know you can buy your way into heaven, via grand donations to the Catholic Church....for new stained glass windows, perhaps a marble statue of the Holy Family. The bigger the sins, the bigger the donation. Mr. Fosella is gonna need to donate a new alter. And yes, I'm Italian, so I know.

Yes missjane - I went to catholic school for 8 years and I remember going to church every sunday and every holiday and having to fill the envelopes every week. They even had the nerve to publish a book every year indicating how much everyone gave for all to see.

Can someone explain why Fossella, a caring father who just had a drink, is being run out of town while Senator Vitter, with wall-to-wall prostitutes and responsibility for the death of a madam, remains in DC ??

How is it that the women get arrested and imprisoned and the men sit in their offices, get paid to be on legislative committees and let time pass until they are "rehabilitated" ??

I am not a fan of Hillary but her campaign has lasted this long because Men get free passes and women get the double standard: they service and their johns are on the loose.

Yes, but the problem is, HE ISN'T GOING TO STEP DOWN. He and his fellow Republicans would rather let a piece of scum like Vito sit among them for the next six months then risk losing ANOTHER seat to the Democrats in a special election. Amazing. And again, it's the hipocrisy that's the most painful, since Fossella was ANOTHER one of these "family values" hacks, all the while secretly having two families. Then to go and get a DUI, and not immediately enter rehab, as so many other recently druck politicans have done, just shows that the Republicans have given up decency in every way.

He deserves a chance to redeem himself - by stopping the illegal lobbying by foreign groups, foreign companies and multinationals that do not pay taxes in the US at all. If he takes the deal, then hopefully we can find more poor chaps who want to join. Everyone makes a mistake, but few are given a chance to redeem themselves.
