CLEVELAND — Sean Levert, a third of the 1980s R&B trio LeVert and son of lead O'Jays singer Eddie Levert, has died after falling ill while serving a jail term. He was 39. Authorities said Monday that an autopsy was inconclusive but foul play was ruled out.

Levert was sentenced last week to one year and 10 months in jail for failing to pay $89,025 in child support. He died at Lutheran Hospital in Cleveland late Sunday, less than an hour after he was taken there from the jail, said coroner Frank Miller.

Levert was sentenced by Cuyahoga County Common Pleas Judge Nancy Margaret Russo, who said a presentence report indicated he had been addicted to marijuana from the time he was 14 until recently. He didn't speak at his sentencing and gave no indication of any health problems, the judge said Monday.

His brother Gerald Levert, who had success as a solo artist after leaving their trio died in 2006 at age 40 of an accidental mix of prescription and over-the-counter drugs.

The brothers had formed LeVert in the 1980s with childhood friend Marc Gordon. Their hits included "Baby I'm Ready," "(Pop, Pop, Pop, Pop) Goes My Mind" and "Casanova."

"Casanova" was nominated for a Grammy in 1988 for best R&B performance by a duo or group with vocal. It was also nominated for best R&B song.

At Gerald Levert's funeral service in November 2006, Sean Levert and his father performed "Dance With My Father" and personalized the words for Gerald. The elder Levert's group, the O'Jays, was known for such smash hits as "Back Stabbers" and "Love Train."

Sean Levert found a new third partner last year and was trying to revive LeVert.

An autopsy was done Monday but no immediate cause of death was determined, according to Powell Caesar, a spokesman for the Cuyahoga County's coroner's office, but he said there was no evidence of foul play or trauma.

Levert suffered from high blood pressure and had been hallucinating in jail, Caesar said. Toxicology reports could take four to six weeks, he said.

Warden Kevin McDonough said earlier that Levert had been sick and guards were watching him at the jail's regular cellblock because he had been acting strangely.

Sean Levert had pleaded guilty last week to six counts of nonsupport involving children ages 11, 15 and 17.

Non-violent crimes desrve no jail time period. Too many people in jail as it is for stupid dumb stuff that can be handled with a fine or longtime community service.

Sounds like Diabetes. If he was hallucinating than maybe his pressure was up along with his sugar. Why didn't they send him to the hospital? It's not as though he was a threat to anyone. My thoughts and prayers goes out to his family!

I'm not familiar with him, but what a sad story. How does a man pay child support from jail? Thought there weren't debtors prisons any more. Wonder what caused his death? How long was he sick before the jailers sent him to the hospital? I'd want some answers if he were my family member. I feel sad for his father.

According to the story, he was "addicted to marijuana". Guess that was thrown in to make him look bad, but its not physically possible.

Deadbeat dads pretty much suck.
But with that said, I can't believe he was serving such a long sentence for not paying child support. Our country is a friggin prison state today, and they especially like to fill them prisons with them negros.
Only violent criminals should serve jail time with other violent criminals. And our courts should do its utmost against putting non-violent people in jail.

This is a crying shame. My thoughts and prayers go out to his family. It is unfortunately yet another reason we need intelligent drug laws in this country that deal more with rehabilitation rather than incarceration.

The following sentence does bother me a little: "Levert suffered from high blood pressure and had been hallucinating in jail." That might not indicate foul play but it does speak to the pitiful, subhuman level of care for prisoners in jails and prisons across the country. Someone who is hallucinating should not be allowed to remain sitting in an environment designed to punish. They should be treated.

I toured with LeVert in the 80's as a background singer for Glenn Jones for several months. Sean and Gerald were both adorable. This is such a tragedy for Eddie. Also a wonderful man with a huge heart. But the biggest tragedy is now the kids don't have their dad at all. As for the child support, I can only think that he must've been truly not able to pay it. I can't imagine him not wanting to.

how, in the year 2008, can a JUDGE publicly state that someone is "addicted to marijuana?" there's no such thing and for taxpayers to be funding the salary of a judge spouting such nonsense deserves immediate removal. oh i forgot. this is america.

This reminds me of the same issue with Bobby Brown that happened last year. He was taken to jail for failure to keep up with child support payments. He was taken into custody directly from his daughter's softball game, where I'm sure he wasn't supporting the other team.

Levert is in jail for an almost two year sentence, two years away from his kids. And to top it off, he dies in jail and they have to say hi and bye to a dead body. It makes no sense.

The marriage and parenting laws need to be changed. For centuries the pendulum of perceived power has swayed towards men. The current laws are a reflection of the pendulum swaying towards women, too far in my mind. The pendulum needs to be in a state of rest, we need to be on equal footing, I'm a man who recognizes members of both sexes today would be served to live with more compassion and humility towards others.

An ex co-worker of mine has been paying child support for 17 years for a daughter that he's never met. This is wrong, and does nothing to rectify what has and continues to happen to women.

He did die during his sentence. He was dying in jail. He lived only one more hour after being taken to the infirmary, which was part of the the prison.

There are many misleading headlines on this site. I don't think this one was bad.

So sad about Sean Levert! I know Eddie Levert is truly hurting now after loosing two sons in less than two years. Sean had a beautiful voice. If he had been acting strangely and I know he told them he had high blood pressure, and he was morbidly over weight. So why they didn't take him to the hospital or have a nurse check him out............. Somebody is going to have to answer some questions on why they didn't get him help in a timely manner........

How many d@mn years ago was "Brubaker" in theatres? This country has learned little or nothing since then - our prison/industrial complex gets bigger & bigger and the corporations get richer and richer...

You better believe the correctional officers/gurads watched him hallucinate,,,like he was a darn animalI worked in booking in WISC. for 2 years so I know how folks in jail are treated...If a persoh arrives with med problems, they would not see a dr. for days, perhaps a l.p.n to administer tylenol and that is it.

Even if he had his own medication to control his h.b.p Levert would not be able to take that...A doctor must approve your meds. and this process takes about 2 months! Only inmates with paying lawyers will get speedier assistance in regard to their pressing health problems.

I think deadbeat dads are awful. Child support should be automatically garnered from their wages or possessions, if they don't pay.

Jail, though? I think jail should be for violent offenders only. I don't think imprisoning people with other criminals is the best way to teach them how to lead a law abiding life.

Also, prison health care is notoriously horrific. This jail sentence may have been a death sentence. Of course, I don't know, but I suspect he might have lived if he had been on the outside.

Wow... I went to school with him. It's hard to imagine what the Levert's are going through right now.

All I have to say is that the child support order stops and unless he has a will or life insurance with the children as the beneficiaries then they'll end up with nothing. Unless of course the family decides to financially support them. I never did understand the logic behind locking up a deadbeat parent as if they can come up with money while in prison. It seems so unfortunate that a man dies in jail not as a criminal perse but a father who refuses to pay child support... somethings wrong with that picture.

Firstly the courts dont vare for the kids at $89,000 they allowed this to happen.......here's how it works.......they first look at the profile of the individual who is court ordered to pay the child support ig income potential Sean is a highly known R&B entertainer he has an income potential on a scale of 5 with scale measuring from 0 to 8. 5 to 8 are ranges of investment bankers entertainment stars fortune 300 to 500 company share holders highly publisize individual. so what do they do they allow it to stack then bammmm hit him for the high amount thinking with contact and such he wont serv to much time or time at all with the bail out he could raise, again potential income....how much of that 89 grand you think the children will get..hmmmmm......anyway its all a trap in child support the courts are looking to get paid is all. I urge if you have children and they need support stay out of the court system as best as possiable but take care of your dam kids and be respectful to mother and mothers do the same with the dads. Treat as a business between you that has an investment of love.

Eddie I pray and hope your Heart stays strong and that the memories you shared with your boys keeps your spirits high as time goes by God bless the Levert.
