ALEC, the NRA, and the Killing of Trayvon Martin

There is little doubt that it was George Zimmerman, a 28-year-old self-appointed "neighborhood watch vigilante," who shot and killed the 17-year-old Trayvon Martin last month as he "returned from a trip to 7-11 with an iced tea and a pack of Skittles."

Less known is the relationship between the Florida "stand your ground" law, which may allow the killer of Trayvon Martin to walk free, and a powerful but private, behind-the-scenes organization that has channeled such bills into the legislatures of Florida and other states.

The Florida law that is drawing such sudden attention due to the death of a teenager in Sanford "is the template for an American Legislative Exchange Council (ALEC) 'model bill' that has been pushed in other states," PR Watch's Brendan Fischer recently reported.

Fischer says that "Evidence suggests a major reason Zimmerman thought he needed to use deadly force against the unarmed Martin is because the teen was black... Zimmerman has not been charged with any crime."

According to Fischer, "The bill was brought to ALEC by the National Rifle Association (NRA), and fits into a pattern of ALEC bills that disproportionately impact communities of color."

It is no surprise that ALEC is hardly a household name. The American Legislative Exchange Council, (ALEC) prefers to do its business in secret. And since ALEC's founding in 1973 by Paul Weyrich (who co-founded the Heritage Foundation and is widely considered to be one of the Godfathers of the New Right); former Illinois Republican Congressman Henry Hyde; and conservative activist Lou Barnett, the organization has successfully stayed out of the spotlight.

If it weren't for the resolute reporting of a handful of investigative journalists and the extraordinary work of the Center for Media and Democracy's ALEC Exposed Web site, not much would be known about ALEC.

Source Watch, a project of the Wisconsin-based Center for Media and Democracy, described ALEC as a "semi-secretive" organization that "has been highly influential, has operated quietly in the United States for decades, and received remarkably little scrutiny from journalists, media or members of the public during that time." A report by the American Association for Justice, titled "ALEC: Ghostwriting the Law for Corporate America" described the organization as "the ultimate smoke filled back room."

As John Nichols recently pointed out in The Nation, "the shadowy Koch brothers-funded network ... brings together right-wing legislators with corporate interests and pressure groups to craft so-called 'model legislation.'" And while ALEC is predominantly concerned with cutting tax rates for corporations and wealthy individuals, privatization, de-regulation, and weakening, if not eliminating unions, it "also dabbles in electoral and public safety issues. And 'Stand Your Ground' proposals have for seven years been on its agenda."

Last year, when Wisconsin Governor Scott Walker unleashed an unprecedented attack on public workers in that state, and Republican-controlled state legislatures around the country began its assault on voting rights, ALEC's fingerprints were all over those initiatives.

From the NRA to ALEC to the states

John Nichols recently reported in The Nation that "The National Rifle Association led the advocacy on behalf of the proposal, [which was signed into law by then-Governor Jeb Bush] arguing that it was needed to provide immunity to gunmen who might use deadly force against unarmed individuals who they imagine to be threatening.

Media Matters recently pointed out that the language in "Florida's statute on the use of force in self-defense is virtually identical to Section 1 of ALEC's Castle Doctrine Act model legislation":

The Florida law states:

(3) A person who is not engaged in an unlawful activity and who is attacked in any other place where he or she has a right to be has no duty to retreat and has the right to stand his or her ground and meet force with force, including deadly force if he or she reasonably believes it is necessary to do so to prevent death or great bodily harm to himself or herself or another or to prevent the commission of a forcible felony.

According to Media Matters, "The language is identical to ALEC's Castle Doctrine Act model legislation, which they have been working hand in hand with the NRA to pass across the country":

3. A person who is not engaged in an unlawful activity and who is attacked in any other place [other than their dwelling, residence, or vehicle] where he or she has a right to be has no duty to retreat and has the right to stand his or her ground and meet force with force, including deadly force, if he or she reasonably believes it is necessary to do so to prevent death or great bodily harm to himself or herself or another, or to prevent the commission of a forcible felony.

"In a 2008 interview with NRA News," Media Matters noted, "ALEC resident fellow Michael Hough explained how his organization works with the NRA to push similar legislation through its network of conservative state legislators:

HOUGH: We are a very pro-Second Amendment organization. In fact, last session, I'll get off-topic here real quick, but some of the things that we were pushing in states was the Castle Doctrine. We worked with the NRA on that, that's one of our model bills that we have states introduce.

A 2002 report from Defenders of Wildlife and the Natural Resources Defense Council titled "Corporate America's Trojan Horse in the States: The Untold Story Behind the American Legislative Exchange Council," found that "the NRA is a longtime funder of ALEC." "In 1993," the report states, "ALEC adopted a resolution expressing its opposition to a waiting period to buy firearms and a ban on semiautomatic firearms. 'The administration and Congress should take a hard look at ALEC's resolution,' James Baker, the executive director of the National Rifle Association's Institute for Legislative Action, said."

SourceWatch points out that "The NRA was a 'Vice-Chairman' level sponsor of 2011 American Legislative Exchange Council Annual Conference, which in 2010, equated to $25,000," and that an NRA operative was "the co-chair of ALEC's Public Safety and Elections Task Force for a number of years, until the Spring of 2011.

Despite its modus operandi of secrecy and backroom dealing, every once in a while something so egregious happens that ALEC is forced out of the shadows. Investigations surrounding the cold-blooded killing of Trayvon Martin by a self-styled vigilante, could push ALEC out into the open.

Sure, ALEC might be getting a little media buzz, but their sugar daddies, (the Koch brothers) appear to have lost their traditional press shyness, so things are unlikely to change...

The NRA has about 4 million members. If 5 million concerned Americans would join the NRA in MAY, under a concerted effort, we can almost immediately change the policies and lobbying by changing the board of directors. I costs $35.00 to join.

One of the things to which ALEC is dedicated is privitization of public services. Notwithstanding that privitization results in higher costs to the taxpayer, with bad results (witness the charter school scam), many corporations that one does not usually associate with right-wing causes support ALEC because of that, such as UPS. It is not just the Kochs.

I have a hard time understanding what is uncivilized about wanting the right to own a gun to protect yourself and your family.

I also have a hard time understanding why Mr. Zimmerman followed Trayvon. If he had listened to the dispatcher, none of this would have happened.

The problem with Stand Your Ground laws is that when you are away from your "castle," the most reasonable response to a suspicious person is to remove yourself from the situation as quickly as possible. It is NOT reasonable to attempt an encounter. Call police after you have removed yourself from the situation.

Real life is not a Western shoot-em-up, or a video game.

During the weekend of Friday March 16 2012 to Sunday March 19, there were over 40 shootings in Chicago and 10 homicides, including the shooting death of a six-year-old Mexican American girl. And yet in Illinois there is no "stand your ground law". There is not any right to carry law in the state. No concealed carry. No open carry. None. This isn't about ALEC or the NRA or any "stand your ground law". People don't need laws to give them permission to kill other people. In fact, they seem to be able to do it quite easily even when there are a multitude of laws that prohibit it. This is about the lack of respect for law. This is about the lack of respect for human life.

According to that law, Trayvon had a right to defend himself, yet it's not clear he ever got the chance. He was chased down and killed in cold blood.

Putting a spotlight on ALEC changes nothing. We all know about the Koch brothers. How Wall Street controls the WH and our government (Along with Wall Street, Big Oil, Big Pharma, Big Agri, Big Banking, etc). The issue is a vigilante murdered an unarmed young man who was minding his own business. This is not a Stand Your Ground issue as Trayvon was acting in self defense. I am really incensed that a Florida prosecutor would already go on record stating getting a conviction against Zimmerman would be very difficult. These sociopaths put away innocent people on a regular basis. They get witnesses to lie. They hide evidence and keep it from the defense. Enough convictions and they get a judgeship and are never held accountable for this conduct. This seems to be an over-powering case of criminal conduct, a blatant series of law-breaking by Zimmerman and the police department and yet the prosecution wants nothing to do with it. How. GD. Typical. You may be right about ALEC, but so what? They are not going away. They don't care about being in the spotlight. What I want--What we want is this vigilante brought to justice. Is that too much to ask?

Putting the spotlight on ALEC certainly changes the picture. The public needs to know that there is a group hiding a secret agenda to change the landscape of America. These people make Louis the Fourteenth (a repressive French king) look liberal!!! If we do not become aware of the ALEC members among our legislators and become aware, once again, of the Koch bros. and others of their ilk we will all wake up to a new American landscape that will make the old USSR look like a paradise.

Mr. Zimerman has set himself up to be shot by others. Here we have a man who has shown thru his actions that he is "trigger happy" and scared of blacks. There may be someone who, if they encounter him, just might shoot first and ask questions later because they know what he has done.

For Christ's sake, hasn't Geraldo explained to us all it was the result of the teen wearing a hoodie? Hoodies, really? How about this Geraldo...the NRA, the gun lobby, gun right advocates across the country are as guilty as George Zimmerman in the killing of this youth. Yes, that's right, as guilty as if they all pulled the trigger.

Hoodies, Really? How about 300 million guns in a country of 310 million people! That is not, by any reasoning, by any definition, conducive for a civil, civilized society. With that ratio, there is no likelihood that these senseless killings will end. No amount of school prayer, mandated or otherwise, will make any difference. No changes in movies and video games, mandated or otherwise, will make any difference. No amount of counseling or eliminating school, workplace, or neighborhood bullying will make any difference. And most certainly wearing a hoodie or not will make no difference

These killings are now a permanent fabric of American society and life as a result of our gun culture. It places all Americans, anywhere in America, at risk of literally being in a war zone at any moment

Thank you HP. Are there other bills effecting other groups? A law to kill blacks, and there are many that unjustly lock us up too (unconstitutional). There is a warning here, we see what is happening in the Middle East, leaders held in power for dozens and dozens of years, like Mabark, and Gadafah, Siria, and these leaders felt they had their situation in the bag, and the people are saying, we will not take it anymore. And today we see something going on in the Middle East that will shake up the world, once that revolution is over. I said that to say to the NRA, and ALEC, we know about your secret meetings now. Without the lawmakers, they would not be able to do these things. Many black families suffering, their family member locked in these prisons, for crimes that do not justify the time. Laws that been on the books for more than a hundred years, such as armed robbery, these laws were created for horrific criminals like Jessie James, Bonnie and Clyde, and the list goes on, and on.These criminals crime involved taking thousands and thousands of dollars, and killing everybody in the bank. The Scott sisters, charged with armed robbery, of $11.00, got two life sentences each, they stayed in prison, almost 20 years, but they are out now, thanks to, guess who? Haley Barbour, and their brilliant atttorney.

My question is how can a state get rid of the stand your ground law? It's obviously having disasterous consequences. Having a gun for self defense is one thing but all too often irresponsible people use them for their own idea of justice.

ALEC, the Koch-funded legislative lobbying arm, couldn't care less about the death of a young boy, or anyone else, for that matter. They are only concerned about how much they can squeeze out of the people and soil of America. Their goal is to decrease the "surplus population" so they can have more for themselves.
