A Time to Choose: DREAM or Impeach?

That didn't take long. No sooner had President Barack Obama announced his decision to suspend deportations of peaceful DREAMers than Republicans responded with calls for his impeachment. The president acted within his executive and prosecutorial discretion and the Republicans know it. But they have to admit that to their fervent followers. Will they choose to DREAM or impeach?

The Obama administration announcement itself is a courageous and common sense move toward immigration reform. For years there has been bipartisan consensus that children of illegal immigrants who have come here through no fault of their own, worked hard and played by the rules deserve a fair shot at education or military service. Today the president acted as chief executive law enforcement officer to prioritize deportations by putting violent criminals first and otherwise law-abiding children last -- a decision well within Barack Obama's executive and prosecutorial discretion. As a former sex assault and child abuse prosecutor, I want the violent criminals especially those who kill, rape or assault children deported first, and believe most Americans would agree with that law enforcement priority. Deciding to allow temporary status for immigrants is also within the president's discretion and happens on a case-by-case basis in every jurisdiction. What changed today was the sweeping scope of those decisions.

Of course there can be disagreement on the policy -- but that doesn't make the policy illegal. However, well before the president spoke in the Rose Garden, the backlash began. I was on radio with Geraldo Rivera defending President Obama to a caller wanting to impeach him for helping DREAMAct kids. OK, I thought, maybe this is a one-off. But I took to Twitter and a simple search revealed that a vast number of self-identified Republicans, Tea Party activists, and/or Romney supporters were calling for impeachment. Not Congressional action to undo the decision or to pass their own version of immigration reform -- but Congressional action to impeach the President of the United States for refusing to deport the noncitizen children of illegal immigrants.

The blogoshpere was replete with calls for impeachment over President Obama's "illegal" action. Then one by one GOP lawmakers and Romney supporters came out with statements calling the president's decision "illegal" -- a dogwhistle to the impeachment crowd. Whether this immigration reaction was as coordinated as the Republicans' "defeat all things Obama" inauguration night dinner plot or merely coincidence we don't yet know, but what we do know is that this fight comes down to what makes a person an American.

One self-described "conservative tea party anti-establishment gun nut" tweeted me this: "If you're here illegally, you aren't an American, got that?" Actually, I don't get that. I agree with President Obama who said "these are young people who study in our schools, they play in our neighborhoods, they're friends with our kids, they pledge allegiance to our flag. They are Americans in their heart, in their minds, in every single way but one: on paper. They were brought to this country by their parents, sometimes even as infants and often have no idea that they're undocumented until they apply for a job or a driver's license or a college scholarship."

The president provided a clear choice -- he is with the DREAmers. I'm not sure where Mitt Romney stands or how many positions he will take on. In this campaign he supported "self-deportation" during the debates and had two positions today -- his advisors saying the president's move was "illegal" (that dog whistle word again) and then the governor's own written Marco Rubio-esque statement acknowledgement that something must be done but this prevents Congress from passing a law to do it. (Actually, it doesn't, because Congress could bring up the DREAM Act on Monday). Letting DREAMers stay -- under Rubio's plan or Obama's is the opposite of self-deportation, so it will be interesting to see whether the conservative media that heckled the president for keeping his word will do to Romney for breaking his word.

The same Romney supporters who oppose the DREAMers, who want to amend the 14th amendment to take out "so-called "anchor babies" are now urging impeachment -- not mere electoral defeat -- of the president. This is another step down the road of illegitimacy from the birthers who claimed he should not be elected, to the heckler who thought he shouldn't be able to speak in his own White House, to the impeachers who don't want to wait for an election to resolve their differences with President Obama. This devolution is a danger to immigrants who should not be scapegoated for American's economic challenges. We need to be creating jobs and ladders of opportunity for all Americans, not dividing by race or national origin. We need to connect with millions of Americans who support helping kids who are here illegally through no fault of their own get a chance to work hard play by the rules and get a fair shot. We must stand up for the president against the calls for his impeachment and urge the press to ask Romney whether he agrees with his supporters that the president committed an impeachable offense or whether he disagrees.

What do you believe? Whose side are you on? It is time to take a stand, as the president did today, about who is an American. It is time to choose: DREAM or impeach?

I think there is a real case to be made to impeach Obama.

His actions have reached a point where he is systematically alienating the people who voted for him and riled up the republicans just before the election since republicans will ill now be energized to make a strong pitch to get him out of office.

Whichever way the ruling on SB1070 goes it will not be good news for illegals so he is batting zeros there too.

I would not be at all surprised if the Democrats woudl see Biden as a better option for them to win out in this election than Obama so would be happy to see him impeached.

If you knew your history at ALL, you should know that Republicans are responsible for the civil rights act, freedom of slaves as well as Social Security/Medicare which the dems in COngress have systematically STOLEN and pretend it is in trust.

So if you are looking for America's greatness, you'll need to rethink about your deportation habits.

Here is the solution. It doesn't sit well with me, but say we granted a mass amnesty for all. Fine, we take these people in and give them a better life, but lets take steps to ensure it never happens again. It's a 4 step process. 1) Janet Napolitano resigns immediately, and she is replaced with someone that can do the job. 2) We finish the border fence she halted. 3) We fire anyone one with the title "czar" and reduce all foreign aid by and least 10% to pay for the hiring and training of more border agents. 4) We send a memo to the President of Mexico telling him we're locking it down and any of his citizens who want to get in can get at the back of the line and apply like every other law abiding potential immigrant does.

Your idea wouldn't work any better than the 1986 amnesty did.

The only thing accomplished from that is we learned rewarding bad behavior gets us more of the same. amnesty/reform/pathway/allowing them to stay is why we have so many illegals now.

The only thing that will ever work on this is the EXACT same things that have worked for every problem like this in the history of mankind.

1.Stop rewarding them
2. Punish those who break the rules
3. Remove the ability to profit from the actions.

Until we do these things they will continue to come. They see amnesty and flood over the border or overstay visas. They see higher paying jobs and come. They see this president (and others) granting them largess and they come. The employers see nobody being punished.

We have tried amnesty 7 times. We have had promises of more enforcement but it is ineffective or won't be funded next year. Never again.

Maybe I need to read between the lines.. but the three things you mentioned hopefully don't apply to the illegals themselves vs the large American business interests, corporations, and construction businesses which openly favor illegal immigration as a source of cheap labor. We need to
1. Stop rewarding them for using the fear of deportation to ensure low wage labor
2. Investigate hiring practices of businesses who employ illegal laborers .. including high tech workers overstaying their visas.
3. Remove the profits derived from companies which use illegal laborers.

We have drones patrolling all over the world to find terrorists but we can't see 30,000,000 people slipping across our border with Mexico(and stepping out of the ocean from Chinese freighters and shipping containers) over the course of 30 years? That strains credulity and lets us know that it is a coalition of interests who have no concern about American citizenship.. including those waging a racialized attack on President Obama's Americanness!

btw- since pelosi claims issuing the appropriate contempt charge against holder was racist and led the whiny dems walkout like big babies. I have to wonder if she was racist against Pres Clinton since she didn't lead the walkout when he was impeached.

You need to do your homework, Christine. Americans of all political stripes are disturbed by this president's repeated abuse of power and violation of separation of powers doctrine. Even if you agree with him in this particular instance, think twice about voting for someone who is not respectful of our system of government. A vote for Obama is an endorsement of his abuse of power and sets a bad precedent for the next president just like Bush's abuses emboldened Obama's bad acts.

Now that was well put. Many ignore his blatant disregard for the laws because they like him, which makes the situation even more dangerous. Between that, and his protractors playing the race card every time someone disagrees with him, what couldn't he, or any elected official like him get away with? Just because you agree with what someone does doesn't necessarily mean they were allowed to do it. Frighting stuff. I like the comparison to Bush though. What many fail to realize is the scary similarities between the two. Many of Bush's controversial policies )like-say, The PATRIOT Act, which he campaigned against, but renewed) have been continued under Mr. Obama. But again, his supporters fail to make the connection.

Obama swore to uphold the laws and constitution .........He has done neither ......... The only way he can get his bad ideas into force is to skirt the laws ....... Impeachment is the correct path for him .....As for the innocent illegals ........ let them follow the same laws everyone else does ........ nothing more ....nothing less........ Prosecute the parents for kidnapping and for illegally bringing them here ......If you take your child with you to a bank robbery and get caught ,you can bet the law will take them from you .......... Deportation is what the law states .......... simple isn,t it ?

If amnesty worked we wouldn't have any illegals here would we? After all we have tried this way 7 times and the only thing it does is encourage more of the same. Just like this one will. Any doubts that crossings will rise?

Yes, of course there would be complaints no matter what, but the timing was planned. Just like waiting for a COLA increase till this year. If you agree with this executive order that's fine, but please be reasonable and except that it was a reelection ploy. The man only really cares about one thing right now.

I firmly believe President Obama's actions would be totally against the U.S. Constitution as the founding fathers envisioned the document. If memory serves right, President Bush also made a few decisions that might have overstepped that authority. Unfortunately too many people only want to look at the decision as something they thought should happen. If they can't get it through congress, they applaud any way, by the courts or Excecutive Order that gets the issue passed. They are more worried about the issue than proper procedures. This only results in worse government in the future reguardless of political party or view.

Unfortunately, it's within his power to enact this order. Thanks 08 voters. I have a soft spot for kids (not people up to 30 as he suggested, people 17 and under) and this is fine by me, but I'd like to get something back-like a secure border so we never go through this nonsense again. Never will happen though.

No it is NOT! He can NOT subvert the legislative process just b/c he is desperate for votes.
Congress voted NO on the DREAM ACT. If he was that concerned, he should have stayed in the WH and crafted a bill and worked with COngress to find a compromise. Instead he played golf, (new sport for him), basketball, and outsourced his job to total idiots like pelosi and reid. Look at the mess they made of obamcare that is now obamaTAX.
oh btw- he forgot to mention if u make under $100k, this obamaTAX is gonna hurt. bad. real bad.

Not really. Prosecutorial discretion means, for example, a DA can decide in a particular case not to pursue a drunk driving conviction because the driver ended up killing his own son. It is something based on the unique circumstances of a particular case. It does not change the underlying law. Obama has laid out a new class of people who will not be prosecuted if they fulfill the requirement of this class: here for 5 years, under thirty years of age, no felony convictions. This is making law by executive order, rather than prosecutorial discretion. But I'm no lawyer and neither are you. So what do you say we ask the Supreme Court to rule. Are you ok with that?

Dem or Rep, the President went well beyond the scope of his authority with this exec. order that is in direct contradiction to the law. As a constitutional law professor, he knows this as well, which means he realizes it will quickly be overturned. So then one must ask themselves, "why such a foolish act by someone who knows better?" Politics, un-pure and simple.
