Hope my re-posting of Veteran Intelligence Professionals for Sanity (VIPS) colleague Ray McGovern's piece doesn't confuse folks. Mr. McGovern doesn't have a blog page on Huffington Post and is too busy to get one right now as he's out speaking to folks. But his recent piece (which follows) not only relates to Arianna's recent question to Nancy Pelosi as to whether she (Pelosi) is "too well behaved to get us out of Iraq" but also relates to efforts in Congress to reform the FISA. So I thought Mr. McGovern's insights merit being re-posted.
What Did Pelosi Know, and When Did She Know It?

Will House Speaker Nancy Pelosi come clean now that it is clear that the National Security Agency (NSA) was turned loose on American citizens well before 9/11? She has admitted knowing for several years about the Bush administration's eavesdropping on Americans without a court warrant. She was briefed on it when she was a ranking Democrat in the House Intelligence Committee when Bush and Cheney took office.
But was she told that within days of their taking office, the National Security Agency's electronic vacuum cleaner had already begun to suck up information on Americans--criminal law and the Constitution be damned?
In a Washington Post op-ed of Jan. 15, 2006, Pelosi, with a uniquely long tenure on the Intelligence Committee, acknowledged that she was one of the privileged handful of lawmakers who were briefed. Referring to her seniority as ranking member, she wrote in an apologia-sans-apology, "This is how I came to be informed of President Bush's authorization for the NSA to conduct certain types of surveillance." She then proceeded to demonstrate her remarkably--one might say unconstitutionally--subservient attitude toward the Executive Branch:
But when the administration notifies Congress in this manner, it is not seeking approval. There is a clear expectation that the information will be shared by no one, including other members of the intelligence committees. As a result, only a few members of Congress were aware of the president's surveillance program, and they were constrained from discussing it more widely.
How did the American people react upon reading in the New York Times in Dec. 2005 of this glaring infringement on their Constitutional rights? Most responded as they have been conditioned to react--out of the old fear-factor shibboleth: "After 9/11/2001 everything changed."
What one can blame them [German politicians and populace] for, and what shows their terrible collective weakness of character, is that this settled the matter. With sheepish submissiveness the German people accepted that, as a result of the fire, each one of them lost what little personal freedom and dignity was guaranteed by the Constitution; as though it followed as a necessary consequence. If the Communists burned down the Reichstag, it was perfectly in order that the government took "decisive measures.

These illegal operations, including those prior to 9/11, were enabled by Michael Hayden, then head of NSA and now director of CIA. Hayden has been out in front "justifying" illegal eavesdropping by what happened on 9/11. Did he know the illegal activities started before then? Of course he did; he orchestrated them.
Did he know they were illegal? Another no-brainer. While director of NSA, Hayden had emphasized what had long been known as NSA's First Commandment: "Thou Shalt Not Eavesdrop on Americans."
But in testimony at his confirmation hearings, Hayden said that in the wake of 9/11 he "could not not do" what the president wanted him to do with the "Terrorist Surveillance Program." The hypocrisy is well nigh unbearable.

When the program was revealed in the press in late 2005, Hayden agreed to play point man with smoke and mirrors. (Small wonder that the White House later deemed him the perfect man to head the CIA.)
Even so, a whiff of conscience showed through his nomination hearing when he flubbed the answer to a soft-pitch from administration loyalist, Sen. Kit Bond, R-Missouri:
Did you believe that your primary responsibility as director of NSA was to execute a program that your NSA lawyers, the Justice Department lawyers, and White House officials all told you was legal and that you were ordered to carry it out by the president of the United States?
This is not a backdoor approach. We believe Congress has authorized this kind of surveillance. We have had discussions with Congress in the past - certain members of Congress - as to whether or not FISA could be amended to allow us to adequately deal with this kind of threat, and we were advised that that would be difficult, if not impossible.
The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.

Why do we keep sending the beneficiaries of the status quo to Washington to change things? After all, to them, a few subjects aside, things as they are are working out pretty well. For them.
Let's see, impeach Cheney, Bush appoints McCain VP.
Impeach Bush, McCain becomes prez. Bomb, bomb, bomb, bomb, bomb Iran. Impeach Bush and Cheney at the same time and Nancy becomes prez. Bomb Turkey.
Ms. rowley, I'm glad you posted this. I first read Mr. McGovern's article on TomPaine.com and posted the link in the massive comments section following Arianna's Pelosi interview. The continued warrantless wiretapping is but one reason for impeachment. There are others. Take a look at this article posted on TomDispatch detailing the administration's paper trail over what it calls "harsh interrogation techniques" and what US and international laws call torture.

Even if you give Pelosi the benefit of the doubt that she knew little about warrantless wiretapping, enough evidence exists to at least open investigations into whether the administration has committed crimes. Ms. Pelosi must revist the impeachment issue. If she doesn't, then she should step down. My advice is to start with Cheney.
I understand your frustration with Pelosi. However, she is who she is. A well coiffed upper class society type who is all about image and rubbing shoulders with her rich pals. It kind of goes along with a lot of this stuff. If you read between the lines you can see that Washington elite works together to keep hold of power and for the most part keep the status quo in force. She is very much part of that as are many other democrats. the surveillance is a part of that. So is NAFTA, so are the cozy credit card company deals, so are the HUGE military contracts being given to companies who give money to BOTH republicans and democrats(Pelosi included). At the end of the day Nancy is above it all in her mansion and her fancy designer clothes.
Tommy d'Alessandro is surely rolling in his grave like a corkscrew to see the wimp his little girl turned out to be.
He was good at compromise but he didn't compromise principles. If it's true that she knew all this shit before-hand and took impeachment off the table to protect her own involvement, then she needs to go as well as the rest of the enablers. They all promised to uphold and defend the Constitution, and if they've breached that faith they all need to go in 2008, if not before!
Can you imagine the turmoil and impact this would have on Washington, if everything could be proven?

can't initiate impeachment, but could plea bargin
to not be impeached, right? I mean if she would
testify under oath, what really happened.
Course, all this has to be proved. Right now its
only a senario.
Pelosi made an extreme error by taking the impeachment issue off the table, and it was clearly unconstitutional.
Arianna made a rookie error by taking the issue off the table in her interview, where she replaced her judgement for her readers'.
There seems to be entirely too much "deal-cutting" in Congress lately with our constitutional rights. Today's Washington Post is reporting that "Senators Say White House Cut Deal with Panel on FISA documents Said to be Traded for Telecom Immunity":

Excuse me but they can't just auction off the Constitution to the highest bidder this way! "RealSoft's" comment below about morality and legality being "fuzzy" is unfortunately somewhat true right now but it's high time we brought them back into focus, especially as to where constitutional rights are concerned.
Simpering Nancy should resign
Now that it is known that she has been a silent collaborator for a couple of years in the invasion of privacy of American citizens, she is just as guilty as those who engineered the takeover of our Constition.
No wonder she "took" impeachment off the table -she would have to line up with the culprits.
Is there anyone we can trust in Congress?
Impeach now. Bush or Pelosi.
Pelosi is a proud self-certifying enabler of the war on the Constitution.
And we thought the Repukes were obstructionists.

I sincerely hope someone sends this to the speaker. She's become a symbol of what happens when a woman is elected to a position JUST BECAUSE she's a woman and it'll be a first.
Richard Nixon's reason for resigning was that he did not wish to tear the country apart. That was a lie to cover up his fear of facing Congress and not a truthful reason to avoid Impeachment. Impeachment proceedings of George Bush and Dick Cheney would raise the hope of this nation and unite us all like nothing else. Impeachment is the only thing that could counter the divisiveness of Bush Cheney & Company, the Enron Administration.
Can't you almost imagine her squeeking like a mouse?

The time for passion is now.
Ms. Rowley is leveling some pretty serious charges at House Speaker Nancy Pelosi regarding the latters alleged suppression of her knowledge of the NSA wiretapping project prior to 9/11.
However, Ms. Rowley's premise for those accusations rests almost entirely upon the supposition that the Bush administration was being entirely candid and forthright with the then-ranking member of the House Intelligence Committee and her colleagues during those closed-door briefings.
Considering this administration's six-year track record of almost casual disdain for truth and fact and constitutional separation of powers, the likelihood of that ever having occurred is, at best, rather dubious. To be sure, Ms. Pelosi's attitude in 2006 appeared entirely too casual and trusting, given what we now know. But then, hindsight's nearly always 20/20, isn't it?
If Ms. Rowley says the sky is green, I'd believe her before Pelosi or Bush saying the sky is blue.
Pelosi is just a whore, like Reid , like the rest. Republican and Democrats united for one cause. The betterment of their position of power, and the cause to fill their bank accounts. Each and every last one of them are driven by greed over morals or devotion to those who elected them to their seats. They lie to us, and gladly take, and give to the capitalist and warpigs of the world.
We no longer have anyone representing, or who can even pretend to represent, the best interest of the American Public.
The reason Pelosi has turn traitor is because she has never turned! she has always been a traitor!
This is why she will never admit to her inner dealings as it would expose the real TRAITOR Pelosi for all she is worth.
Pelosi wants to keep "Impeachment OFF the table" because it would expose her own complicity.
Dammit woman! Impeach the bastard and his trained seal Cheney.
