He should have asked for a change of venue. A FL jury might have said he felt his life was in danger.

In this case it was not self-defense, looks like the old man would kill anybody or animal that got in his way. Ted Bundy started out torturing and killing animals, and when that no longer satisfied his evil desires he went to humans. I don't know what happened here, only one sided story, but if the man was mentally ill why did he have a gun or any other weapon for that matter? Sometimes I know young kids likes to taunt mentally ill people or the disadvantaged, I see it happen all the time, so kids need to be taught to never mock somebody, I am not saying this is what happened in this case, but 13 and 14 yr. old kids can be pretty mean.

"Spooner's defense attorney, Franklyn Gimbel, never denied that his client shot Darius. Instead, he argued that Spooner did not mean for the gunshot to be fatal."

As an attorney, I'd just like to note that that's one HORRIBLE defense attorney Spooner's got there. "Oh my client meant to shoot him but he only meant to wound him, thus showing that he had the requisite mental capacity to form the intent necessary to commit the crime and thus destroying his insanity defense."

I seriously don't know what people think a bullet does. Do they have absolutely no training whatsoever?

Even with this, some people are still blaming the kid. Really? Even THIS guy, you take his word?
04:21 PM on 07/18/2013
Yep, they'll say that he'd still be alive if he didn't go outside. They'll probably also blame his mom for asking him to bring the trash cans in.

He has a history of violence, not mental illness.
He's not crazy, he's another violent offender that has been getting a free ride.

"Spooner's daughter once brought home a kitten that he didn't want so he took it into the basement and killed it, Jackson said. Spooner also used to choke and beat his late wife, the doctor testified."

Probably should have been in prison along time ago, put him in prison where he belongs.

So a white man shoots a black boy and he's mentally ill. If the roles were reversed the words "mentally ill" wouldn't have been thought of. He would have been found guilty and on death row.

If the cops didn't say he was trying to evade arrest when they shot him first.

Very similar case to Trayvon Martin with both victims fasley accused of crimes. The only difference is Trayvon had a chance to fight for his life and this young man didn't. If he had the chance GZ supporters would be crying self defense. So I guess they want these young men to just stand there not defend themselves and take a bullet.

When I was growing up, most kids had the same surname as (both) their parents. That seems to be the exception nowadays...

Probably not since there was also an eye-witness, and he didn't have any sort of defensive wounds that would support him if he claimed he were attacked.

With stand your ground laws one doesn't even need to be physically attacked. One only has to be reasonably fearful for their safety. I don't know if WI has the same type of laws as FL, but if it did and there were no video or eyewitness reports this man could easily have received a free pass for murder.

Uh, I don't know. I hear this kid smoked some pot. Oh, and there was an awning piece in the bushes next to him. No telling what he was going to do with that. Oh, and he confronted the guy that was after him. Big mistake. Oh, and he forgot to bring a gun to a fist fight. Ya know, those righties can't win a fight without cheating. Sort of how they win elections too.

Being that Wisconsin is a Castle Doctrine but not a Stand-Your-Ground, state, it seems to me that if Trayvon had been killed in Milwaukee then Zimmerman might've actually been convicted. But that's just one of the very MANY differences in these two cases. Let's remember who THIS case was about - an innocent 13-year-old child named Darius Simmons who was killed while doing his chores. His family deserved justice, and they got it today.

Kind of like a long tailed cat in a room full of rocking chairs - won't be long now.

Seriously, he won't be in prison long, if any, because the guy said he had terminal lung cancer.
