Nothing will happen to Cuban. He's a MAN. But the SEC had no problem going after and imprisoning a WOMAN. With all the blatant corruption on Wall Street, it was MARTHA STEWART who ended up in jail.

How the case turns out will depend on the people that wind up on the jury and their mindset.

I thought that the only reason that the case was brought against Marthat Stewart (which wasn't insider trading case---it was lying to federal investigators) was that the government was feeling heat from the public for not getting cases against the likes of Ken Lay, Jeff Skilling, and Bernie Ebbers to trial quickly.

By the same token, I think the jury in the Martha Stewart case got it wrong. I don't think the government got past reasonable doubt, but the jury was bound and determined to send a fat cat to jail, regardless of the evidence.

I hope you smoke them in court , I'm a normal guy make a modest pay I was charged civil and criminally for a trade I made in 2008 , my trial was in October they used all smoke and mirrors , circumstancal evidence and even some lies but the jury was confused and I had no money to afford a lawyer who understood insider trading cases so the govt took full advantage of the situation. I make a modest pay of around 7oK per year they fined me over 3 million dollars and I'm in jail for a period of time too. Financially I'm ruined for life because of it , the sad thing is that if I had money to have afforded proper council I would have won. 5 other people were also investigated they all got off with a fine only and no criminal charges ...Its really sad how the govt targets the small fish and uses us to make themselves look better .

Ziggs - you were targeted by GOP-appointed prosecutors who were empty suits or morally corrupt. Remember that Rove had purged the AG office on the basis of ideology. And sadly, the DNC has not purged that generation of empty suits because this President is not willing to violate the law and the rights of the lawyers in the AG office.

False, smokerob. She did not "steal" millions. An attorney (male) phoned her with information, she traded on it, and then denied it under penalty of perjury. She was jailed for perjury, not for theft.

I don't envy the lawyers trying to pick a jury. Unlike financiers like Warren Buffet, Carl Icahn, and Norman Pletz, Mark Cuban owns a sports team and is very visible at Mavs games, sitting either courtside or in the cheap seats, rather than in a luxury box.

Plus, he's on ABC every Friday night in prime time.

People either love him or hate him. There is no middle ground.

What's going to make it harder is the fact that the trial judge already dismissed the case once. Some people might very well think that if the judge dismissed it once, that a trial on the remand is a waste of time.

Oooooooooooooo, puhleeeeeeeeeeeeeeeeeeze.  This trail is being held in Dallas.  And Mark can afford the very best jury selection specialists.  The government will be lucky if the jury doesn't award Mark court costs for the trial.

That's just it. The trial is in Dallas. The government will have to dismiss a lot of jurors for cause. The have Mavs season tickets. They are Mavs fans. They watch Shark Tank and like Mark more than Mr. Wonderful.

Then, there are people who don't like Mark, because he is brash.

Yes, Mark will have his jury specialist, but it still will take time. Too many people know of Mark Cuban. If you had the case in any other major city, it would also be difficult, because Mark is so well known. You have probably seen his face on SportsCenter, the sports segment on the late local news, SI, or the local sports section.

Remember that it took a while for the attorneys to pick the Oprah jury in Amarillo, TX, and she had Dr. Phil as her jury speciialist. That still took several days.

here's where I COME TO THE DEFENSE OF THE BILLIONAIRE! Mark Cuban has been an outspoken critic of patent law! This has probably rattled the Obama admin. There are millions of large companies that are making a killing by stifling the us economy preventing ordinary people from developing new technology. This may have resulted in his losing some of his luster among the ONE PERCENT....or did he miss a payment to the right people? Anyone who doesnt do what the one percent want get targeted and I cannot believe that anything has changed....even Mark Cuban, once a star of the One Percent can get hit if you get in their way....as for the PATENTS? I WOULD LIKE TO SEE IMMEDIATE MOVEMENT AGAINST ANYONE WHO TRIES TO INTERFERE WITH AMERICAN PROGRESS....there are a million different ways to do the same thing....IT IS ABSURD TO SEE PEOPLE MAKING BILLIONS BY PREVENTING OTHERS FROM INNOVATING...

Mark Cuban is a class act and the most humane of the Sharks. The Shark Tank can be heartless in their actions, sometimes exemplifying how greed is good, but Cuban is not one of them, so he'd get a break from the universe if I were judging the fine points of this case.

You're right that Mark does try to steer people the better offer, which usually isn't Mr. Wonderful's offer.
