The S.C. justices are undoubtedly extraordinarily bright individuals but perhaps not well-trained in the field of economic theory and policy analysis. Presumably, they would ask for translations if confronted with language such as marginal personal cost, marginal social cost, externality, consumer surplus, producer surplus, deadweight loss, transaction costs, cap and trade, etc. They are not going to go back to school.

Nearly all of congress wouldn't know those economic terms either. Really sad that the most politicians we elect really don't know what makes an economy go, or how decision are made to expand, invest, etc.

I have a simple solution that will illustrate the C02 problem. Put plastic bags ovr the heads of the Justices with air hoses attached and gradually change the mixture of air going into the bag by increasing the amount of C02 in it.

Maybe they will get the general idea.

Marcus, this column is a good idea. My issue with the President's shameless endorsement of seeking out those pesky regulations that hamper small businesses is that it appears that at least half of the complaints concern environmental issues. For example, I live right next to the Coors factory in Colorado. I'm sure they're all pissy and whiny now about how their bottom line would just shoot up if they could just dump all their waste in Clear Creek, but so frigging what. That doesn't mean that it's a good idea.

The adhd American public cannot differentiate between short-term profit and ethical and reasonable long-term solutions of mutual benefit to both corporations and the public. Not to mention, we certiainly have a proven track record of usually voting for everything that will screw us.

I think Arianna Huffington termed Obama's idea du jour "political demagoguery." Good word choice. Plus, let's get real--he's hardly the biggest part of the problem. Now we have a House full of corporate enthusiasts hell-bent on recreating the Love Canal, and what you said about the Supreme Court is not exactly news, but definitely a reminder to be freshly alarmed. I've enjoyed your column so far, and look forward to more.

OH MY GOOOODDDD! I know all about the love canal...... worst atrocity to the upper NorthEast ever! And so few peope know about it. Although I'm an avid fisherwoman, I would NEVER eat fish from any of those streams or lakes.

I have heard from prestigious lawyers from three different allied countries that our Supreme Court is not held in high regards at all, vis a vis arguments, logic, judgements, precedents, etc, etc, etc.....

Sounds interesting, but a little thin on details. Which allies (for starters) or any specific instances of the arguments, logic, judgments, etc. Don't doubt it, actually have a few suspicions myself, but IANAL.

BTW the only qualification for being a Supreme Court Justice is to be 35 years old. :)
