I am not a lawyer, but the argument that the Republicans are making just seems completely ridiculous.
Unless Wisconsin law is just plain goofy, the mere fact that the Reference Bureau publishes something that purports to be validly passed legislation cannot in and of itself make the thing law over the objections of a court that wants to consider whether a legal process was followed and whether the state's open meetings law was followed.

Isn't the role of the Reference Bureau basically just to serve as an archive of public documents? Surely the Bureau does not get to decide for itself whether the documents are what they purport to be, does it?

Challenge the law if you wish but it seems clear that you must wait until after it's published. The Supreme Court's decision in Goodland v. Zimmerman, 243 Wis. 459, 10 N.W.2d 180 (1943) makes this clear.

In an odd twist, the law was nevertheless published today and will become effective tomorrow. This isn't defiance of the judge's order by the Republicans or Scott Walker. They didn't do it. It's not defiance of the law at all. It seems to have been mandated by the law. Let's work through it.

35.095 (2)(b)The person numbering an act under par. (a) shall note on it the date of enactment and shall deposit it in the secretary of state's office no later than the next working day following its enactment.

The secretary of state assigns the new law a date of publication. On or before that date, copies of the act in pamphlet form, called a “slip law”, must be available for public distribution. The secretary of state must publish the act’s number, title, and original bill number within 10 working days after the date of enactment in the newspaper designated as the official state paper for publication of legal notices (currently the Milwaukee Journal Sentinel). The notice contains the date of enactment and date of publication and states the act is available for public distribution. The act takes effect the day after its assigned publication date, unless another effective date is specified in the law itself.

Well he will Run. But it will be for the Hills. The destiny is a sad one for Mr. Walker. First he will be recognized as a pyorrhea: His picture, his presence, his name will be synonymous with betrayal and Disgust. Then those who launched this misfit to do their bidding: Will also realize the liability he poses. He'll likely be discovered in a shallow grave in the University endowment lands. Ya know, in January Walker ushered through his $140Million Dollar Tax Cut to his CorpThug Bosses....

hmmm..;. maybe if Walker had not given his CorpThug Bosses a $140 Million Tax Cut then that $137 Million Dollar shortfall - would, in math reality, be a $3Million dollar SURPLUS and teachers would not have to have their monthly wages reduced

but don't you know that through cutting taxes to 0% for all Corporations, they might just possible... for a nanosecond, just have a hint of a tinge of a guilty feeling and consider for half a nanosecond to bring back those jobs they sent overseas?

I mean Honestly, it has something to do with something called free markets.. Where Corporations charge us until we are bled try, pay nothing into our economy, send all the money they make to a tax haven over seas... Build everything in Taiwan..

It is true, only you also have to include the minimum wage and all safety / environmental requirements, then we can go back to the good old days of Monoploies so kind to pay us 1 dollar an hour in the form of vouchers that must be used for their houseing and grocercy stores, they will expand their genorosity to provide us loans which can never be repaid so we can never leave our jobs.. Seriously does no one know the history of the Robber Barron era. We need another Teddy Rosovelt.

The real reason this is idiotic is that when you act like the judiciary doesn't exist or matter it tends to really hurt your chances when you appeal to the State Supreme Court. My understanding of the make up of the court there is that it would have favored them, but if you start acting like a petulant child and disrespecting their office it tends to cause a visceral reaction.

The judge needs to play hardball...jail time for those who are in contempt of court. Walker will be someone's b---ch in the prison in no time. He will see how it feels to eff someone up the whazoo like he has Wisconsin voters and public sector workers.
