This Time President Obama Literally in Gun Toters' Sights

The bullet-riddled tee shirt of President Obama posted brazenly on Facebook by seven semi-automatic gun toting men among them a Peoria, Arizona, police sergeant was much more than the by now standard non-stop litany of racist cartoons, depictions, web postings, and kooky loose talk threats against President Obama. The gun-toting men and the police sergeant were taking target practice on the president's likeness at an undisclosed desert locale. This is Arizona. The state where many legislators think it's ok to pack guns in the legislature, and for citizens to openly pack them in public. This is the state where former Arizona congresswoman Gabrielle Giffords was nearly killed in an assassination attempt, and where there's a wide body of respectable opinion starting with a finger in the face of the president by Governor Jan Brewer, that openly loathes the president's policies and in many cases him personally. The gun-toting men made a virtual public call for the gunning down of the president.

It comes against the backdrop of Secret Service reports that the rate of threats against the President Obama has increased 400 percent from the 3,000 a year or so under President George W. Bush. He receives dozens of assassination threats continuously, and that number has been steady before and during the campaign and increased after he took office. Federal law is very clear on Threatening the President of the United States. It is a class D felony under United States Code Title 18, Section 871. It consists of knowingly and willfully mailing or otherwise making "any threat to take the life of, to kidnap, or to inflict bodily harm upon the President of the United States."

The Secret Service has taken the threats against the president seriously and has diligently investigated every one of them. In a few cases, prosecutors have brought charges. But here is the problem, in fact several problems. How seriously do other public officials take them, especially in places like Peoria, Arizona? Peoria, Arizona, officials did not suspend the police sergeant pending review and investigation, let alone fire him or call for a prosecution of him or his gun toting pals. Their weak, duck and dodge response was at worst that he may have violated the police department's employee conduct rules on the use of social media. There was no immediate response from Peoria, Arizona, Mayor Bob Barrett or Peoria, city council persons to calls for them to take action against the officer and men involved.

The Secret Service also has had other worries, namely about staffing. At one point, in 2010 there was a report that in a budget request the Secret Service was understaffed and under-resourced. The Service denied it and insisted it had the resources and personnel to meet any security issue involving the president. But the president's hands on meet the people routine during his non-stop road travels throughout the country is a constant challenge to any protective and enforcement agency.

The concern over Obama's safety has been intense since he announced he would seek the presidency in February 2007. He had the dubious distinction of being the earliest presidential contender to be assigned Secret Service protection on the campaign trail. This didn't ease the jitters over his safety. Several congressional members even then demanded that Secret Service officials provide all the resources and personnel they could to ensure Obama's and the other presidential candidates' security. They heard the whispers and nervous questions from his constituents about Obama's safety.

During the presidential campaign in 2008, the flood of crank, crackpot, and screwball threats that promised murder and mayhem toward Obama continued to pour in. This prompted the Secret Service to tighten security and take even more elaborate measures to ensure his safety. This was especially important given the deep doubt and even paranoid suspicion that some blacks have that shadowy government agencies were complicit in the assassination of Martin Luther King, Jr, and the fervent belief of millions of other Americans that the CIA or other government agencies were deeply complicit in the killing, if not outright murder of JFK.

There is nothing shadowy or conspiratorial about what police sergeant Pat Shearer and his gun-packing friends in Peoria, Arizona, did. It was brazen and very open. The clueless Shearer for his part saw nothing inappropriate, let alone, dangerous, about what he did. He chalked it up to much ado about nothing or as he put it, he didn't think that shooting up a t-shirt with President Obama's face on it "was that big a deal." It was more than a big deal. The target in their in gun sights was not a regular bullseye, a likeness of Howdy Dowdy, or a cactus plant. It was President Obama. Federal prosecutors should see it as the "big deal" that it is and bring charges.

Shooting a paper target with a picture of someone on it is not anywhere close to a crime. The notion that anyone should face charges for doing so is laughable, or at least would be if such thinking wasn't so dangerous to civil liberties.

Earl,

Just so you know, people have been using the images of famous people for target practice for decades, including those of US presidents­. I have personally seen images of Clinton and Bush 43 used. There is a difference between a threat and a tasteless action.

FYI, I see 8 people (7 in the frame and the shadow of #8).

Also, I see 4 firearms -- one of which is a revolver and another is a bolt action rifle. There appear to be 2 semi-autos. Not quite the 7+ semi-autos the author implies.

Sorry Earl, but that 2009 report was debunked more than 2 years ago.

I find it unbelievably SICKENING that so-called "Americans" cannot be trusted to respect the man who is their President simply because he's not white! I have ZERO respect for Arizona, Texas or any of the other states that have PROVEN their blatant racism and ignorance!

Where exactly did any of the people in this incident say or indicate that they were motivated by race? If you are going to play the race card, best to have some kind of evidence.

Despicable, but I'm not sure how one would prosecute this. It doesn't sound like he violated the statute.

It does sound like he violated the police agencies code of conduct, and I hope he's reprimanded appropriately.

Whoever knowingly and willfully deposits for conveyance in the mail or for a delivery from any post office or by any letter carrier any letter, paper, writing, print, missive, or document containing any threat to take the life of, to kidnap, or to inflict bodily harm upon the President of the United States, the President-elect, the Vice President or other officer next in the order of succession to the office of President of the United States, or the Vice President-elect, or knowingly and willfully otherwise makes any such threat against the President, President-elect, Vice President or other officer next in the order of succession to the office of President, or Vice President-elect, shall be fined under this title or imprisoned not more than five years, or both..... Nothing about a T-Shirt

This is so sad; he knew this going in and STILL wanted the job--and that is all it is..a J O B! I love the fact that we have such a stellar guy as our 'leader' but i would be on pins and needles if i were his wife...or if were HIM -- i know you're not supposed to worry about it.. and sad to say probably most of the ones who want him dead didn't finish 6th grade...just saying...

Many of the so-called "threats" to Bush were farcical. I work with someone whose wife is a liberal activist. At the time of the Enron scandal, she wrote something in a chatroom to the effect that Bush was "going down" because of the scandal. Shortly afterward, two Secret Service agents showed up at their door to interview them, asking questions such as "do you collect books on Lee Harvey Oswald"? My colleague referred to them as Mulder and Scully and found the situation absurd. There are many similar stories, such as the young woman who had been an anti-death penalty activist while living in Texas and had a poster condemning Bush's position as governor on the death penalty on her apartment wall. The Secret Service dropped by to determine whether she was a threat to the president.

Way to misquote and completely misapply the statute. Your "analysis" of the statute failed to indicate these individuals ever mailed this threat to the president, or otherwise communicated it to Mr. Obama. Furthermore, a little research would have shown you that a threat is determined by an objective standard. See US v. Orozco 903 F.2d 1262 (1990), citing US v. Mitchell, 812 F.2d 1250, 1255 (9th Cir.1987) "[w]hether a particular statement may properly be considered to be a threat is governed by an objective standard — whether a reasonable person would foresee that the statement would be interpreted by those to whom the maker communicates the statement as a serious expression of intent to harm or assault. US v. Mitchell, 812 F.2d at 1255-56 (reasonable person standard employed in determining whether statement is threat under 18 U.S.C. § 871)."
Notice, again, that the threat must first be communicated to the person, and then must be an objective "threat." Anything that is not a threat is protected by the 1st Amendment as free speech. Watts v. United States, 394 U.S. 705, 707, 89 S.Ct. 1399, 1401, 22 L.Ed.2d 664 (1969) (per curiam.
Here, you make several leaps of logic to equate citizens excercising their free speech and right to bear arms into a conglomerated mess of racially-charged, anti-gun, and liberal agenda. Thankfully the federal prosecutors you attack have the education, to correctly interpret a statute. It's no surprise that charges were not filed.

One of these glorious luminaries is a police sergeant, one who is sworn to uphold the law, to protect and serve, and all that jazz. I don't care if he was off-duty or not, and I could not care less what political party he associates with (even though it's clear where this yahoo stands), it still gives the perception that he, a police officer and government employee, has this kind of mentality, no telling how he reacts to public citizens, especially ones that happen to be of color (and, yes, I went there, and I'll remain there, given Arizona's current political reputation). If roles were reversed, and someone like Bush was the target, yes, I, someone on the left, would absolutely have a problem with that as well.

For me, this isn't about gun-rights or freedom of speech. It's about the mental state of a police officer. They're not like actors, who can do a job playing someone else by day and be their normal selves when the work is done. Any police officer can tell you that, mentally, they aren't always completely off the job.

And why be stupid and arrogant enough to post this where the whole world can see it? Political (as he claims) reasons or not does not sit well with me as a law-abiding, taxpaying citizen AT ALL!

Federal law is very clear on Threatening the President of the United States. It is a class D felony under United States Code Title 18, Section 871. So, why are there still Facebook pages, journal articles, Senators and citizens calling for the death of our President who are not behind bars??? (just saying!).

I was appalled at the pic! And, I'm very worried and scared for his safety. Even when the 911 hearings proved that Bush and his administration knew of the 911 attacks before hand, no one took target practice at a t-shirt w/ his face on it. The only "American" threat that the public heard of to Bush is the reporter who threw his shoes at him. There is already a fever pitch of hate against Pres. Obama, but I think people like Shearer and his gang stirr up and incite other hate mongers to participate in and possibly, live out their actions. And they, and their fellow hate mongers, will believe that they are a martyr. I pray that the secret service keeps him safe, because if something happens to Pres. Obama, I believe this country will have a BIG mess on its hands. The economy will no longer be the big issue.

And we thought the vitriol directed toward the Clintons was shocking! The rage machine organized by Rove, the Koch brothers, the Teababies, and right-wing media is spinning out of control. A black president threatens them? What will happen when we elect a president who is fluent in multiple languages???
