What if Zimmerman Gets an All White Jury?

Accused murderer of Trayvon Martin George Zimmerman almost certainly will eventually face a jury. And what if that jury is all white? A recent Duke University study showed that all white juries in Florida were more likely to convict a black defendant than mixed ethnic juries. Though Zimmerman isn't black, the defense almost certainly will pull out all stops to make the case that Zimmerman was the real victim and that Martin was the aggressor. In essence this means that jurors will be asked to do a defendant and victim role reversal and put Martin on trial.

The massive barrage of digs, innuendoes, and slanders of Martin's character and actions that fateful night has been relentless since the killing. So the rule that black defendants inevitably get the short end of the jury stick will be very much in play in the case against Zimmerman. That's where the danger of an all white jury comes in in the Martin slaying. It could easily happen. Two years ago a Equal Justice Initiative report found racial discrimination in jury selection is still rampant, even blatant. A Supreme Court ruling and other court rulings that ban all white or non-black juries have been in far too many cases no more than paper decisions that have had little effect in insuring a diverse jury in cases involving black defendants. The same holds true where blacks have been the victims, and whites or non-blacks the defendants, as is the case with Zimmerman.

The report found that prosecutors and judges in eight Southern states used a litany of dodges, tactics, and legal ploys to outright exclude blacks from juries, or whittle the number of blacks on juries down. In capital cases, some jurisdictions don't even go through the legal pretense of trying to get a racially balanced jury. In North Carolina at least 31 current death row defendants were sentenced by all-white juries. A new North Carolina state law, the Racial Justice Act, and a recent courageous ruling by an African-American judge to overturn the death sentence of a convicted black murderer under the act drew national attention to the blatant bias in all white jury decided cases.

The report also found that a racially diverse jury weighed evidence and testimony longer and more carefully, brought different perspectives and life experiences to the deliberations, and made fewer factual errors. These are crucial factors in the rare cases where cops are charged with killing young black or Hispanics. A jury with no blacks, composed of mostly older middle class whites, and non-black ethnics, is much more likely to believe the testimony of police and prosecution witnesses than black witnesses, defendants, or even the victims.

Prosecutors have a big task in trying to overcome pro-police attitudes and the negative racial stereotypes. Two Penn State University studies on racial perceptions and stereotypes, one in 2003 and a follow-up study in 2008, found that many whites are likely to associate pictures of blacks with violent crimes, and in some cases where crimes were not committed by blacks they misidentified the perpetrator as an African-American. In three major racially charged cases in past years where blacks were the victims either beaten or killed by white cops Rodney King, Oscar Grant and Sean Bell, defense attorneys depicted all three men as the aggressors who posed a threat to the officers. They played up and exaggerated their run-ins with the law to depict young blacks as crime prone, menacing figures. The idea was to subtly and openly play on the prejudices, stereotypes, and negative beliefs of many white jurors toward young blacks.
Even when the victim has no criminal record and poses no threat to officers, the negative racial typecast still kicks in. This was the case when white jurors acquitted the four New York City cops tried for gunning down African immigrant, Amadou Diallo in 1999. They claimed that they feared for their lives.

Legal experts blame the paucity of blacks on many juries not on deliberate racial discrimination, but to the paltry number of blacks in the jury pool, changing demographics (the city is majority Hispanic, Asian and white), and the failure of blacks to heed jury summons.
This begs the issue. It doesn't much matter how few or how many blacks are in the jury pool, if prosecutors (or defense attorneys when the accused is white and victim black) use a storehouse of challenges, questionnaires, and profiles, to systematically strike blacks from a jury. And sometimes, they don't even bother with the ploys.

The Dallas Morning News revealed in 2006 that Dallas prosecutors systematically dumped blacks from juries for years. The Supreme Court tossed the conviction of Texas death row inmate Thomas Miller-El based on a Dallas prosecutor's brazen racial jury sanitizing. Yet prosecutors still try to get as many whites, and as few blacks as possible, on juries.

The Zimmerman case jury may be fair and impartial. But to pretend that racial bias doesn't exist in racially charged trials is self-serving and dangerous. His case could again cast an ugly glare on jury race bias.

A jury that relfected the demographics of Sanford, Florida, would have five whites, three blacks, two white Hispanics, and two mixed-race individuals. Zimmerman is mixed-race with European, African and Amerindian (Native American) ancestry.

How convenient for the Attorney representing Zimmerman...........Im not picking sides, but here's how this deal's gonna work out.

90% of any and all monies raised by any means will be depleted and plundered away.....Zimmerman's Attorney will raise and bring up non-issues just to sent notices, and pleadings to the Court.....an hourly check will be made by the firm to the "social asset" account to gauge in and out flow of cash, or disposable assets : )

At a tipping point or a decision made in the Judge's chambers or between Attorneys, the Defendent's Attorney will settle the case at his convenience will little honest concern for his client (very typical of most Attorney's).

He'll have gotten his name in the papers, and throughout the world via internet, had no issue with getting his bills paid, since he has a Cash Cow at hand......and will be on his way......plundering 90%+ of the monies......Guaran-Teed !

It would not surprise me in the least if he receives an all white jury. The defense is going to probably make sure they are all NRA supporters who more than likely be cons/bags/birthers. This is a child of a former magistrate, I don't think justice is going to prevail. Too many good ol'boys.

This case doesn't involve testimony or actions by the police. If mixed race juries are less likely to convict black defendants than all white ones, it could be because of jury nullification by black jurors.Who is behind the Equal justive intitiative report ?
Martin has no bruises whereas Zimmerman was injured . Zimmerman may have offended martin in some why and Martin responded with violence . There is no law that permits one to physically attack someone because they are offended by something he said . Martin was over 6' tall and Zimmerman is short and pudgy so I find it credible that Martin hit Zimmerman , rather than the other way around.

If I follow someone, no stalk someone, that's ANTAGONIZING THEM. Folks go to jail for stalking. If I, a neighborhood watch VOLUNTEER, am instructed by a police dispatcher to refrain from following a "perceived" perpetrator but continue to follow them anyway, I am deliberately putting myself in harm's way. If I shoot an unarmed 17 year old KID (let's stop pretending that he was a "violent adult", shall we?) then I am a MURDERER. Plain and simple. Zimmerman had every opportunity to allow REAL law enforcement to do their jobs but he just could not resist the opportunity to play cop.

I guess you are another one of many who need to look up the legal definition of stalking in Florida law. It does in fact require more than one instance and more than one occasion, as in several. The instruction given by the dispatcher (who is not a law enforcement officer) was a standard response read from a computer screen. It releases liability from that end of the call. In most cases it is used to ward off harm to the caller. It must be very easy for you to sit there and be exactly what you hate GZ for, judge jury, executioner? An unidentified black male with a gun walks into my sisters complex. The security guard see's him but never leaves his car. He calls 911. 15 min later the police show up. It's too late my sister was raped at gun point. You must always assume the worst. There are times when you must get involved. In most cases it will prevent a crime from happening. Then you blame GZ for getting involved? All Martin had to do was call the police. Or (help out) by explaining his presence.

Ahhh, another story of the "bad black criminal" used to prove your tired and nonexistent point. It must be easy for you to sit there and pretend that Trayvan deserved what happened to him...just the fact that you present the supposed rape of your sister (have you NO shame) by a "black male" proves MY point...that you and other people supporting Zimmerman believe that it is OKAY to stalk (I don't care WHAT FLORIDA LAW says following someone around because of your perception of what they are doing or what they are going to do is a form of stalking) and kill a young man when 1) no crime was being committed, 2) the shooter was not law enforcement (merely a "wannabe" cop with issues), and 3) the victim's only weapon was a bag of Skittles. Get Real!! How would you feel if it were your son??? Oh wait, let me guess, your son is always innocent and would NEVER go to the store to buy Skittles...

Since the prosecution has no case, they are counting on putting together a biased jury that will convict him on preconceptions, not evidence. Certainly most blacks and a large number of whites have already made up their mind thanks in part to the biased news reports that featured Martin as a 12 year old, and Zimmerman as much heavier, mean looking person in pictures. If a conviction is not handed down the first time, I'm sure they will get it the second or third times they try him, just like the Rodney King case. Since we are more afraid of riots than convicting an innocent man, I'm sure eventually Zimmerman will end up in prison.

So, Zimmerman is an "innocent" man??? It is easy to say that because Trayvan was not YOUR son... Zimmerman should end up in prison solely because he stalked and killed an unarmed black man based upon his "perception" of what the young man was doing...Why are all of you not open to the fact that Trayvan was killed due to the color of his skin and NOTHING more??? Should we all go out and shoot everyone that looks "suspicious" to us?? If you are not the target of racism, you have no clue of how truly ugly it is. This was a racist act and the police conspired to cover it up. Let's stop pretending that this young man died because the neighborhood was afraid...the "neighborhood" did not stalk and kill Trayvan - Zimmerman did.

Um when that suspicious person turns on you and attacks you. BTW Zimmerman is someones son too. Not that either point matters. Please provide one iota of proof that this was racially motivated? Please do not post (anything) media related. You are also another who needs to go to Florida statute regarding stalking and look up the legal definition that does not apply. I find it extremely transcending to watch these posts (many like yours). You (all) are doing the exact thing you (hate) George Zimmerman for. You are being judge, jury and executioner. How do you justify that?

Hmmm , seems cover ups happen everywhere.....Did the Media and Police Ignore Mob Beating of Two White ReportersChalk up another entry in the recent string of racially motivated assaults. Today’s story comes from Norfolk, Virginia, where a white couple were beaten savagely by a group of (according to reports) between 30 and 100 black youths. Apparently, the beating was so brutal that the couple could only manage to scream out the intersection at which they were located –.Two weeks have passed since reporters Dave Forster and Marjon Rostami – friends to me and many others at the newspaper – were attacked on a Saturday night as they drove home from a show at the Attucks Theatre. They had stopped at a red light, in a crowd of at least 100 young people walking on the sidewalk. Rostami locked her car door. Someone threw a rock at her window. Forster got out to confront the rock-thrower, and that’s when the beating began...

He'll end up in prison because that is where he should be. He gunned down a kid because he made a real bad judgment, and then did NOT OBEY the police when they told him not to follow the kid, but he did anyway.

Likely that it will NOT be an all white jury as the Supreme Court Batson decision expressly forbids the use of peremptory challenges based on race, and a statistical disparity is prima facie evidence of improper challenges and will usually result in the siting of jurors who have the offending side has challenged.
By rights this case probably should exclude many potential jurors who are African American since polls reveal that over 80 percent have already formed an opinion that Zimmerman is guilty and therefore should be excluded as jurors as a matter of law. Hopefully a diverse but impartial jury can be found.

This and few other articles only show us why we need positive leadership and directon in terms of civil rights in this country. We can continue to go around in circles trying still trying to find middle ground, but the truth is we do not have respectable organizations to move forward the task. Sure we do recogonize the NAACP, J. Jackson's Rainbow, and Rev Al Sharpton's leadership, but they are slow showing on pertaining to individual needs. High power cases and media spotlight seems to quench their thirst. Not to get me wrong, I welcome their stride however, when the lights go out, they move on. Only when cases such as Trayvon becomes a wake up call. The sting that drove this case to where it is now, is the media's influence..right or wrong, and Geraldo's infamous remark, about Trayvon wearing a hoodie so he deserved to die in the streets. I am amazed and as I write this response I am sad, because the generations to come are left without much hope and respect, besides the protection of the Justice System for their constitiutional rights. No time to write or talk, time to make a move forward and do something..anything to bring the issues to the front!!

It seems some people on here don't know the difference between a judge and a retired magistrate....I saw some posts where the dad was a "magistrate on the Supreme Court." They got all their talking points from Rev. Al and they are sticking with them...the heck with the facts.

It is article's like this that have caused all the tension among citizens by making this case about race.  It is the media that decided what pieces of information they original released to illicit the most chaos.  They used things like pictures of Trayvon when he was a little boy, the strategically edited 911 calls, and the standard headline of white man kills unarmed young black boy are just a few examples of what the media used to inflame the readers/viewers. In this case I can guarantee there will NOT be an all white jury.  Both the Prosecutor and Defense attorney will make sure there are different races on the jury.  With the way this case is being handled the only way to ensure there is not a citizen uprising is a conviction of Zimmerman for one of the murder charges.

I believe from the beginning of this case that all American's regardless of racial background wanted this case handled the appropriate way. I think the media is responsible for pointing this case in the wrong way. I guess it's hard for me to understand why many people think just because one person may have some type of racial motivation doesn't mean everyone person of that race has that same racial motivation. I just like most American's am what I call "Heinz 57." Basically I have so many different ethnicities all wrapped up into one to make me. :-)
