Chicago Rolls Back First Amendment Rights

Wednesday the City Council voted to approve Mayor Rahm Emanuel's new protest ordinance. The controversial ordinance was greatly opposed by many Chicago residents as these new measures threaten to rob citizens of their civil liberties, most notably our right to free speech and our right to congregate peacefully.

Additionally, although this ordinance was originally meant to be temporary (as a proposed way to increase security during the G8 and NATO meetings), Mayor Rahm recently announced that much of this ordinance would remain in place after the May meetings.

The ordinance includes new parade restrictions, increased fines, new closing times for parks and beaches, and more security cameras (which will make Chicago's surveillance system the most extensive in the country). New restrictions will even require people to register bullhorns before use at events.

These restrictions are not only excessive and invasive, but they will also serve to prevent citizens from protesting and exercising their civil liberties. Groups will not be able to congregate freely as these amended security measures will restrict their movements and keep them from particular locations, and increased fines and stipulations (such as those regarding bullhorns) will impede their right to free speech.

Overall, the ordinance will serve to significantly limit Chicagoans' civil liberties, and this could set a dangerous precedence throughout the rest of the country as well. These new limitations on free speech could not come at a worse time, at a time when many of us want to make their voices heard and when so many of our fundamental rights as Americans seem at risk. Just this week many popular websites chose to shut down shop for 24 hours in order to protest new copyright legislation which would allow the government to censor and limit Internet access to certain sites.

Freedom of speech and the right to congregate peacefully are two of the crucial cornerstones on which this country was built over 200 years ago. Our founding fathers were well aware of the consequences created by government oppression and lack of civil liberties, and the Bill of Rights was their testament against such tactics and their earnest attempt to found a country which would be almost entirely based upon personal freedom. Chicago's new ordinance and SOPA detract from these rights and our liberties, and we cannot allow Big Brother to rob from us that which is not theirs to take.

Perhaps Benjamin Franklin said it best: "They that can give up essential liberty to obtain a little temporary safety deserve neither liberty or safety." He did not mean that safety was not of the utmost importance, but that security and freedom should not be mutually exclusive. We can live in a country that is both free and safe -- that is, after all, the very reason our country was founded in the first place.

Well, not enough people cried when Chicago took away the second amendment rights so many years ago. They al just accepted the BS excuse that it would make the city safer. And now that those are gone, they can start taking away the other 9.

Humm, you guys voted for him 1st Amendment Rights gone 2nd Amendment Rights gone, pretty soon he will go for your 4th Amendment Rights, and you Libs will say you are free, you people need a IQ higher than room temp.

Our backdrop is the Arab Spring...the United States is the vanguard of modern democracy and freedom. Ald. Joe Moore with whom I've fought alongside on many battles called these concerns, “overheated rhetoric and over-the-top hyperbole.” Joe's a great guy but no one is screaming fire in a crowded theater - rather we are witnessing the clash of ideologies. Despots, dictators and entrenched megalomaniacal government leaders always seek to limit/control the voices of the people . I am instigating Vigilance! The Internet allowed the world to witness the birth of freedom during the Arab Spring the way the mobile TV camera allowed the world to see black Americans fight for freedom during the Civil Rights Era. I am not so entitled that I believe that my freedom is freely acquired and effortlessly sustained. If it is now wrong to question the 'tweaking' of these sacred rights then I've been asleep longer than I thought. Wake up because history will repeat itself if we say nothing.

To think i voted for this mayor. I alwasys learned that our first amendment rights are what differ us from dictators we vote on mayor's so they may make things better for our economy and community's no one man can decide the fate of our city. doe's our fine mayor forget.the puerto rican riots.history shows us that when you ignore the poor it;s chaos he needs to listen to our needs. My one vote is small but he cant count on it again! my father fought and died for my first amendment rights so Emanuel and the powers that be Julio Cintron will voice his first amendment rights ps hope i dont get fined for this post! lol !

My Alderman is Ameya Pawar. He explains his actions in weekly Friday emails. He said the ordinances were changed by the time a vote was called and he voted in favor because the ordinance:

Enhances First Amendment Protections by including a fee waiver provision for permit application fees and insurance requirements if these fees would unduly burden 1st Amendment expression.

Enhances First Amendment Protections by allowing for immediate judicial review of denied permit application if time does not allow for an administrative appeal.

Enhances First Amendment Protections by establishing a procedure for spontaneous public assembly to become an unpermitted parade and utilize the public way.

DOES NOT increase fines for resisting arrest.
DOES NOT contain parade marshal quota.
DOES NOT require registration of banners and sound amplification devices.
DOES NOT place a time limit on public assembly.
DOES NOT prohibit, restrict or discourage spontaneous public assembly.

I received an e-mail with a similar breakdown from my alderman Joe Moore (49th). The hyperbole offered by Rev Livingston and those outside instigators who intend to come here and disrupt completely ignores widely accepted Supreme Court rulings regarding "time, place, and manner" restrictions. - - - dictionary.thefreedictionary.com/Time,+Place,+and+Manner+Restrictio ns
