General Colin Powell contends that Obama is a citizen since he believes he was born in Hawaii. That is not sufficient to establish his citizenship. The U.S. Supreme Court in 1874 established that to be a citizen one must have both parents born in the United States in addition to his or her situs of birth. The case is still good law, has not be overturned, and is Minor v. Happersett, 88 U.S. 162, (1874). Therefore, because Obama's father was born in Kenya and was a British subject, Obama does not meet the requirements of the Happersett case. He is therefore unqualified to be President of the United States pursuant to the U.S. Constitution, Article II, Section I. In the Happersett case, plaintiff Virginia Minor, a resident of the State of Missouri, sought a ruling from the Court that she could vote in her home state. The Court was aware that the Missouri Constitution did not allow women to vote. However, before the SCOTUS could reach the issue of the Missouri requirement, it first had to determine whether Ms. Minor was a citizen. They found she was a citizen; she was born in Missouri and both her parents were born in Missouri. The holding of the case is controlling case law. When the birth issue comes before the Supreme Court, you will all see the citation to the Minor v. Happersett case and you will finally understand the circumstances.
