090507-immigration-reform-not-raidsI got up at 4:30 a.m. on Tuesday morning to fly to Phoenix, Arizona, to speak at a press conference and rally at the State Capitol at the invitation of the state's clergy and other leaders in the immigration reform movement. The harshest enforcement bill in the country against undocumented immigrants just passed the Arizona state House and Senate, and is only awaiting the signature of Governor Janet Brewer to become law.

Senate Bill 1070 would require law enforcement officials in the state of Arizona to investigate someone's immigration status if there is "reasonable suspicion" that the person might be undocumented. I wonder who that would be, and if anybody who doesn't have brown skin will be investigated. Those without identification papers, even if they are legal, are subject to arrest; so don't forget your wallet on your way to work if you are Hispanic in Arizona. You can also be arrested if you are stopped and are simply with people who are undocumented -- even if they are your family. Parents or children of "mixed-status families" (made up of legal and undocumented, as many immigrant families are out here) could be arrested if they are found together. You can be arrested if you are "transporting or harboring" undocumented people. Some might consider driving immigrant families to and from church to be Christian ministry -- but it will now be illegal in Arizona.

For the first time, all law enforcement officers in the state will be enlisted to hunt down undocumented people, which will clearly distract them from going after truly violent criminals, and will focus them on mostly harmless families whose work supports the economy and who contribute to their communities. And do you think undocumented parents will now go to the police if their daughter is raped or their family becomes a victim of violent crime? Maybe that's why the state association of police chiefs is against SB 1070.

This proposed law is not only mean-spirited -- it will be ineffective and will only serve to further divide communities in Arizona, making everyone more fearful and less safe. This radical new measure, which crosses many moral and legal lines, is a clear demonstration of the fundamental mistake of separating enforcement from comprehensive immigration reform. We all want to live in a nation of laws, and the immigration system in the U.S. is so broken that is serving no one well. But enforcement without reform of the system is merely cruel. Enforcement without compassion is immoral. Enforcement that breaks up families is unacceptable. And enforcement of this law would force us to violate our Christian conscience, which we simply will not do. It makes it illegal to love your neighbor in Arizona.

Before the rally and press event, I visited some immigrant families who work at Neighborhood Ministries, an impressive community organization affiliated with Sojourners' friends at the Christian Community Development Association. I met a group of women who were frightened by the raids that have been occurring, in which armed men invade their homes and neighborhoods with guns and helicopters. When the rumors of massive raids spread, many of these people flee both their homes and their workplaces, and head for The Church at The Neighborhood Center as the only place they feel safe and secure. But will police invade the churches if they are suspected of "harboring" undocumented people, because it is the law? Will the nurse practitioner I met at their medical clinic serving only uninsured people be arrested for being "with" the children of families who are here illegally as she treats them?

At the rally, I started with the words of Jesus (which drew cheers from the crowd gathered at the State Capitol), who instructed his disciples to "welcome the stranger," and said that whatever we do to "the least of these, who are members of my family" we do to him. I think that means that to obey Jesus and his gospel will mean to disobey SB 1070 in Arizona. I looked at the governor's Executive Tower and promised that many Christians in Arizona won't comply with this law because the people they will target will be members of our "family" in the body of Christ. And any attack against them is an attack against us, and the One we follow.

Catholic Cardinal Roger Mahony of Los Angeles just called this Arizona measure "the country's most retrogressive, mean-spirited, and useless immigration law" in the land. On CNN, I defended the Cardinal's comments, which likened the requirement of people always carrying their "papers" to the most oppressive regimes of Nazism and Communism. I wonder whether the tea party movement that rails against government intrusion will rail against this law, or whether those who resist the forced government registration of their guns will resist the forced government requirement that immigrants must always carry their documentation. Will the true conservatives please stand up here? We are all waiting.

Arizona's SB 1070 must be named as a social and racial sin, and should be denounced as such by people of faith and conscience across the nation. This is not just about Arizona, but about all of us, and about what kind of country we want to be. It's time to stand up to this new strategy of "deportation by attrition," which I heard for the first time today in Arizona. It is a policy of deliberate political cruelty, and it should be remembered that "attrition" is a term of war. Arizona is deciding whether to wage war on the body of Christ. We should say that if you come after one part of the body, you come after all of us.

Law enforcement may only check legal status if there is already lawful contact (eg; a traffic stop) in progress. Law enforcement may require any person to provide proof of identify. A driver's license is proof of legal status. Law enforcement is forbidden from initiating contact merely to check legal immigrant status.

Undocumented people are here illegally, they are illegal immigrants. Arizona passed this law because the federal government was not doing their duty of enforcing the law and protecting the borders. Powerful special interest group, including clergy, benefit from illegal immigrants.

When asked about paying taxes, Jesus answered to the effect of, "Give unto Caesar that which is Caesar's, and give unto God that which is God's". Jesus knew the boundary between church and state. No doubt he knew and preached that the Kingdom of God is greater, but the greater does not subsume the lesser. Jesus meant to "welcome the stranger" into the FAITH and the CHURCH (in contrast to earlier religions). Jesus did not encourage breaking Caesar's law.

But the left will use it if it suits their cause.. Truth is, the AZ bill parallels the feds bill almost exactly. Obama admin has prepared its talking points and the MSM parrots them; thus, the "Gospel" according to Obama is created. We need legal immigration, of the type and kind used 100 years ago. It created a country of legitimacy, not one of entitlement. Illegal immigration will not wash -- in Washington, AZ or any other of our 50 states. Let's get the borders "boarded" and then work with what we've already got. Unless we protect our borders, we'll have another 10 - 15 million illegals; the American system of government is ill-equipped to sustain these numbers; just look what illegal immigration has already done to California and Arizona. If you want to keep America "American", adhere to its laws; they've worked for hundreds of years and should not be abolished because some, including the catholic church, think they should be ignored.

The short and sweet is that right is right and wrong is wrong. If you are in the states illegally, you deserve what you get. I hope all 17 other states looking to follow AZ pass the law and we put a stop to people being in our country illegally. When you go out of the country, do you go illegally or do you have to take your passport with you? Go to Mexico and see what happens if you are living or working there illegally. How many people that are against this law have actually read it or just going by what they have heard second and third hand? I am all for anyone being in our country if they are here legally. Welcome to the best country on earth. If your are not here legally, get out or we will help you out! To all of the haters of this bill, #1 read the bill, #2 move to Phoenix (#1 kidnapping capital in the US) and live in the people of Arizonas shoes and explain to the families of those who have had members of their families murdered by illegal imigrants why this bill is not good.

If I were a relative of any family in Az. that lost someone ect. due to illegal immergrants...I would sue the federal gov. for not doing there job!!! Then maybe they would get off there butts and put an end to all the illegals coming. I feel for Az.

Myth #5: A large share of schoolchildren are undocumented.

Nationally in 2000, only 1.5 percent of elementary schoolchildren (enrolled in kindergarten through 5th grade) and 3 percent of secondary children (grades 6-12) were undocumented. Slightly higher shares—5 percent in elementary and 4 percent in secondary schools—had undocumented parents.

Myth #6: Undocumented immigrants do not pay taxes.

Undocumented immigrants pay the same real estate taxes—whether they own homes or taxes are passed through to rents—and the same sales and other consumption taxes as everyone else. The majority of state and local costs of schooling and other services are funded by these taxes. Additionally, the U.S. Social Security Administration has estimated that three quarters of undocumented immigrants pay payroll taxes, and that they contribute $6-7 billion in Social Security funds that they will be unable to claim (Porter 2005).

Maybe undocumented, but how do you know what kinda sickness they have, and you are putting your children same the schools. just think all of those people coming over and the sicknesses come with them, polo, swine flu, ect. That's why we need laws that stop illegals. your children or someone you know may die, due to you not standing up for your rights and stopping illegals.

Myth #1: Undocumented immigrants come to the United States to get welfare.
Undocumented men come to the United States almost exclusively to work. In 2003, over 90 percent of undocumented men worked—a rate higher than that for U.S. citizens or legal immigrants (Passel, Capps, and Fix 2004). Undocumented men are younger, less likely to be in school, and less likely to be retired than other men (Capps et al. 2003). Moreover, undocumented immigrants are ineligible for welfare, food stamps, Medicaid, and most other public benefits (Fix, Zimmermann, and Passel 2001).
Myth #2: Undocumented immigrants all crossed the Mexican border.
Between 60 and 75 percent of the more than 10 million undocumented immigrants entered illegally and without inspection—mostly across the Mexican border. The other 25 to 40 percent entered legally and subsequently overstayed visas or otherwise violated the terms of their admission (Passel 2005).
Myth #3: Undocumented immigrants are all single men.
Over 40 percent of undocumented adults are women, and the majority (54 percent) of undocumented men live in married couples or other families (Passel 2005). Fewer than half of undocumented men are single and unattached.
Myth #4: Most children of the undocumented are unauthorized.
In fact, two-thirds of all children with undocumented parents (about 3 million) are U.S.-born citizens who live in mixed-status families.

Jim, you are qualified to provide an opinion but if you believe you speak with fact, empathy, or a higher moral ground, you are sadly mistaken. I have to pay for car insurance (mandatory in AZ) and one of the premiums is for "under insured" and another premium is for "uninsured"... AZ has one of the nation's highest rates for these two elements. Just stretch your imigination as to why that is the case. Why are all the top 10 cities in the nation for stolen vehicles in the West? Yakima, WA and Las Vegas, NV are the only 2 cities, in the top 10, that are not in a border state.

Jim - do you also want our judicial system to let rapists, burglars, murderers, and drug dealers go so they can be released back into our society? If you give amnesty to one CRIMINAL, then why not to all? I'm not trying to be facitious - I'm very interested in how you separate these "causes" in your mind.

He separates his "causes" because this law will make racial profiling legal. At what point does a police officer decides he or she has "reasonable suspicions" that a person is an illegal immigrant. Someone with an accent? Someone with different colored skin? Oh we just train them you might say. How quickly will than happen? In the mean time citizens are being unlawfully detained. He separates his "causes" because he sees real and potential abuses with this law. We already have police officers who do this with present laws in place. Most officers try but what do you do with that 5-10% who are abusive. This only makes it easier for them to get away with things.

TOO BAD!!! This law mirrors the federal law passed years ago....Az just made it a state law too!!! If you go into Mexico WE have to have papers, or your ass is in jail. This is not racial profiling it is our countrys law!!!! Cant make excuses for some....Laws the law!

I fear you are another of the nattering nabobs out there who hasn't bothered to read the law, but is quick to condemn it anyway (not unlike Obama Adminstration officials...). The law SPECIFICALLY disallows racial profiling. Period. Read it before commenting.

Jim - I'm a very strong Christian and if you would take the time to read your Bible, it very clearly states in Romans 13:1 - 7 ""Everyone must submit himself to the governing authorities, for there is no authority except that which God has established. The authorities that exist have been established by God. Consequently, he who rebels against the authority is rebelling against what God has instituted, and those who do so will bring judgment on themselves. For rulers hold no terror for those who do right, but for those who do wrong. Do you want to be free from fear of the one in authority? Then do what is right and he will commend you. For he is God's servant to do you good. But if you do wrong, be afraid, for he does not bear the sword for nothing. He is God's servant, an agent of wrath to bring punishment on the wrongdoer. Therefore, it is necessary to submit to the authorities, not only because of possible punishment but also because of conscience. This is also why you pay taxes, for the authorities are God's servants, who give their full time to governing. Give everyone what you owe him: If you owe taxes, pay taxes; if revenue, then revenue; if respect, then respect; if honor, then honor." - so sir - how, as a "man of God" can you write such an article that distinctly supports the disobedience of our law?

On its merits alone, amnesty is catastrophic to the USA in every conceivable way. The twenty million (or so) amnestied will have the legal right to bring in their immediate familes - which explodes the actual number to over 60,000,000, within a decade. See Robert Rector's analysis on the dire effects of adding that many people, so fast, to the welfare and social security systems - not to mention the overwhelming strain on schools systems, hospitals, health care, crime, etc. And how then are that many people expected to assimilate to the dominant culture and the English language when at that moment in time they will constitute fully one fourth of the American population? If balkanization is the desired outcome, amnesty (or its euphemism, "pathway to citizenship")is the way to go. This is utopianism and wishful-thinking off the scales. A recipe for social unrest or worse. The only sensible course for both US citizens and illegal immigrants is to do everything to encourage the migration to halt. That means finally securing the border, creating the conditions for voluntary self-deportation by penalizing unscrupulous employers and instituting a massive Marshall Plan for Mexico and Central America.

Jesus would have sent them home. The social myth called Jesus believed in following the law. So regardless of what you believe Jim is wrong. Speaking as an immigrant who arrived within the law I find his lack of respect for the law troubling. He suggests forgiveness to all sinners for all crimes without a change in behavior. Kill me once shame on who? Lets hold hands and pray for miracles that only exist in Cecil B. DeMille movies and not in the real world.

So this law is about criminals who come here to take jobs when we are experiencing mounting unemployment, who violate our laws, who traffic in humans or drugs. And your for NOT enforcing the laws of our country on these people? This country is made up of immigrants from many locations, and it welcomes those who respect our laws.

Difficult position to take, but I suppose it takes all kinds.
