Eliminating Regulations That Protect the Health and Safety of Americans Is Not Job Creation

As you are preparing to gather around the Thanksgiving table, the Republican majority in Congress is rushing to push through legislation that will undermine the continued health and safety of the loved ones seated next to you. Over the next two weeks they will bring three bills to the House floor that will halt regulation as we know it, making it more difficult to protect public health and safety. Nobody likes red tape and everyone can agree that there are areas where our regulations could be streamlined. However, these bills go much further and will make it virtually impossible to enact new regulations or fine-tune existing ones. Indeed, under these bills it would even be harder to get rid of burdensome regulation.

Consider H.R. 3010, the "Regulatory Accountability Act of 2011," the latest salvo in conservatives' war against safeguards provided by regulations. If enacted, H.R. 3010 would effectively halt agency rulemaking, which threatens the government's ability to protect the American people from a wide range of health and safety harms. H.R. 3010 will result in "paralysis by analysis" by imposing numerous unnecessary analytical requirements on agencies before they even start the rulemaking process. This bill will arrest the rulemaking process and slow down the implementation of critical regulations that ensure our air and water is clean, and our consumer products are safe.

But that is not the only bill being crammed into the remaining few days of the congressional session. H.R. 10, The "REINS Act," would adversely impact how necessary and beneficial rules are promulgated by imposing a mandate requiring all new major regulations to be affirmatively approved by both Houses of Congress and signed by the president within 70 days before they can take effect. By requiring congressional approval and by giving Congress too little time to act, the REINS Act will effectively prevent major rules, including those related to public safety, from ever being implemented.

Rounding out the trio of public safety killing legislation is H.R. 527, the "Regulatory Flexibility Improvements Act of 2011." Under current law, rulemaking agencies must make an analysis for every new rule that would have significant economic impact on a substantial number of small entities, such as small businesses. Among other things, this bill repeals the authority of an agency to waive or delay this analysis in response to an emergency that makes compliance or timely compliance impracticable.

So if there is an epidemic of E. coli or listeria infection caused by some item in our nation's food distribution network, or if there is an imminent environmental disaster that could be addressed systemically through regulation, this bill says "Don't worry. Don't rush."

My conservative colleagues argue that this legislation is necessary because too much regulation is responsible for our nation's current economic difficulties. They must be suffering from some collective form of amnesia. It was not too much regulation of Wall Street that led to the near collapse of the worldwide marketplace. It was not too much regulation that caused the BP oil spill. And, it was not too much regulation that allowed mortgage brokers, servicers, bankers and others to engage in predatory lending and falsify foreclosure documents in court proceedings.

Regulation has had no discernable impact on our economy compared with the devastating impact that the lack of demand has had. As a July Wall Street Journal survey of business economists found, "The main reason U.S. companies are reluctant to step up hiring is scant demand, rather than uncertainty over government policies." Even the business community recognizes that the biggest problem it faces is lack of demand. The most recent National Federation of Independent Business survey of its members likewise shows that business owners believe that poor sales -- not regulation -- are the biggest problem.

The focus of this debate, rather, should be on the fact that regulations are really about job creation. Historically, American-made goods have been sought the world over because of their high quality and safety standards. But the United States will lose this competitive advantage if we continue toward lowering our regulatory standards.

The solution to the recession is fairly straightforward. We must increase demand for American goods, create jobs and resolve the home foreclosure crisis. If we continue this regulatory race to the bottom, American manufacturers will be less competitive, demand will further weaken, and fewer -- not more -- jobs will be created. These bills provide yet another opportunity for big business to recklessly cut corners on public health and safety in the name of increasing big profits without creating a single new job.

The safety standards for American goods are so high, and our products are so consistently safe that it is no surprise we often take for granted the regulations that ensure their quality. So as you sit down to a nice meal consisting of food put through a thorough inspection process with loved ones who traveled safely on planes, trains and automobiles subject to rigorous safety standards, remember: Regulations don't kill jobs, they save lives. And that there are plans underway in Washington to undermine the regulatory process that guarantees the health and safety of millions of Americans.

Deregulations do not create jobs it creates more corporate profits. Corporations that move offshore are not moving because they have less regulations, they move for cheap labor. Michelle Bachmann love China because they don't have regulations nor unions and politicians are not elected. Corporations would love to import more children toys with lead paint so they can growup to be Republicans.

Regulation is a smoke screen, the real truth, and no politician will address it frankly and openly is the cost of the American Worker. No one will stand up and say it publicly. Corporations have found a new supply of cheap well educated workers elsewhere. You could open the smokestacks, and dump in to local river and it wouldn't create anymore jobs. We need a new paradigm for society, futurist predicted this as far back as 1960. What got us here was short term greed and no vision. I laugh when politicians tell us that some kid inventing in his garage is going to solve our labor problems it shows how clueless they really are. What we should be doing is inventing a new form of governance. Corporations have immigrated elsewhere, government is left holding the bag, and doesn't have clue how to deal with it. The question is how do you circulate the wealth throughout a unemployed population (Leisure Society)?. So that all their basic needs are met. I am not saying it is going to be easy and we will probably stumble all the way. To do nothing as we are now will be catastrophe.

Why not reduce the size of government by 50% to 75% so we can save some money?

Greetings Congressman Conyers:

You really want to protect American people?

I respectfully suggest we divide the FDA and FCC to create the Federal Legal Administration ("FLA") for the specific purpose to regulate, manage and police our legal practitioners throughout the United States. With more than 3 million people in prison and 5 million Americans confined in the legal system, Sixth Amendment right to "effective assistance of counsel" is being violated each and everyday!

We have real estate lawyers defending criminal cases on a "learn as you go basis" with the out-come clearly detrimental to defendants. We have legal practitioners engaging in areas of law in which they are clearly unqualified with no experience. This unconstitutional practice is sanctioned by federal government with panel attorneys receiving tax payer funding as much as $8,500.00 per case.

In contrast we protect our people with regulating a five cents (cost to produce) egg, medical services, board certified professionals, school bus drivers, fruits, meat, veggies and other consumer goods we must give legal certification to the more than 199 different areas of law.

Even the federal bureau of statistics agrees there are at least 500 thousand people behind bars in American prisons that should not be there! This is greater than China and Russia combined. Considering expenses of $35,000.00 per inmate per year, the government's waste is criminal. The prison industry is the fastest growing industry in America.

Why? LAWYERS GONE WILD. POLICE THE LAWYERS!

It's not like dumping some regulations will actually lead to abuse or dangerous conditions in the work place. Does not bad PR from a scrutinizing media or fear of bankrupting law suits or the fear of unionization or even violent retribution in the work place act as deterrents? The regulations merely ads to the cost and redundancy of deterrents.

That's a very naive view. Many companies seem to be in mindless pursuit of ever higher profits and don't care about the consequences on the environment, their employees, or future generations. Regulations are both needed and necessary to keep them from these behaviors. The bad PR is just a cost of doing business to them and the violent retribution usually happens against those who protest for better working conditions.

Americans must realize that a divided government is not beneficial, when you have the GOP and Tea-Party Republicans placing an oath and pledge to an individual, Grover Norquist above them. The GOP and Tea-Party Republicans pledged their oath Grove Norquist, above their oath to the Constitution of the United States, and have ignored the requirement for them as members of the House of Representatives, to serve the needs of the people they represent. This they have failed to do and must be legally removed from office. Election 2012 in November we must show our power to determine our government function for our needs.

H-1b work visas don't create jobs either. H-1b drives down wages and creates unemployment BUT Democrats support H-1b and dozens of other work visas.

Democrats also support offshoring and free trade with communist China which also costs us jobs.

Democrats also support amnesty for illegal labor which also drives down wages and creates unemployment. Illegal labor is great for employers.

I know people who have lost their jobs or have suffered stagnant and declining wages due to NAFTA, free trade with China, and work visas. I don't know anyone who has lost a job because of environmental regulations.

Derugulation is certainly a job creator - we will need and pay for more doctors, nurses, medical personnel - and those oh-so-important bonus absorbing executives - because if more people get ill and die from derugulation we will have to hire more people to take care of them - and bury them. Don't forget the attorneys!

Have the Republican GOP-TPs lost their ever-h@tin' minds???

The whining from business about the "regulatory burden" goes back to Teddy Roosevelt. It has nothing to do with jobs and everything to do with profits.

If I own a service station I'm going to hire the exact number of people I need to service the customer demand I have. No more and no less.

If the EPA tells me it's ok to pour used motor oil down the toilet, that would save me the money I have to pay for recycling but it doesn't bring in any more customers and it sure as heck doesn't mean I'm going to hire another grease monkey. I'm just going to pocket the profit while gleefully sending my toxic sludge down the river.

"Regulatory burden" is BS.

"Overtaxing the job creators" is BS

Jobs some from customer demand. With the economy trashing through another republican depression there isn't a lot of customer demand right now. That is slowly improving. Getting rid of the EPA and handing more tax goodies to trillionares isn't going to speed things up.

The easiest way to explain why this is a big lie is to look at communist China. The same corporations the cry to congress about regulations are the same who are expanding into communist dictatorships like China. Corporations love communist dictatorships because the people have no rights and corporations can exploit workers. This is what CEOs want. They want a communist dictatorship.

Diffidently, I must inform you of some specific instances. I use lliquid N2 in my medical practice-for skin cancers etc.It requires having a large vacuum flask filled with air,without oxygen.In the past,I'd go over,have it filled and bring it back to my office.Last year,the company had to be cerified to handle the 'air minus oxygen'.I can no longer pick it up;it must be delivered.Increase in cost,100 bucks per time. I'm in Michigan I'm very,very good at what I do. I received a jjob offer from one of the plains state for an increase of about 140K/year.It's a Republican state. Unemployment is 2.8 % Reality is a tough concept for some folks,but try

Soooo because you have to pay an extra $100 for N2 delivery you are going to the prairie for $140K raise? Just trying to follow you logic here. But I'll offer a few observations:

1. Is there a legit reason for the special handling of N2?
2. If not, was this imposed as a some liberal conspiracy to make your life unpleasant, or even more likely, pushed through by a corporate lobby to drive up their profits?
3. Congratulations on your very well paying job. If you can wander a few states over for a $140K "raise" that's pretty sweet. I heartily suggest you make haste to this republican paradise.
4. If you consider triple the median household income a "raise" then I humbly suggest you are the one insulated from reality.

Diffiently I must say that I am unmoved by your arguements. But thanks for playing.

I agree with Jon Conyers - Regulations are not killing jobs - But No regulation will certainly kill PEOPLE.

It is like saying traffic lights are the cause for transit delays - we should get rid of them. YES traffic lights may cause delays in some places but they were put in for a reason and the reason is to PROTECT people. BETTER LATE THAN NEVER.... Guys. THINK

Just because someone is from detroit and a democrat - you are just going to disregard what he says? Well, buddy - then you are wrong. He is in a better position to comment about jobs - because he has seen the problem closely and has had to deal with it.

Also you criticize my use of capitalization - but don't really add anything to the conversation? Capitalization is used in in literature and the web to get attention - and I sure got yours - and it at-least made you think. I can lead a horse to the pond, but I cant make it drink.

What are the real job killers for the middle class? They are:

Offshored jobs to low cost labor pools with products imported back into the country duty free.
Automation which replaces human workers and paid for with investment tax credits.
Illegal aliens who drive down wages while they swell the welfare ranks paid for by property owners.

How many school children , or seniors will have to die from contaminated foods for instance before the American people fully understand what a threat Republican deregulation is. Will Newt if he manages to survive, insist that that dying from contaminated food is another reason to eliminate food stamps.
