UPDATE: Gagging on the Ag Gag Bill -- Industrial Lobbying and Corporate Overreach at Its Finest

UPDATE:

The Washington Post is reporting that the Ag Gag bill (Iowa SF431) has stalled in the Iowa legislature and likely will not be passed, at least not this session. Many thanks to the 40k of you who signed the petition below to let legislators know that a well-run farm is a beautiful place with nothing to hide. I'll let you know if indeed the measure does come to a vote.

Industrial agriculture, like most powerful business interests, has a very effective lobbying organization -- not only in DC, but also in state capitols around the country. Over the last few years they've been stung by surreptitious video recordings taken on a few farms showing examples of egregious animal abuse, unsafe working conditions, and environmental degradation. See examples here, here, and here (caution: some parts may be disturbing to some people).

Needless to say, it makes them look bad, which of course they don't like. Now let me state right from the start here that I and the organization I represent, Slow Food USA, are not at all anti-farmer, and firmly believe that a vast majority of America's farmers are honest, hardworking, industrious and well-meaning keepers of their land and heritage. That said, there are exceptions, and like in any industry, a few bad apples can make the whole bunch look bad.

But instead of working hard to stop those few bad actors, Big Ag's response is to try to criminalize the whistleblowers. And their first attempts, in four states (Florida, Minnesota, Iowa and most recently New York) are so far-reaching as to beg obvious 1st amendment questions to say the least.

Take for example Iowa's proposed bill, which as I type has passed the Republican controlled House and is pending in the Democratic-controlled Senate. Formally titled "SF431: An Act relating to offenses involving agricultural operations, and providing penalties and remedies," it makes it a criminal offense to photograph, video-or-audio-record any farm without the owners consent. It goes well beyond making it illegal for you to stop by the side of the road and take a snap of those cute sheep or that gorgeous old barn (though it does do that). It also makes it illegal to possess and/or distribute such images, putting them on par with child pornography.

Not only would it mean that, for example, the producers of the Oscar-nominated documentary Food, Inc. would face penalties, but also that yours truly could be fined or jailed simply for the hyperlinks I referred you to in the second paragraph, above. Imagine what our food system might look like today if some similar disruption of free speech had stopped Upton Sinclair from publishing The Jungle.

Slow Food has a petition circulating against the bills, which I urge you to sign (over 33K have already). I will hand deliver this petition to the Iowa Senate. We also have a beautiful and fun campaign going on our Facebook page called "Farmarazzi," requesting that people send in photos of farms near them to demonstrate that a well-run farm has nothing to hide.

Now some of the farmers I have spoken with tell me that it is a matter of privacy, and that they all suffer when videos surface that make them all look bad or that somehow portray them in a false light. Doubtless some commenters below will take that tack. But to them I say this: In cases of trespassing, breaking and entering, or slander and libel, we already have laws in place for all of those offenses. But the bill in question does not protect animals, does not protect farmers, does not protect eaters, does not protect the environment, (does not create jobs by the way), and does not pass the constitutional laugh test.

My dad grew up on a working farm and he's furious at what he calls the "agri-factories", he's even gone so far as to say they're just sweatshops.

The ag "gag" bill is a case of shooting the messenger and protecting corporate criminal activity, in this case, its egregious and systemic cruelty to farm animals. Anyone who misrepresents him/herself while photographing, videotaping, etc. someone else's property should face consequences. You don't own it, it doesn't belong to you so you can't do whatever you want. Get it?

That's civil. This is criminal. :o)

This bill needs to become law in every state as it is unfair to overburden a property owner, who may not even have the funds necessary to go up against the H.$.U.S. and the 100 - 200 million dollars brought in thanks to their highly questionable pandering tactics that pull on the heartstrings of the well intentioned but ignorant and misguided public, by offering no alternative to lengthy and costly lawsuits.

Interesting they can have the power to keep people off their operations or taking pics from public ROW but when it comes to what women do with their bodies and who people marry they they get quite intimate. Such hypocrisy.

There is a clause in the bill that says the violation must occur ON the farm, and I wondered what the purpose was, maybe that's it.

Yes and they settled out of court. And all she said was that she wasn't going to eat beef anymore. That's freedom of speech in the modern era.

Just what exactly is our government all about, and why have the USDA headed by a Monsanto crony and former Gov. of Iowa, Thomas J. Vilsack?

The links he posted as proof of the terrible abuse in food production made me want to vomit, not because of what was happening in them, but because Mr. Friese might as well be pushing the PETA agenda himself. Shame on Slow Food for giving those people a pat on the back and still claiming to be in support of the small farmer! Is that ONLY if the small farmer growing slow food grows only fruits and vegetables?! I do not agree with this law, it is poorly written, but you are embarrassing yourself in the manner of your involvement. Even "slow food" farmers buy only female chicks for laying operations. Farming is not for the faint of heart, you can not keep sick or non-productive animals around, and they must be disposed of,even in the most humane operations. Is Slow Food a vegan proponent? Do you support the HSUS and PETA? Please let me know so I can plan MY support accordingly. If you don't, perhaps you should reconsider publishing articles in which your board members hale one of the biggest threats to real food as heroes for exposing "the truth".

The clips in question were posted as examples, and chosen somewhat at random, to demonstrate that the proposed law would prosecute me simply for exercising my right to post them here. That said, Slow Food neither supports nor opposes HSUS, PETA, or a vegan diet. They are all different agendas from that of Slow Food.

We are working toward a food system that is Good, Clean, and Fair. By Good, we mean that it's good tasting, good for the eaters' health and good for the environment. By Clean we mean that there's nothing in the food that isn't food (and if it wasn't food 100 years ago, it's not food now), and by fair we mean it's price should be fair and the people who produce the food should be justly compensated for their efforts. THAT is what Slow Food stands for.

I understand both your concerns about PETA, et al, as well as their concerns about the treatment of farm animals, and believe that both sides would be far better served if they were to engage in dialogue instead of name calling, sinister tactics and unjust lawmaking.
