The Supreme Court UPHOLDS Health Reform -- What Does It Mean for You?

In a surprise decision, the U.S. Supreme Court has upheld the constitutionality of the Affordable Care Act passed in 2010. You will hear a lot of commentary from legal and policy experts in the next few weeks about this decision, but this post is about what the Court action means for YOU personally.

The outcry from the right will be deafening, and there will be attempts by the House Republicans between now and November to take out sections of the law, although the Senate Democratic majority is not likely to approve any of those actions. Obviously, if the Republicans win the presidency and the Senate in November, the full ACA may be whittled away before its full 2014 implementation date. Now is the time to acquaint yourself with what the health reform law really means to you -- while you still have it.

1. If you are employed and enjoy health insurance as part of your work benefit package: The Affordable Care Act does not currently have a large impact on large self-insured companies; however, as the law is fully implemented in 2014 and beyond, there is a chance that your employer may determine that employees can get cheaper coverage through a state exchange and over time some employers may drop employer-sponsored coverage. If you work for one of those companies, you may actually have more choice of plans through an exchange and depending on whether or not the employer subsidizes you or you are eligible for a federal subsidy, you may pay less than you do now. Until that time, you will see a few benefits of the ACA -- no lifetime limits on your benefits; restrictions on annual limits; preventive services without co-pays; and adult children allowed to stay on parents' plans until age 26.

2. If you are lucky enough to be on Medicare: The Affordable Care Act has brought seniors a number of significant benefits already. The doughnut hole in prescription drug coverage is being closed every year and will disappear by 2020. In 2011 alone, 3.6 million seniors saved $2.1 billion on their prescription drugs because of health reform. Another benefit for seniors is the preventive services that are available without co-pays and the 4% reduction in premiums for seniors enrolled in managed care Medicare plans (called Medicare Advantage) in 2012.

However, looming on the horizon if there is a Republican sweep in November are big changes to Medicare, including a potential rollback of some of the ACA benefits and an attempt to switch to a voucher system which would give you a fixed amount to buy a plan without any guarantee that the amount would be sufficient to cover what you currently have.

3. If you are self employed and have an individual insurance policy for yourself and your family: Try to keep your policy while you wait for the state exchanges to be put in place -- that is, if you can continue to afford it. Don't let it lag because we do not know the outcome of the November elections or what your state may do with its exchange, and if parts of the Act are overturned, you could be on the streets again, trying to get coverage as an individual and potentially being turned down for pre-existing conditions.

4. If you are uninsured but are hoping to be able to get it through the Affordable Care Act and a State Exchange: The good news about the fact that the Court upheld the entire law is that you will still have the option to buy insurance through an Exchange in your state and if your state does not offer one, through a federal exchange. And you will get help affording that premium via a federal subsidy that will allow you to earn up to 400% of the federal poverty level before the subsidy phases out. For those who have a pre-existing condition, the law still guarantees that insurers must accept you starting in 2014.

5. If you are a small employer and were hoping to be able to help your employees get health insurance at a reasonable rate through the state exchanges: There will still be options for you and your employees. The state exchanges will be open to individuals and small business, offering a variety of plan options at a variety of prices, much like the Massachusetts exchange. Up to now, small businesses have found it very expensive to insure their employees, particularly if any of them have been sick.

If Republicans sweep the November elections, it may not matter how the Supreme Court has ruled. The Republicans will surely make a show of repealing the entire Affordable Care Act even though they have no plan to replace it with a plan that could make health care more affordable. Don't forget that the Republican plan for health reform has only three or four main provisions -- protect doctors with malpractice reform; allow fly-by-night insurers to sell their "hospital gown" plans (looks good in the front but is bare in the back) across state lines; and make you, the consumer "more accountable" for your health care costs (translation: you pay more).

No matter what you hear on Fox News, this is NOT a tax on the middle class! This is a tax on people who do not have insurance and will not take personal responsibility for their health care. This is a tax on those who would shift their costs to the rest of us!

There are many benefits of the Affordable Care Act. Educate yourself and fight to keep them.

What does it mean to me? My 26 year old daughter with Type I diabetes now on COBRA for $509 a month might be able to find health insurance when the COBRA expires and not pay $1,000 out of pocket each month for overpriced medical supplies that, if she does not get, she dies. A homeless guy in my neighborhood has no health insurance. With asthma, he worked last Friday in 100 degree heat as a handyman so he could afford to buy an inhaler and breathe. The state stopped enrolling single adults on Medicaid. The local emergency rooms turn him away. Then there's the guy I talked to last week who lost his home to foreclosure due to a medical bill. And I read Senator McConnell saying that we have the best health care system in the world, a statement that has as much credibility as the tooth fairy.

It's not perfect, but it's a start. What we really need is universal health insurance taking Medicare from cradle to grave. Medicare is one of the best programs the government has enacted so far thanks to President Lyndon Johnson. It combines the governments resources in conjunction with the private health insurance carriers. Medicare is administered by a a government agent called the Centers for Medicare and Medicaid Services aka CMS. It's rules and regulations protect mostly the consumer & dictate the cost of premiums, what benefits must be given, etc. There is a program within Medicare that helps people who can't afford the cost of medication & alike. I am a Calif Licensed Health Insurance Broker and no one I know has gone bankrupt being on Medicare! You need to write the 'Congressmen and Senators' in your state who supposedly represent you in Washington (ha ha ha) and tell them how you feel.

Here's a few observations about this SCOTUS ruling:

If the responsibility of the Judicial Branch is to uphold laws passed by the representatives of the people if possible, they why was the vote not 9-to-0?
Why, as reported, is there anger on part of the justices on the right regarding Justice Roberts siding with the liberals on this issue? Pure and simple - at least three of the four right-wing justices are, in fact, a political cabal.

It is my opinion that Justice Roberts recognizes that the Court is being held in increasing amounts of disdain and contempt. And that is not good for America.

It does not mean a damn thing for me but the individual mandate is a give away to health insurance companies and the implementation of a single payer system [Medicare for Everyone} will rid us of the health insurers. It cannot happen quickly enough.

I agree that expanding Medicare from cradle to grave is what is needed; however, you actually don't want the private health insurance companies to go away. They are makes the Medicare system so great! The Medicare premium is collected monthly by the government agency (The Centers for Medicare and Medicaid Services aka CMS) and in most instances paid to the private insurance companies who administer the beneficiaries plan which include HMO as well as PPO plans with no premium which has already been paid to CMS and in most instances there is no co-pay for HMO plans. The private health insurance carriers who participate in the Medicare system are all regulated by CMS of what they can and can't do! I know all this because I am a CA licensed Health Insurance Broker also certified with CMS to sell Medicare plans. So the health reform law aka Obama Care is a great start even with the 2,800 pages thanks to the Republicans in Congress and their lies!

I thank you and all the other people who are "pro and con" for expressing their opinions.
I have read your article and all of the comments.
People with some education ( and those with none... or not enough ) just DO NOT understand
any of this .
We need "plain" talk .
Perhaps an open forum where people will be not afraid to ask "dumb" questions but will get an
answer that is simple that they can understand. I hope you understand my drift.

This site was put together by Anthem Blue Cross to help educate people on what it's all about (unbiased) and just because someone has a college degree if that's what you are referring to by being educated doesn't mean they are educated!

People have a lot of questions about the direct benefits for them. People who support the ACA have allowed the GOTP to mis-define the benefits and now there is all sorts of gobbledy-gook out there. Case in point is Romney's reaction and pat statements he gave in response to the Supreme Courts' ruling. It was full of fibs and lies.
People need to know this stuff. I know that the ACA will still be very popular if Democrats just start talking seriously about it.

Over 250 million people in the US already have insurance. They will not be paying a tax or using the Exchanges or getting a subsidy. So while the Republicans have already started screaming about a big tax on the middle class, step back a moment. Very few people will likely refuse to get insurance and end up paying the "penalty" or now "tax", In Massachusetts, Romney's state and Romney's health care reform law, WITH an individual mandate and a penalty, only 1% paid that penalty in 2009.

Great article; we just need more like it. Because of all the misinformation and outright lies being spread by the Republicans, people are confused such as the man who in 2010 stated at a town hall meeting, down with this health care reform law, it's socialism 'but don't touch my Medicare'.
As a CA Lic health insurance broker who is also certified with CMS to sell Medicare plans I have been replying to readers who have commented on your article pointing them to an unbiased website from Anthem Blue Cross http://www.makinghealthcarereformwork.com/healthcarereform/ which simplifies the whole thing in plain talk to better understand how great this law is and what's in it for them and there is something in it for everyone!
