HR 4970 Empowers Abusers, Not Victims

For nearly two decades, the Violence Against Women Act (VAWA) has provided essential protections for immigrant survivors of domestic violence and sexual assault. VAWA was created because Congress recognized that abusers routinely used victims' immigration status to perpetuate the cycle of abuse.

Today, however, a U.S. House bill that proposes to amend VAWA threatens to undermine these crucial protections and put vulnerable victims at greater risk of abuse. HR 4970, co-sponsored by Representative Sandy Adams (R-FL), would eliminate confidentiality protections for immigrant victims of domestic violence and would create dangerous and unworkable requirements for victims of violent crime.

Lawmakers must understand the devastating human effects of this proposal. Had this bill been in effect two years ago, my clients would have suffered immeasurably. "Sara," a victim of domestic violence, might not be alive today, and "David," a child victim of sexual assault, would lack protection.

"Sara" entered the United States on a student visa to study at a prestigious university. Within a year, she fell in love and married a United States citizen. Her husband soon became controlling and aggressive, forcing her to quit school. His beatings became increasingly violent, culminating in a particularly vicious attack that left her unconscious. Neighbors called the police, who broke down the door to rescue her. Yet Sara withdrew the charges against him out of fear that he would kill her, as is too often the case. Without proper U.S. identification and legal status allowing her to financially support herself, Sara was afraid to escape her extremely dangerous husband.

Through a victim advocate she met while her husband was briefly jailed, Sara and I met and began to complete a VAWA application for legal residency in secret. Once it was approved, advocates strategically planned her escape and she was relocated to another state.

I know firsthand how dangerous an abuser can be and the risks that immigrant survivors take when they courageously decide to leave their abusers. Sara's husband was so enraged that he began threatening me after he found my business card among things she had left behind. Fortunately, he has never found Sara. She is now a lawful permanent resident. If Sara had not had the promise of confidentiality she likely would not have taken the steps necessary to free herself from her abuser. Had it not been for the VAWA protections that keep victims' secrets safe, Sara might not be alive today.

VAWA has provided a confidential way for victims of domestic violence, like Sara, to safely file for residency without having to depend on their abusers to legalize their status. However, HR 4970 completely eliminates confidentiality for applicants like Sara, by allowing immigration authorities to notify abusers of the application and solicit their testimony. HR 4970 creates a dangerous, even deadly, predicament for immigrant survivors of domestic violence who, like Sara, are undocumented solely because their abuser refused to file the necessary paperwork to legalize their status as a means of controlling her.

HR 4970's proposal to amend VAWA also effectively eliminates protections for immigrant survivors of violent crime, including kidnapping, rape, human trafficking and domestic violence by creating untenable requirements for U-visa applications. The U-visa was created as a law-enforcement tool to encourage immigrants to report violent crime without fear of deportation. It requires that law enforcement endorse the application by certifying that the victim was cooperative throughout the investigation and prosecution of the crime.

My client, "David," now a teenager, struggles with physical and mental disabilities. When David was 12, he was sexually battered and molested three times by a family friend. However, because he had the mental capacity of a 6-year-old, he was unable to communicate to his parents what happened. His parents didn't realize that something was wrong until David exhibited fear of the abuser months later, alerting them to the situation. His parents called the police and testified against the abuser, helping to ensure the conviction of a serial child molester.

After the prosecution concluded, the state attorney's office referred David and his parents to AI Justice and I filed U-visas for him and them. David is still recovering from the trauma. HR 4970, with its 60 day reporting requirement and requirement that the U-visa be filed during the criminal case, would make David ineligible for a U-visa. It would discourage David and countless other victims of sexual abuse from reporting crimes and assisting law enforcement, allowing child abusers like David's to roam free, further endangering our communities.

For years, Congress has reaffirmed VAWA through bipartisan reauthorizations, demonstrating a commitment to the particular issues faced by immigrant survivors of domestic violence and sexual assault, like Sara and David. HR 4970, on the other hand, demonstrates a complete lack of understanding of the reality of survivors' lives. The bill would roll back decades of protections for immigrant survivors without any justification, and most importantly, would have real consequences, endangering the population it was designed to protect and ultimately defeating the entire purpose of the Violence Against Women Act itself.

This article is about the sort of domestic violence that is obvious. There is also the domestic violence that is anything but obvious and it is committed by both sexes. READ, PEOPLE, READ. It would be illegal to discriminate against 1 gender over another. We do live in America. The gov't likes nice lil' acronyms like VAWA , ICE, DOMA, women were the intended group but VAWA protects everyone. I represent men who are victims. It is incredibly hard sometimes for them to get over their sense of manhood & accept the help. I have had men who would rather let the abuse continue & remain undocumented then throw the mother of their child under the bus. I have male clients who have been beat up with hammers, their bank accounts emptied, their children abducted by the wife....these were all VAWA cases filed by men. It also protects the elders & children, including men & boys, from violent abusers - no matter their gender. learn what U are talking about before U make ignorant statements that others just latch on to & start to believe. Such ignorance of the laws is dangerous. Saying something over & over does not make it true. this is why we are so screwed up as Americans, people believe all the crap they hear & read nothing. Please read the law yourself, nothing states men are excluded. It is any victim of spousal abuse. Are you upset with something that protects abused humans because they R immigrants or because they R women? sounds like angry white man syndrome to me. Get over it. This House Bills only excludes ILLEGAL immigrants, not legal US citizens.

The House bill excludes much more than that. Try reading. LGBT, Native Americans (and anyone else on reservations), and several other groups would all lose protections under Ms. Ortiz' bill.

All immigration bills address immigrants. Immigration laws do not apply to U.S. citizens. there are many categories: non-immigrants, immigrants, undocumented immigrants, legal permanent residents, asylees, refugees, naturalized citizens, and parolees (not the criminal kind). Most people do not understand each of these legal distinctions and often are dead wrong when describing immigration laws. AGAIN READ, READ, READ.

"Women commit the majority of child homicides in the United States, a greater share of physical child abuse, an equal rate of sibling violence and assaults on the elderly, about a half of child sexual abuse, an overwhelming share of the killings of newborns, and a equal preponderance of spousal assaults...The sole explanation offered by criminologists for violence committed by a woman is that it is involuntary, the rare result of provocation or mental illness, as if half the population of the globe consisted of saintly stoics who never succumbed to fury, frustration, or greed. Though the evidence may contradict the statement, the consensus runs deep. Women from all walks of life, at all levels of power — corporate, political, of familial, women in combat and on police forces — have no part in violence.

It appears that when women commit DV against men, the salient point that it is domestic violence goes unmentioned. Instead it is called manslaughter, murder, assault, grievous bodily harm, actual bodily harm, malicious wounding etc.

However, when men attack their girlfriends or wives, reporters fall over themselves to speak of domestic violence and spousal abuse. Indeed, with monotonous regularity, they also seek to warn us that there is an epidemic of the same.

Women committing domestic violence (shhh – but don’t tell anyone)

•Poisoning – Woman poisons her husband using anti-freeze
•Kicking – Woman kicks heel of high-heeled shoe into boyfriend’s brain
•Stabbing – Woman stabs and kills boyfriend

•Another stabbing (but we’re told she didn’t commit DV, he did) – Woman stabs and kills boyfriend

Domestic violence laws cover both men and women as victims and perpetrators. If someone commits violence against their spouse, they are charged with DV. Agencies that serve women victims most often serve male victims, too. It's been that way at every agency I've worked and I have never seen an agency that discriminates based on gender. VAWA covers anyone that is a victim of domestic violence.

It just happens that most of the cases we see are women being abused by men, over and over and over again.

VAWA covers any victim of domestic violence, sexual assault, etc. I have worked at many agencies that serve victims of these crimes and all of them provide services to woman and men alike. The only difference is that the overwhelming majority of victims are women and the majority of the perpetrators are men.

I worked at a police department as well and they would charge any abusive spouse with domestic violence. Gender doesn't matter. I don't know where your assumptions come from, but I'm speaking from a decade of real life experience working with these issues.

All these speacial laws to protect just one gender. Who is protecting the other gender when they are abused, let me guess it's the same old reply, it's not that bad.

61% of all child abuse is committed by biological mothers.
25% of all child abuse is committed by biological fathers.

To solve this problem, Congress should pass a bill that says if you MARRY a US citizen, you AUTOMATICALLY become a US Citizen. Who are we to stop what two people in love decide to do?!! It'll be call the TRUE LOVE LAW. Besides, the Republicans are all pro-marriage-between-a-man-and-a-woman! Then, the woman would have all the rights to report abuse as a US Citizen. Problem solved.

To put it simply, the Republican party had become the *party of malice*. These are the people who are still arguing in favor of torturing prisoners. Do not imagine they are *simply unaware* of the harmful consequences of their actions. They are fully aware of the consequences of their actions. Doing harm is not an unfortunate byproduct of their legislation, its the primary intent.

I find it just another way to give amnesty to illegal aliens. There's a "chain of migration" attached to this bill - so more illegal aliens can come to America. For heaven's sake, we can't save the world and we can't even take care of OUR own people. When 1 out of 5 kids in this country go to bed hungry, how close are we to a third world country, and it is ALL and ABSOLUTELY because of the illegal aliens. Our government needs to use the world NO NO NO>

NO, the purpose of this law is not to have more "illegal aliens" come to the U.S. It is is to protect HUMANS who have been victims of horrible, violent crimes. We are going downhill as a nation if we lose our ability to care about other humans.

Undocumented immigrants have nothing to do with child hunger. There would be hunger whether or not immigrant people had a pathway to legal residency here.
