Supreme Court Justice Clarence Thomas must recuse himself immediately from any cases regarding the constitutionality of the health care reform law.

The Thomas household has profited from opposition to health care reform. His wife has already taken nearly $700,000 from health care opponents and now openly advertises herself as a crack lobbyist with the "experience and connections" to overturn the law of the land.

Yesterday, 75 of my House colleagues sent a letter to Justice Thomas calling on him to recuse himself from deliberations related to health care. Now I need your help to show Justice Thomas that we won't accept a biased Supreme Court.

Tell Justice Clarence Thomas to recuse himself from any cases regarding the constitutionality of the health care reform law. Go to ConflictedClarenceThomas.com and co-sign our letter.

Next week, I'll hand deliver your signatures to the Supreme Court to make sure Justice Thomas knows where you stand on maintaining impartiality in our nation's highest court.

Stand with me today.

Anthony

P.S.: The full text of our letter to Justice Thomas below.

The Honorable Justice Clarence Thomas
United States Supreme Court Building
1 First Street Northeast
Washington, D.C. 20543

Dear Justice Thomas:

As an Associate Justice, you are entrusted with the responsibility to exercise the highest degree of discretion and impartiality when deciding a case. As Members of Congress, we were surprised by recent revelations of your financial ties to leading organizations dedicated to lobbying against the Patient Protection and Affordable Care Act. We write today to respectfully ask that you maintain the integrity of this court and recuse yourself from any deliberations on the constitutionality of this act.

The appearance of a conflict of interest merits recusal under federal law. From what we have already seen, the line between your impartiality and you and your wife's financial stake in the overturn of health care reform is blurred. Your spouse is advertising herself as a lobbyist who has "experience and connections and appeals to clients who want a particular decision - they want to overturn health care reform. Moreover, your failure to disclose Ginny Thomas's receipt of $686,589 from the Heritage Foundation, a prominent opponent of health care reform, between 2003 and 2007 has raised great concern.

This is not the first case where your impartiality was in question. As Common Cause points out, you “participated in secretive political strategy sessions, perhaps while the case was pending, with corporate leaders whose political aims were advanced by the [5-4] decision on the Citizens United case. Your spouse also received an undisclosed salary paid for by undisclosed donors as CEO of Liberty Central, a 501(c)(4) organization that stood to benefit from the decision and played an active role in the 2010 elections.

Given these facts, there is a strong conflict between the Thomas household's financial gain through your spouse's activities and your role as a Associate Justice of the United States Supreme Court. We urge you to recuse yourself from this case. If the U.S. Supreme Court's decision is to be viewed as legitimate by the American people, this is the only correct path.

We appreciate your thoughtful consideration of this request.

Sincerely,
ANTHONY D. WEINER
Member of Congress

If we are going to split hairs, I think Elena Kagan needs to recuse herself because she has worked as Obama's lawyer on several Supreme Court cases before she was appointed a Justice there.

Actually, she should never have been appointed to the highest court in the first place.
Just go to the supreme court website: supremecourt.gov and search "Barack Obama".
You will see Kagan was his lawyer.

The game is already rigged, Anthony. You want to make it even more corrupt?

It seems the Democrats are panicking about their watertight (read Titanic) legislation. Now they're playing the man instead of the ball. Or in Weiner's case, the man's wife.

How long have you been a sexist, Congressman Weiner (great name)? Have you always believed that a wife could do nothing separate from her husband? Or does it just depend upon whether you agree with the wife or not?
02:12 PM on 03/08/2011
No, he's just quoting the letter of the law. It states that in the case of the appearance of a conflict for the justice or his/her spouse, then he or she should recuse himself/herself. The law is not sexist, and neither is Congressman Weiner. Speaking of which, nice burn on making fun of his name. What are you, twelve years old?

“Democrats are raising this issue to undercut the suggestion that Elena Kagan might have to recuse herself from any consideration of the constitutionality of the Affordable Care Act,” says doug mataconis.

Not gonna happen, Congressman. And I find this sudden concern with the Constitution today amusing considering how you and the rest of your party completely disregarded it while ramrodding this abortion of law that's soon to be found unconstitutional down our throats.

Weiner is not just from NY, he is from NYC.
They outspend 99% of everyone else in education but produce, '...data released by New York state education officials, only 23 percent of students in New York City graduated ready for college or careers in 2009...well under the 64 percent graduation rate, the Times noted...'
They have a 45% out of wedlock birth rate in NYC.
NYC is on the verge of bankruptcy. Wiener's NYC also pays for the '...absent teacher reserve pool, which consists of teachers who have lost their jobs because of budget cuts or a school is shut down for poor performance, but have not been accused of incompetence or wrongdoing. Those teachers, (around 1,100) have no permanent classroom jobs but draw full salaries costing NYC $100 million annually.'.. but Weiner wants American taxpayers to pay more to fund crap like this but Weiner (and Obama) have the Chutzpa to call it 'investing in education'.
Mr. Weiner should clean up his own backyard and do the manly thing and stop attacking a woman with an independent career, and independent views making an independent living.
If he wants to put women back in the kitchen, he can start with his own wife.

The case is much stronger that Elena Kagen should recuse herself, since she helped get the bill passed.

I agree, both should recuse themselves and let the other 7 decide.

He should recuse himself but he won't. Why else would these conservatives groups pay his wife the big bucks?

Thomas isn't conflicted, Rep Weiner. He's firmly rooted in 18th century American and has no respect for the Supreme Court, the law, women and what passes for its ethics these days. Poppy must be proud.

This presumes that Clarence Thomas, who perjured himself during his confirmation hearings, has any sense of ethics.
