Paul Minor's Attorneys File Emergency Motion for His Release

Attorneys representing Paul Minor, the Mississippi attorney currently serving 11 years in federal prison on bribery charges trumped up by Karl Rove's confidantes in the Bush Justice Department, filed an emergency release motion with the 5th Circuit Court of Appeals on Monday seeking his immediate release while the court deliberates his appeal. It is the last chance Minor will get to see his wife before her imminent death.

Minor's wife of 41 years, Sylvia, is dying of terminal brain cancer and her moments of clarity are dwindling. Her oncologist issued a statement over the weekend at the request of her family noting that Mrs. Minor's "demise is imminent.... Mrs. Minor requests the presence of her husband during this last part of her life... it is urgent that this occur immediately due to her rapidly deteriorating condition."

Paul Minor's only crime was being the number one donor to Democratic candidates in Mississippi, and, as this New York Times editorial last week correctly highlighted, his case deserves an urgent review by the Obama Justice Department.

Minor is legally entitled to release on bail from the Pensacola Federal Prison Camp where he has spent the last two-and-a-half years. His attorneys have successfully raised "substantial questions" about Minor's conviction, the key legal test which requires the defendant's release on bond pending the outcome of an appeal. The tough questions asked of the DOJ attorney by the panel of judges hearing Minor's appeal last week make clear the fact that these judges appear to have their own "substantial questions" about the Justice Department's prosecution of Mr. Minor for bribery.

In March of last year, the 11th Circuit on virtually identical issues found that former Alabama Governor Don Siegelman, another Rove victim, had established substantial questions about the correctness of his prosecution and was therefore entitled to release pending appeal. Given this decision, it would raise grave suspicions if the 5th Circuit now denied the release of Paul Minor.

Minor previously asked for release on bail last year, but Judge Priscilla Owen denied the petition. Judge Owen is a member of the ultra-conservative Federalist Society and a controversial Bush appointee whose first nomination to the 5th Circuit was blocked by Congress in 2003. According to The New York Times, Priscilla Owen has been "guided by the hand of Karl Rove" ever since Rove helped her win a seat on the Texas Supreme Court in 1994.

To her credit, just minutes before Minor's appeal hearing last week, Judge Owen recused herself from the case, likely in response to a letter sent the previous evening by Minor's attorneys detailing the close connections between Rove and Judge Owen.

Given the near certainty that Rove was the chief strategist behind the Bush Justice Department's targeted prosecutions of Paul Minor and other prominent Democrats -- the details of which are currently under Congressional investigation -- Judge Owen's impartiality was questionable. She was correct to step down from this case.

The Justice Department knows there are substantial questions surrounding Paul Minor's conviction that entitle him to bail, and should not oppose Minor's release while the 5th Circuit decides his case.

Given the substantial questions raised in his appeal, Paul Minor deserves immediate release from prison and the chance to comfort his wife Sylvia as she slips away.

Clevelandchick I posted the sites addresses names dates etc. to answer your post that I had not given any factual article to show proof of my claims but they have not let it go through. Maybe it shot too many holes in the article?

Hopefully, prayerfully Minor can be with his wife. I would be heartened to see a few more comments about his joining his wife at her bedside. I too want the Bush DOJ reviewed - there are others beyond Minor, Seleigman and Stevens that should be investigated. First let's think of Mrs. Minor. Her husband. Her family. Then let's think how justice shoud be changed.

*sigh* The extent of the corruption in ever facet of government that was allowed to proliferate under the Bush administration is so utterly deplorable and against everything that the U.S. was founded upon... that I am ashamed to call myself an American. President Obama is making great strides to get the country back on track... but until transparency is fully established in government... and in the press... with both complete disclosure as well as full accountability... the U.S. will not be able to heal... which is a necessary precondition in order for the country to move forward.

While there are those who are advocating for forgiveness and understanding and suggesting that it is time to look toward the future.... until the wounds of the past have thoroughly been excised and brought into the open air... regardless of how painful and embarrassing this is... the U.S. will continue to be a very sick nation of lies and secrecy.

In the words of George Santayana, “Those who do not learn from history are doomed to repeat it.”.

We must first, however, know just what the truth of that history really is!

Then you haven't studied the case! He was found guilty of bribing judges, racketeering and fraud with more counts than these.. The part of being let out twice and found drunk and being away from his ankle monitor is ALL there if you will look!

His charges were trumped up by Rove and carried out by judges in Rove's pocket. Of course he was found guilty, Owen would not have recused herself if there was not foul play. If you were going through a situation like that, being railroaded for your political beliefs, you'd get drunk too. That's hardly a crime.

Sir, I disappointed in you. Your complete disrespect for the rule is shameless. We need to completely look at all federal prosecutions as we have had a Justice Department full of people who have no ethical morals at all that were hired under Gonzales and Mularsky. The Stevens case says it all. We have US Attorneys acting as political operatives. Any one who voted for George Bush should bow their head in shame.

There are so many things about this article that are BOGUS, BIASED and BLATANTLY leaving out facts. First you say his only crime was being a top Democratic donor but the crimes were Bribery, racketeteering and fraud among others. He was found guilty of all by a jury (not picked by Rove or anyone else. One Paul's friends posted that Paul TOLD HIM he bribed the judge and told him HOW HE DID IT and that the Judge OWED THE FAVOR! Secondly -A near certainty that Rove trumped up the charges. This has never been shown true except in your minds. Thirdly- you say Minor should be released pending urgent appeal . He has had his appeal and is being reviewed by 5th Circuit now. Fourthly- Paul Minor WAS released TWICE!!! He broke the terms of releases by getting drunk and going to a restaurant where alcohol is served and dissappearing for over 4 hours from the ankle monitor! Why should he be given strike three? (and this time maybe gone for good). Fifthly you say that it would raise grave suspicions if 5th circuit denied his release. How ?(given the above facts)

Where do you get your info, DoubtingDot? The only thing Minor was found guilty of was some charge of 'honest services mail fraud'. And it's a trumped-up charge. Also, I have found NOTHING about Paul previously being let out on appeal, being a drunk, etc.

Looks like DoubtingDot just got served!

The point is that Paul Minor has been treated unfairly by Bush's biased (un)justice system from the very beginning. Setting him free immediately is the least this man and his family deserve.

All I have been served is a plateful of this liberal unfounded rhetoric. Look at the FACTS!! He is guilty as sin and WAS let out TWICE. He broke the rules and should be incarcerated until the 5th Circuit finishes with it's review after his appeal. Why should he be let out a third time and possibly be gone for good? Great editorial!!! Thank you for bringing this to the public's attention. Many of these cases seem to be swept under the rug by Faux news and other outlets. This case and the Siegelman case are good examples of the misuse of power by the previous administration.

What I see is cruel and unusual punishment. The man is accused of committing bribery, To me it looks like he is he's an innocent man being falsely incarcerated for political reasons. Even murderers get out on bail and get shortened sentences. The least they could do is let the man out during the appeal process so that he can be with his wife in her last days! He's not a flight risk. Let him out! Better yet, let him go free!
