I just read the recent decision by Judge John G. Bates dismissing the Wilson's lawsuit. Without going into the legal merits of the dismissal, it should be known that this Judge was a former Whitewater prosecutor. In addition, the judge used a legal technicality to dismiss the case based upon his assertion that the Wilsons could have had an administrative remedy for unauthorized disclosures under what is commonly called the Westfall Act of 1988.
The problem with the Westfall Act is that the Attorney General (Gonzales) can and did issue what is called a "Westfall certification" which constitutes an ad hoc determination that the defendants were working within the authority of their duties. And the judge stated that the Wilsons had the burden of proof in overturning the governments so-called Westfall authority. This is another case of commutation by the Bush/Cheney administration.
