First, you imply that asking questions is an unnecessary recent development. What are you basing this on? Thomas himself explained his reticence by saying that "I have some very active colleagues who like to ask questions. Usually, if you wait long enough, someone will ask your question." Obviously he considers questions during oral arguments to be important, he apparently just does not like to be the one to ask them.

Second, it is true that the briefs are carefully reviewed and discussed by the justices and their clerks. But they prepare questions based on the briefs that they then may ask during the oral arguments. You seem to be implying that justices should not have questions about material in the briefs. Why would you expect that they not have questions?

There is clear evidence that oral arguments certainly influence the decisions of the Supreme Court. I refer you to Wrightsman's "Oral Arguments Before the Supreme Court
An Empirical Approach" for more information on the critical role they play.”
