“Given that he wasn;t supposed to be in the picture - which means the photographer took a picture of a minor on school property without consent - then yes, they could have left him out by not allowing him to be in.
Which was the only course of action they had any form of right or consent to take.”

“He was IN the picture. And he wasn't supposed to be. So they couldn't just "leave him out". The photographer was notified he wasn't supposed to be there. And the kid was in the front row. The PTA is the one who told him to put the smiley face there. Dumb move, but not meant to demean the child.”
