“Of course it's immoral and illegal. But, unfortunately, the way the rape laws and court systems are currently set up, in most of these cases a perpetrator CAN get away with rape.
Prosecutors are elected public officials and they have budgets provided by the taxpayers. They do NOT try cases they have an expectation of losing. Their doubt in these cases comes from the fact that they are unlikely to seat 12 jurors who will side with the victim. There will always be people -- like many of the posters here -- who maintain if the young woman doesn't want to get raped, she shouldn't have been drunk in a bar. In fact, in this case the victim DID commit the first illegality, drinking using a false ID. So to many people, that negates her right to safety. I'm NOT agreeing with that -- just stating what the reality is from the court's standpoint.
If you don't like it, as a voter you have a chance to change the laws. Let your legislators know you want rape laws with teeth in them. Let the prosecutor in your area know you object to business as usual.
Until there is a public outcry beyond the feminists -- such as myself -- who have been arguing for DECADES for stronger rape laws, it will be business as usual.”
