“It all hinges on the subjective intent of Hasan and his actions and has nothing to do with what a reasonable person would/could have expected Hasan to achieve with those actions.

Put more directly, if HASAN intended his actions to intimidate or coerce civilians (i.e., voters), if HASAN intended his actions to influence government policy in any way, or if HASAN intended to affect the conduct of government through the murders (or any combination of them), then it absolutely IS a case of terrorism.

That being said, we don't yet know what motivated him and what he intended and therefore cannot dismiss the possibility that his were terroristic acts.”

See 18 USC 2331*, the pertinent provisions of which are as follows:

"§ 2331. Definitions

As used in this chapter—

(5) the term “domestic terrorism” means activities that—

(A) involve acts dangerous to human life that are a violation of the criminal laws of the United States or of any State;

(B) appear to be intended—
(i) to intimidate or coerce a civilian population;
(ii) to influence the policy of a government by intimidation or coercion; or
(iii) to affect the conduct of a government by mass destruction, assassination, or kidnapping; and

(C) occur primarily within the territorial jurisdiction of the United States."

If the attack was intended to intimidate/coerce the government with respect to policy, then it is an act of terror without regard to whether the intended targets/victims are civilians or military personnel.”

B(ii)--It did not and will not not could it be reasonably expected to have an intimidating effect on the government's policies
B(iii)--Neither was it intended to have an effect on the Conduct of the government.

So.. it was mass murder not terrorism.­...Not particularly different that any civilian going "postal"”

If McConnell succeeds in delaying it by one day more (to 43), the number of those who will have died due to a lack of health care will EXCEED the number of military personnel who have died in the wars in Afghanistan and Iraq, combined (approx. 5302 and 5290, respectively).

In my home state of New Hampshire, RSA 630:1-b provides that "A person is guilty of murder in the second degree if ... he causes such death recklessly under circumstances manifesting an extreme indifference to the value of human life." Although the term 'causes' could be arguable, you can draw your own conclusions.”

- Is there a common thread to the accidents or are they very unfortunate events totally unrelated to each other?

- What time(s) of day did these accidents occur and in what kind of weather conditions?

- As two of the 3 accidents involved local law enforcement, how are the local personnel selected and what training do they receive?

- Did local law enforcement in NM fail to secure intersections along the motorcade route?

- What were the two Secret Service agents doing when they hit the pedestrian? Were they part of a VP motorcade or were they performing other duties? Were they even *on duty* at the time?”

“Sorry, but you are confusing civil suits with criminal prosecutions.

The Alien Tort Act (28 U.S.C. § 1350) specifically states, "The district courts shall have original jurisdiction of any civil action by an alien FOR A TORT ONLY, committed in violation of the law of nations or a treaty of the United States." [Emphasis added.]

A "tort" is an injury to person or property not arising out of a breach of contract, and is civil rather than criminal in nature and is compensable by the award of money damages. Almost always it's private parties that bring tort claims, and almost always it's the government that brings criminal charges. Different (i.e., lower) standards of proof obtain in civil matters as compared to the 'beyond a reasonable doubt' standard applied in criminal matters.

While the ATA can be used by the Pearls to sue KSM, it cannot be used by them to bring criminal charges against him.”
