“The Constitution was designed to have Supreme Court case law be part of the interpretation of law. That was designed in and if you actually read the writings of Madison, Jefferson, and Adams this would be absolutely clear by both intent and fact of implementation. You have to completely deny our form of government to support what you imply in your post. Please learn about our history and the law. We are a nation of law by design and implementation. The civil rights are federal law. These are increased for clarity and for implementation by both legislation, by the Supreme Court case outcomes. New amendments have happened rarely, but still have.

Again, case law is part of the design given by our Constitution in its division of power and the flexibility to interpret and deal with the conditions of the present. This was designed in and the Founding Fathers wrote about this intent.”

“Of course. However, I was posting not about the overall structure of the federal government, but about that which happens as part of the approval process for "legislation". Yes, after the approval process, the Supreme Court did approve the constitutionality of the ACA when it was challenged in court. However, once again, the legislation process for approval of "legislation" which is law is as I posted. That was the main point of my post as well as how it works as negotiation so the approval happens.

It never became law as originally drafted. At the encouragement of the Obama administration, the 111th Congress devoted much of its time to enacting reform of the United States' health care system. Known as the "House bill," HR 3962 was the House of Representative's chief legislative proposal during the health reform debate.
On December 24, 2009, the Senate passed an alternative health care bill, the Patient Protection and Affordable Care Act (H.R. 3590).[2] In 2010, the House abandoned its reform bill in favor of amending the Senate bill.

Again, please learn about how our form of government works. It is a divided government with two houses in the Congress, the House and the Senate. The third is the executive branch with the president. “The government spending is caught in an obstructionism hole created by the right wing Republicans in Congress. They do not want government to operate well. They want it to be failed so people will lose faith and confidence in government. The higher percentage of people that "vote", the further left the country moves and it votes Democratic by larger majority. The fewer percentage that vote, the more to the right the country moves. The Republicans work by hostility to government and making it a mess with obstructionism and attack on government programs that work well (e.g., Food Stamps, Social Security, Unemployment Insurance, Medicaid, Veterans benefits and health programs, Student education grants, and so forth. The ACA/ObamaCare will be added to this and it sends the Republicans into irrational stomps.).

Spending is helpful for infrastructure investment and in needed areas with "high turnover of money" in communities that are in need. Food Stamps for example are incredibly successful with a 1.7x turnover of money spent from government. Spend is almost immediate and brings "funds" into less rich and poorer communities. That money turns over so that one million spent is near 2 million dollars in a community, for example. Those areas of spend that sit as inventory for a long time (e.g., military high end equipment) have a very, very low turnover.”

The government system of described in the book "1984" is not here in the USA. President Obama was elected twice to the office of president by a majority of the popular vote and landslide in the electoral college vote.

A majority of people have benefited from ObamaCare legislation which regulates minimum health insurance products preventing refusal of insurance from pre-existing conditions, allows ones children to be part of group insurance if they are 26 or younger, it got rid of the medicare drug "donut" expense ceiling which was causing a crisis with seniors.

The legislation requires people to get health insurance or pay a tax. The legislation provides legal structure for state health insurance exchanges so commercial private insurance companies can offer insurance products that meet minimum standards on an easily accessible exhange tool or direct to consumers. Subsidies from government sources for those that are poor or disabled are offered in a form of discount for the insurance. For those that are poor, subsidies can cut insurance rates by half or ten times.”
