“All you have to do is read Sorkin's book "Too Big to Fail" and you will come to the conclusion that these ego centric Wall St. types think about nothing but themselves. If these bankers cannot triple revenue while slashing jobs, no deserving borrower will receive a nickle. If they are doing "Gods's" work, then we should put them on the unemployment line. There is nothing like a terrible swift sword to remedy this economy. Congress cannot do it. The President cannot do it. The courts must do it. I want all you Oliver Wendell Holmes judges to step up to the plate, and devise some new principles of equity to deal with the problem by judicial fiat. We need a Brown v Board of Education case to level the playing field.

Every once in a while, this right leaning current court surprises me. Latest one is Melendez-Diaz.

But as a civil rights advocate, & indigent defense provider's investigator in Oregon, I usually cringe at the thought of this court ruling on any matter connected with liberty.

I believe the prosecutor immunity should become qualified immunity as with police, but doubt have a hard time believing this court will be willing to open up that can of worms.”

“When David Brooks likes Obama, Obama is in trouble. I think he is in trouble. JFK was in trouble until he stopped listening to the centrists, the CIA, the FBI, and came out in favor of Civil Rights, which LBJ ran with losing the Southern bigots. Obama must show he is a man of principles even if he goes down in defeat on healthcare. If he takes the moral high ground and provides affordable healthcare to everyone and loses, he will campaign against a "do nothing Congress" as Truman did in 1948, and won. Then in 2010 he can pick and choose which Democrats to support and which ones go into a primary. He has to go to every Blue Dog and tell them "all or nothing at all." When he did not select Howard Dean as Secretary of Health. The Republicans are being the populists instead of the democrats. That is one friggin stupid mistake. There are no Wall St. Republicans, only Wall St. democrats. He turned over populism to the rural bigots. The Dems should be the tea baggers. The Dems should be the revolutionaries. He must put the torturers on trial and pillory Bush and his cronies.

Although most of us were unaware of how corporatist the new Administration would be, some of us had inklings.I noticed and did the math behind contributions that sent Obama to the White House, and I didn't like what I saw - but the alternative in the end was far worse than what we have now. Can anybody imagine having McCain/Palin at the helm today? The Supreme Court of the US overturned the Supreme Court of California where my friend Ron George presides as Chief Justice. California ruled that the California usury statute trumped South Dakota and federal regulations. In Smiley v Citibank, the Supreme Court of Bush, held that California usury laws must bend. Now all the banks are incorporating in South Dakota prairie dog country. To think that Bob Rubin sat on the Board of Citigroup is repulsive.

If it wasn't for the Smiley decision we would not be having this conversation.

“Erin and Joe do not have a clue about taxes except they don't wish to pay them. The tax code has been amended over and over again based on political and economic agendas. Obama seeks an amendment of the tax code for the same reason. Paying as little taxes as allowed (allowed) being the operative word, is encouraged. That is what Erin and Joe are talking about. They are both ditto heads on that issue with me as a ditto.Obama does not disagree with that policy, he just wishes to have Congress amend the Tax Code for his political and economic reasons.I am dito with that.

“The banks and finance companies do own the senate, democrats and republicans.Joe Biden voted the the 2005 Reform Act because of all the credit card companies located in Delaware. Each and every Democrat and the Administration should get behind the new bankruptcy bill, The 2005 Act should be repealed. Individual homeowners whose principal residence is under water are entitled to the Chapter 11 "cram down". What is good for GM is good for us working stiffs who got screwed by greed and fraud in the banking system. Private student loans should be dischargeable. Interest rates should be limited to 10%. Executory contracts should be rejected. If the unions can get busted by GM in BK, the banks should get busted by the working stiff who got shafted.

If we let these crimes of torture go unprosecuted, there will no longer be a restraint on how far a President may proceed in what he perceives to be rightous even though it is clearly wrong under US criminal law and the Treaties we have signed. The Constitution clearly states that a Treaty that has been signed by the President and confirmed by 2/3rds of the Senate has the force of law and is the "Supreme Law of the Land"

Nixon thought he was above the law and the Supreme Court thought otherwise. If Obama pushes these violations under the rug he will and should be prosecuted for compounding a felony. Where is the steel in his backbone?

“I believe he has said that the decision is for the Justice Department and AG Holder who has said he "would follow the law". You know, as well as anyone, that this is a matter for an INDEPENDENT Justice Department and that the AG is bound by law to investigate and prosecute if wrongdoing is found.

Summers and Geithner can't sell diddley squat. They and Rubin are the guys who got us into this derivative crap and crap its is. AIG unit in London should be put into Chapter 11 so that all of these insurance contracts can be rejected. If some of the big boys fail then let them fail. Citi should fail. GM should go into Chapter 11 as well. We need one big Chapter 11 for everyone. Flatten everyone. We will recover so long as the people know and believe that there are no favorites. The people want blood and a catharsis.

Let the Senate and the House carry the ball on the investigative process. If the big boys don't honor subpoenas then let Eric jail them until they testify. If jail is good for Judith Miller for contempt then jail everyone who refuses the subpeonas.

“You are absolutely correct. Obama hired Clinton staffers and Wall St. bankers as his advisors. Obama must "pull the trigger" and convince Congress to follow your advice. I just wrote another letter to Senator Boxer (before I read your article) giving her the same suggestions. Bite the bullet and take over the "zombies".

As Tom Friedman wrote, we will go through a generation changing transformation. Transformation is good, greed is bad. Obama must walk the walk and stop talking the talk. The editor of the Financial Times on the Charlie Rose show tonight just stated the same. Remember that Neall Ferguson was at Davos and talked the talk as you and I have talked the talk. But only Obama and Congress can walk the walk.

“I viewed an interview of Niall Ferguson on CNBC the other evening at 3:30 AM PST. After listening to his comments I could not go to sleep until 5:00 AM that morning to wake up at 9:00 AM to watch CNBC and MSNBC on the economy. He then reiterated the use of money in society all the way up to present day, discussing CDOs and CRDS, both "naked and clothed" and how our toxic assets were spread around the world since these securities were improperly rated as triple AAA by S&P, Moodys, since they were insured by AMBAC et al. All the banks in the world bought this "stuff" filled with "sub primes" including the most reputable banks in the world Last night I watched the Charlie Rose show who interviewed a panel consisting of Martin Feldstein (the Reagan era economist), Senator Shumer, Welsh the former CEO of GE, and a NY Times reporter. What was so amazing to this poster is that no one had a solution to this crisis. Feldstein, the conservative economist stated we needed government intervention as "a last resort". His tax cut comments were very cogent, namely using tax methodolgy to create demand now, such as investment tax credits for business, rebates to buyers of American cars made in the USA, etc. Welsh held his nose about "bonuses". Imagine that!!!

“Banks should assume the same posture that we expect our politicians to take; public servants. We are not here for them, they are here for us.

We need to roll back all of the liberties we have given to banks, savings and loans, and all other lending institutions over the years. Banks can no longer be part of the free market.

1. Bank employees should make about what government workers make. No bonus, no commission.

2. The amount banks earn on interest should be restricted to about 4% and they should pay out no more than 3%.

3. The purpose of a bank should be similar to the role of government. Government does not exist to make money but it exists to help John Q public and the business climate do well.

4. Credit Card companies should fall under the same restrictions as banks. There should be no interest rates above about 3% for credit card companies. no repackaging debt. no changing terms and conditions - ever.

5. Lending institutions and wall street should not be telling the attorney general what they are going to do, just the opposite. The attorney general tells the banks what they are going to do, how money will be lent.

6. Adjustable rate mortgages are illegal.

7. The Federal Reserve really should be part of the government that way money that is earned by the banks stays in this country and in our system which can be and must be loaned out again.”
