Hardcore evidence, mainly the burns, proved the coffee was to hot.  What I'm trying to tell you is THERE IS NO EVIDENCE against the manufacturer in these types of cases.  Without evidence there is no case and its a waste of taxpayer dollars.  Was the gun defective? No, Did the manufacturer obey the law with making and distributing the gun? Yes.  Where is the crime that the manufacturer committed?  It's quite obvious you are completely ok with court backups, and higher taxes to pay for more workers and cannot grasp the concept that the shooters are the ones who are in all shapes and forms, responsible for the crimes committed by the guns they steal or obtain illegally. ”

“The purpose of a lawsuit is to gain money.  Laws are not enacted through lawsuits.  To suggest to a court that having someone pay you a huge amount of money to replace your dead child is pretty greedy and is only passing the blame from one person to another.  If they want change, they should be using this opportunity to push it with their representatives, senators and with the media. Once a manufacturer has lawfully passed the gun on to the seller, it becomes the seller's responsiblilty and the government's responsibility to make sure the laws are followed.  I personally believe that gun shows and private sales should be more regulated but then again, that responsiblity lies with the government.   ”

But my family has pushed for 15 years to get legislative change after my step brother was shot and it hasn't worked because we don't have the money that the gun manufacturers/NRA have. Power=money in the political system, and to deprive manufacturers of money is one way to shift the power balance. Money in politics is, as always, at the core of this problem. I think that families going after the companies financially is more effective, and I say this after 15 years of frustration in trying to do as you suggest. ”

“Coffee should not produce a severe burn, in this case, the lady had a severe burn because of it.  No one had to decide if the coffee was too hot because it was proven to be to hot.  You cannot not prove a manufacturer is responsible for a person going off the deep end, stealing a gun and shooting some place up.  That part of your point is still invalid.  As for the court deciding, the law was put in place do to the extreme amount of frivolous lawsuits ALREADY thrown out and in court against the gun manufacturers for things they had no control over.  IF indeed it was a issue of defectiveness such as with the coffee, the court WOULD hear the case.  Manufacturers do not have absolute immunity as the title of the article suggests.”

“I sincerely doubt your statistics there.  Owning a gun does not make you a nut, nor is every single American tired of gun ownership.  Responsible owners are also upset over the lack of reasonable gun laws.  Why was a person who had a son with such issues even allowed to purchase a gun?  Because no one talks about keeping guns away from the mentally ill.   Tossing around made up statistics does nothing to help your anti-gun bid other then making those who are responsible wary of your efforts to disamantle the second amendment.  And yeah the second amendment says the state shall not infringe on the right to bear arms....infringe includes extreme taxation to make it difficult for law abiding citizens to own a gun. ”

“She got 200k or so a year from the ex....she also seemed a bit parnoid to have so many weapons and yet not keep them locked up around her son. Mostly likely she would have paid the insurance and this still would have happened. Only difference is the poor country folk who use guns to hunt (yes people still do that and yes they do use that meat to offset high meat prices) would not be able to afford their extremely high cost insurance and thus not able to have guns. Guns they only would have used legally, for a time honored father and son tradition of hunting.”

“The three wheel ATV lawsuits were based on design error. While some were able to drive the ATV's with out any issues, others who used the ATV's the way the manufacturer claimed it could be used, ended up seriously injured or dead. Therefore the lawsuits against the three wheel ATV manufacturer were legit while the ones against gun manufacturers was not. Guns do just as they are advertised too. Any problems because of them are strictly user error not a manufacturing issue. As for automatic weapons, they are legal in many areas, if the US passes laws banning them, and manufacturers make them, then and only then should they be libel.”

If a gun is bought legally from a manufacturer, is not defective and it causes harm due to the negligence of the purchaser, only the purchaser should be allowed to be sued. Now if it's discovered that a gunshop illegally sold a weapon without the proper checks, then yeah the gunshop should be libel. If the manufacturer sold the guns to a shady shop without the proper documentation or if the weapon causes harm because it is defective THEN you would sue the manufacturer. Its common sense. To expect to go after the manufacturer when they have done nothing wrong, is a simple tactic to attempt for a larger payday. Who's greedy now?”

“Well something was going on with him but without a mental evaluation on him while he was living who's to say for sure what it was. He was at the right age for schizophrenia to show up, as early twenties is typical. To bad he was labeled a "nerd" and not given the help he needs as far as we know. It might have saved some innocent people.”
