“Lest we lose track of what "dark money" means, both Democratic and Republican corporations and individuals are donating money to 501(c)(4) "charities" that are not required to identify their donors. By law, 501(c)(4)organizations are supposed to use that money "exclusively" for non-political “social welfare” purposes, although in the 1950s IRS regulations interpreted the word "exclusively" to mean "primarily" – a term that has been drained of meaning, since many dark money organizations appear to use practically all of their funds for political purposes.

On July 10, 2013, 16 members of Congress wrote to Secretary Lew to urge the IRS to discard the “primary purpose” standard and to permit 501(c)(4) organizations to devote only a “de minimus or insubstantial amount of work outside of its social welfare mission” – that is, to enforce the law as written, not as mistakenly interpreted by IRS regulations.

President Obama and the IRS should enforce the law as written by Congress while also defining “social welfare” to prevent abuse. Even though such changes wouldn't prevent the Koch brothers and other wealthy donors from funding political campaigns and attack ads, light would be cast on the donors behind such political activities. We could follow the money.”
