“Their is no such thing as rights without input from all of society. Courts do not have the authority to make up rights as they see fit. All rights come from society. Not the courts. And rights do not exist in a vacuum. They are decided upon by society. Not the courts.”

“This society already wrote into it's highest law that all citizens must be given equal protection. Since marriage was declared to be a civil right by the supreme court, then it needs to be available regardless of race, gender, ableness, or sexual orientation. You don't have to like it. You're just not allowed to right your bigotries into civil law. If you have a problem with that, then I think Iran might be more to your liking.”

“And whether you like it or not, you always will be held accountable for your own choices. And people will always have a say in the society in which they want to live. Try working on your reading comprehension. I never said government was not involved with marriage. I said they had no business being INVOLVED in marriage. get back to mje when you figure out the difference.”

“WRONG. The whole basis of the gay movement's argument is based on "feelings" such as "love". You do not get to pick which group of peoples feelings are more valid than any others. The point being made is that "feelings" do not necessarily have anything to do with the discussion. The idea that your feelings are more valid than someone elses is what is bogus. Incest and polygamy absolutely are relevant to the discussion. Those groups have feelings and they believe they were "born that way". So to make the argument that you are somehow special and that we should ignore all other groups making equivalent claims is absurd. If you want to make your case then you must accept the case of others making equivalent claims.”

“Very simple. No one said anything about the word love. What we have said is that gays do not have the right to change the definition of marriage for everyone else. Secondly, the government absolutely has NO right to be involved in marriage whatsoever.”
abbeyroad replied on Dec 22, 2009 at 01:37:00
“That was an EXTREMELY WEAK explaination.
Marriage is about LOVE. The love and commitment between 2 people.
And here's a news flash for you: The government is VERY involved in marriage.
You have to go to COURT to dissolve a marriage, remember ?
Whether you like it or not, gays and lesbians are NEVER, EVER going away.
No one will EVER be able to stop it.
It's only going to be more and more accepted by each new generation
WHETHER YOU LIKE IT OR NOT.”

“You have equal protection. You have the exact same constitutional rights that I have. You can vote, you can own property, you have freedom of speech, you have freedom of the press, and all the others. Marriage is not a constitutional right. There is not one single constitutional right that exists in which I need permission from the government. To be married in my state I must have approval from the government and I must purchase a permit. Also in my state, the law specifically states that marriage is between a man and a woman. Therefor equal protection applies to the law as it is written in the constitution. Not what you want it to be.”
RainbowPhoenix replied on Dec 22, 2009 at 12:50:06
“Loving v Virginia identifies marriage as one of the fundamental rights of man.
The fourteenth amendment requires that all citizens be given equal protection. Equal treatment does not count when the results are very different for different groups.
The ninth amendment states that a right doesn't have to be spelled out in the constitution in order to exist.
So no, I do not have equal protection as of writing this.”

“Actually you are wrong. Regardless of what rationale the state tries to use, it boils down to the fact that the state is telling a group of people that they can not marry if they choose. You do not get to pick and choose what is moral. You assume that because you are in favor of gay marriage that the state has no rational interest. That's your opinion. Morals can only come from one of two places. They either come from God, which I doubt you believe, or they come from man. If they come from God then man does not get the option to over rule them. If they come from man, then it is man that gets to decide what is and is not moral. And that means ALL of man. In other words, if morals come from society, then it is ALL of society that gets to decide what is or is not moral. Not just the minority. You don't get to decide what is moral simply because it serves your own interests. It is an issue for all of society to decide.”
RainbowPhoenix replied on Dec 21, 2009 at 23:45:48
“In this constitutional republic, morality is irrelevant. All that matters is that the constitution requires equal protection for everyone. Not equal protection for whoever the majority thinks deserves it.”

“Gays have the same marriage rights. They have the EXACT same right to marry someone of the opposite sex that anyone else has. The current laws do not state that marriage is between two consenting adults. If it did then gays would have an argument. But it doesn't. The law states that marriage is between a man and a woman. Just because you don't like that definition does not mean any discrimination is taking place.”
