“Nope and it doesn't make your burnt-toast contrapositive any less half-baked... No one is talking about forcing businesses to close. Just because the constitution doesn't specifically enumerate pay to play, its application and reach is fairly well-settled precedent when it comes to the federal government and inter-state commerce... which leaves me wondering... was there a point to your post?”

“You are absolutely correct, eljay.  The collective responsibility of consumers is the crux of the issue here and if that's all you were pointing out, I am with you.  To any extent you are somehow implying that consumer/employment regulation isn't a proper government function, I am not.”

“Corporations are amoral. They are neither evil nor good but capable of both. No employee is made more free by being paid less. Whatever notion you have of "consumer freedom" is unconstitutional and rather perverse.”

“Asking a business to pay its employees ten dollars a more per hour to operate on a federal holiday oppresses who exactly and why do you think that this is somehow beyond the reach of a century's worth of well-settled common law?”

“If only we could govern with the platitudinous logic of a Hallmark card.”

eljay on Nov 21, 2013 at 17:27:10

“It's not a platitude, it really is that simple. This article acts as if people are being involuntarily ripped from their families on Thanksgiving because they're incapable of resisting a deal on a flat screen television. If more people placed a higher value on home and family rather than heeding the call of advertisers to "consume, consume, consume!!" then it wouldn't be worth it for retailers to be open nationally recognized holidays. Since when could you ever expect a massive corporation to dictate ethics anyway? Here's how you solve the problem: Don't shop this Thanksgiving. Don't shop next Thanksgiving. Keep doing it until retailers get the message. They don't understand anything that doesn't effect their bottom line.”

“Give it a rest... Corporate freedom is a clunky legal construct about as outdated and useful as the blowhards that come here to champion it.”

“Actually, I was referring to consumer freedom and employee freedom, but you have drank so much of the liberal "corporations are evil" kool-aid that you couldn't even see that point.  When you wake up someday and you have no freedoms left, then you will know what I was talking about.  Happy shopping.”

“Forget Thanksgiving... I'm a fan of the more gleefully absurd Labor Day. How is it that the one day in this country that should be devoted solely to the working stiffs and wage laborers turns into a day where bosses and managers shop for cars?”

“No one is talking about the right to shop or telling you how to observe the holidays and your trying to make this some sort of constitutional issue doesn't make it so. I'm glad you brought it up though because it is important to note that wage and hour regulation is a legitimate government function as can be seen repeatedly throughout constitutional jurisprudence. But feel free to keep on hitting your head against that wall... It's definitely having an effect on the pink elephants.”

“Because it's the right thing to do. Sorry pal, but freedom has exactly jack to do with it... You have no constitutional right to shop on Black Friday.”

Greg Smee on Nov 21, 2013 at 18:30:26

“Ahhh . . . the age-old strict interpretation vs. loose . . The Constitution doesn't specifically enumerate many things that people might consider freedoms. Are you implying that, because the Constitution doesn't grant citizens the right to open the doors of their business on a particular date, that therefore they could be forced to close?”

5ilver on Nov 21, 2013 at 16:37:23

“So you are being forced to shop?”

To be sure, Big Ed has its lobby but you should probably look to the privatization folks to see where that dirty money is really going.”

“You clearly didn't heed Bill Maher's new rule on 'just sayin''. I'll give you a pass on that but still feel compelled to point out that there was and is no link between the executive branch and the tired IRS scandal. In fact, I seem to remember reading that the dude most-responsible was a Bush hold-over with pretty shady motives. Moreover, gotta think given everything going on now with the TP and the debt-ceiling business that a little extra oversight might have been warranted for those guys.

Not to mention that clearly liberal organizations were also audited at the same rate, the IRS was well-within its statutory authority to selectively audit given the circumstances regardless, and the administration has been thoroughly exonerated of any wrongdoing. Finally, I would venture a guess that had these new TP groups actually been as heavily/unfairly audited and scrutinized as media coverage suggested, we might not be in this current predicament... Just saying.”

“Here's a clue: Correlation is not the same as causation. Don't feel bad, it's one of the most common lapses in day-to-day critical thinking. If 40% of traffic fatalities involve drivers under the influence, then, by your logic, we should stop letting sober folks drive.

My time is measured in 6 minute increments and even the most basic concepts in logic take time to lay out. Read: Please don't respond with something inane.”

I dunno, just a crazy thought but isn't it at least possible that law enforcement in blue states is more inclined to investigate and prosecute hate crimes than red state counterparts? It's not like there are any DA's in Alabama and Texas that don't believe in hate crimes, amirite?”
