The idea that a corporation is a "legal person" goes back at least as far back as Roman law, and remember that the publicly-traded, joint-stock corporations is only one kind of corporation: There are also unions, non-profits, incorporated municipalities, etc., etc. That doctrine is not the problem. I think what you have in mind is the doctrine that legal persons have all the same rights under the 14th Amendment as natural persons. That is the problem. It goes back to a Supreme Court decision not almost 40 years ago but almost 124 years ago, Santa Clara County vs Southern Pacific RR.
