A "free market" is not some naturally emergent property of competitive beings in the absence of government "interference." It's a highly structured and historically grounded set of institutions, practices, and mores, including governmental ones. It always strikes me that free market fantasists operate on the unspoken assumption that a free market is a condition that would naturally emerge if only we would let it, if only "government" would "get out of the way.' That is just nowhere near close to an accurate understanding of the nature and variety of markets.”

“What Congress gives, it can take away. Congress gave us the McCarran-Ferguson Act of 1946, and Congress can repeal or amend the same.
Intentionally or not, Congress did erode that act with passage of the Employee Retirement Income Security Act of 1974 (ERISA). It was primarily an act to protect pension funds, but it also covers health plans when they are a part of an employee benefit package.
COBRA and HIPPA have made significant amendments to the act, but ERISA lacks regulatory teeth for the health insurance part otherwise.
