End Judicial Selection by Election

“Not only should the election process continue for state judges but that same practice should be applied to our own Supreme Court. Our Supreme Court judges do not reflect the people of this country, the reflect the views of the President who got the most strategic appointments.

The lifetime appointments of the SC Judges should cease. We are not getting better justice because of lifetime appointments. What we have ended up with is a smaller representation of Congress with every issue getting decided on party lines.”

Nor should they. It is not the job of a judge to reflect the "will of the people". If that were the case, Gitmo prisoners would still be being tortured and interracial marriage would still be banned. It is the job of a judge to apply the law to the case at hand (mutatis mutandis, obviously), not to enforce the popular will or even (as Scalia once argued) to protect the people; just to apply the law.

Quite apart from which, the doctrine of stare decisis means that the decision rendered by a court is often dictated by precedent. That was the basis of the Ricci case that caused Justice Sotomayor such problems.

Now, if you'd like to discuss whether lifetime appointments are a good thing, that's a different issue and we could have a good discussion there.”

“sherbug - Can you envision Supreme Court candidates running around the country giving speeches, taking campaign contributions, doing TV ads, knocking their opponents, etc. I agree that the appointments are the prerogative of the President, but they go through such a thorough investigative and vetting process followed by Senate hearings, that we can be assured of the experience, integrity and qualifications of the nominee. We may not like their judicial philosophy, but that has a way of balancing out over the years. As to life or fixed terms, that is a subject worthy of continued debate. See reply to dcnola...”

“First your analogy of Judas and Obama is offensive. Obama made promises during the campaign as does each and every politician. However, no President has had his feet held to the fire as firmly as Obama has had his held on campaign promises.

Clinton and G.W. Bush made campaign promises and gave inaugural speeches full of high ideals and a message of fairness for all and a chance for all.

Did everyone get a fair shake or a chance? Or did things just continue to get better for the rich and worse for the poor? Did we get health care from Clinton and did we get a fiscal conservative from Bush?

What makes you so angry with Obama is because Obama got to you. He got to you with his soaring speeches and rhetoric and he made you believe in this country again. He spoke of unity and transparency and fairness, all the things you were hungry for from the past 8 years under Bush. Now that you realize Obama cannot deliver the unity, transparency and fairness in a neat little package, you want to pair him with Judas.

So the next time you want to sit down to pen one of these snarky Op-Eds, please realize that you are coming from a place of hurt. And a person who is lashing out because they are hurt is just trying to hurt back.”

He just wrote about what he observed--in his opinion (Op-Ed remember?). I for one agree with his observations. The sound of cans being kicked down the road is deafening.

So those who have been "PT Barnum'ed" should shut up and take it like Rahm wants you to take it. You sucked for it. To bad, so sad.

Obama, Palin or whoever would still face the same Congress owned by corporate oligarchs and the corporate power structure that is strangling this country.

Palin would face the same problems Obama faces. Palin like Obama would be a new comer to the Washington scene. She has no friends, no connections, no favors owed and no favors done.

She would, just like Obama, have to surround herself with Washington insiders if she wanted to even know what was going on. If she surrounded herself with Washington outsiders then she would have a hard time functioning.

They all say they are different. Name one politician that has gotten up to run and does not say that he/she is different. You are angry at Obama because he got you. He got you with his soaring speeches and rhetoric and he made you believe. You are angry with him the same way we were angry at the Balloon Boy Family. You feel played and you don't like feeling that way.

They have all sold us out. Regan did a masterful job of turning our country over to Big Business and Clinton did a number on our trade agreements that we are still under today. Bush sold us a bill of goods called the Iraq war all for profit to his richy rich cronies.

We didn't complain when he missed the State of the Black Union. Instead we sent death threats to Tavis and his mother because he called Obama out.

Now when we complain about Obama, he tells us that he can't be the President for us, but has to be the the President of all people. We understand that, but we are complaining that he is not addressing any issues of the working people, which would include us.”

I was not angry that he did not appear at the State of the Black Union Address, was happy he didn't . The State of the Union only serves to prove the point Obama is making. Stop talking about it and do something. Every year the conversation is the same, black leaders meet and stand on stage trying too see who gets more applause and who can give the best comeback. Then they leave and impliment nothing. IF you want the black communites issues addressed then come up with a plan, an agenda, cost etc and present it to the President. “Obama is ignoring the black community because that's the way we started off with him and that's the way we will end up with him or we will get into a fight.

We started off wanting Obama to be black but not really from black. We were afraid that if he came too close to us that white people wouldn't like him and we needed some of them to get him elected. We made excuses for him when Tavis called him out on not attending the State of the Black Union. And we made excuses for him when he didn't attend the MLK 40th memorial. So we allowed him to stay his distance and not pay any particular attention to the black community.

Now some have changed their minds and want him to pay attention. But Obama always reminds us that the deal we made was for him to stay his distance. If we want to change the deal, we must fight. The fight seems to be on, starting this past week when more and more blacks are becoming vocal in their criticism of him.

Hopefully he will answer the call not only to blacks but to everyone that he made promises to.”

What many fail to see that over half of the CBC was for Hillary Clinton and thought Obama should wait his turn in line perhaps behind some of them. When HIllary did not receive the support they assume she would (people like Tavis Smiley) they then came on board with Obama. There was division with Obama in the leading blacks long before he took office and some of these same people who have been in office, who have done little more then hold press conferences, state of the union address and dinners have stilled not back this man as President.

Where were these people when attacks were made against him as to his citizenship, where was the CBC's press conference when his life was being threaten at townhall meetings? Where were Smiley, Jackson, Walters the DEMOCRATIC & PROGRESSIVE PARTIES which are still missing in action on every issue he tries to push. “I echo PATina sentiment. I was listening to Black Talk Radio yesterday and the topic was health care and what blacks thought about it.

So many comments from blacks were in essence saying they believed in the President and if this is the best we could get then that's it. In short, there was very little criticism and a lot of blind acceptance for anything this "man" does.

As an AA I was as happy and emotional as anyone when Obama won the Presidency. I didn't expect him to just address black issues, but I did expect him to address working class issues. So far, he has addressed the issues of the rich and powerful.

This health care Bill that he claims is the best thing since sliced bread is an expensive turkey. If it was good for working class people then health insurance stocks would have plummeted instead of skyrocketing.

Blacks first need to stop being so romantic about this President and watch what he does. We must forget that he is black and look at him as any other politician. Obama got elected because the entire black community put out weight behind him. He would not have won without the black vote.

Obama can be cavalier about the black issues if he wants, but if he does he may find a lot of blacks will stay home in 2012.”

“Wow, your insight is amazing. How did you guess that I was a Republican. Well let me give you a tip. Don't give up your day job because being a mind reader is not going to work out for you. As it happens I am a progressive and an Obama supporter from day one. I donated, made calls and knocked on doors and volunteered at voter registration booths in the state of Georgia.

However, that does not make me blind and crazy and Obama is not living up to his promises and his base is eroding. I am not shooting at the wrong target when my President who said he would lower prescription drug costs cuts a back room deal with the pharmaceutical companies. I am not going to applaud him when he praises a Bill that only sells millions of Americans into slavery to the insurance companies and forces us to consume their products with no cost controls.

If you have a job that subsidizes your health insurance then you wouldn't understand the frustration of those who have no insurance. If you have no insurance yourself, then I don't see how you can be OK with this Bill.

And for your FYI, I don't have a script. I take each day as it comes and I form my own opinions based on my own research.”

“You are delusional. You say Obama's behavior is superficial? He personally saw to it that we paid more for drugs than other countries? When you have medications that are costing $300.00 for a month's supply and you could get the same medication for $80.00 for month's supply from another country, that is not superficial.

As for complaining to my Reps. I live in a red state and all my Reps are Republicans, so there is no use in me calling their offices.

Healthcare was Obama's Bill. He wanted it and it was up to him to lay out the framework for the Congress to work within. The framework he gave Congress was so vague and in spite of their pleas for Obama to get into the fight, he opted to supervise from on high and take a hands off role. His only mandate was to pass a Bill, any Bill.

Obama is a nice guy and he makes a great speech and I personally like him very much. He is just not a great leader and a lousy negotiator.”

“I'll tell you how. He came out of the gate with single payer off the table. He cut deals with the pharmaceutical companies early in the game and that stopped the import of cheaper drugs from other countries. He was against mandates but we still have a mandate in this Bill.

He said he was in favor of the public option, but the public option was optional. When Liebermann threatened to filibuster, the President told Rahm to cut the deal with him and get rid of Medicare buy in. Nelson threatened to filibuster and the President again tells Reid to cut the deal and Nelson gets an upgrade to his state's health care system.

Obama did not stand up to the insurance companies or to the obstructionists or to any one. The only pressure he applied was concessions and appeasements at the expense of the people of this country.”

As the article states he came out of the gate making concessions. He stood right in our faces last year and said he was against mandates. He also said he would always tell us the truth, but he has not even done that. He has just left us to wonder what happened to the man we elected.

I can't tell you how disappointed I am, but I can no longer make excuses for him. Its not that he's not liberal enough its that he's not strong enough to lead.

“It is one thing to sit and fantasize about a third party, but the truth of the matter is our democracy is gone. Even if there was one person who believed in a democratic society, this person would still face the Congress who is bought and paid for by the corporate oligarchs.

Campaign financing is already before the SCOTUS. That will allow profit and non profit organizations to spend up to 1% of revenue on the candidate of their choice.”

“I can only shake my head with disgust. What needs to be transparent are the deals cut between our representatives and the lobbyists.

We know how much money each one gets from insurance companies, but what we want are transcripts of the deals made. We have a right to know.

Obama promised us transparency and all the deals broadcasts on CSPAN. Not only do we not have deals broadcast, we have Obama himself back door dealing with the pharmaceutical companies.

Forget about insurers publishing some scrubbed numbers that show how good they are treating us, I want to hear the squirmy little deals that they make with our elected officials.”

“Then, Mr. Reich, how is it still just worth the effort? You did not make your case.

Sure, they cannot deny pre-existing conditions but that won't kick in until 2013 or 2014. Don't you think that insurers will be working over the next 3 years to beat down any changes to their existing business model. All they want is a guaranteed customer base and access to the subsidy pot.

They don't want anybody 55-64 to be able to side step them and buy into Medicare. They want all healthy people in that age group so that they can triple the premiums on these people.

Mr. Reich, why do politicians think that the public becomes blind and crazy when it comes to these legislative matters. Even you are trying to snow us into believing that this Bill is worth the $800B price tag.

This Bill should die. Leave things the way they are and let people scuffle for health insurance the best they can.

“I'm afraid this post is true. There is already talk of a Primary Challenge and the chorus will only grow louder after the 2010 elections.

But who would challenge him? We don't want a repeat of 1980 where we send a weakened candidate into the general election.

Many have posted here they don't want another Clinton in the WH, but Hillary is just about the only person we have who could win in a General Election against Romney or Palin.

We need to come to grips with some realities and that is Obama cannot win in 2012 and either we turn the WH over to the Republicans or we put another Clinton in the WH.”

When he speaks he is always humble and appreciative, never haughty and condescending. He has not run the WH as a go it alone, I know everything kind of guy, but has sought out the advice of varied number of people, even to the point of being called a ditherer.

He has opened the WH and has been a gracious host for all sorts of occasions.

As far as his policies are concerned, then I do think he is moving to the right, but he has never been someone who looked down on anyone. That is something that is internal to you.”

Whether your lib or repub he doesn't care... he's already had his words in one of his "non fact-checked" books... he will side with his muslims brother and sisters if it came down to it.”
