Empathy be damned, I'm a republican!”

“Nobody said the USA was responsible for slavery. But for a long time, this country fully participated in it. In your mind slavery may have ended a long time ago. But in light of how old this country is. It hasn't been that long ago. You don't mention the contributions of blacks because you consider this a so called, "required performance". What the hell does that mean anyway? Yet because some blacks are great at singing and playing sports. Then that's considered greater accomplishment in your book, than overcoming almost 300 years of being slaves. That's some twisted logic you have there. You're not aware of how many blacks have been awarded medals in war or for being more than just responsible citizens because as far as your concerned that's a part of "required performance". Again. Whatever that means! And you've only been listening to them sing, or watch them play sports. Because it seems as far as you're concerned. That's all they're good at anyway.”

“What difference does it make where it originated? It was still a inhumane practice. Especially in a country that at the time that was supposed to be a democracy. It was a way of life for a lot of people in this country for 300 years.
And the next time you use an example of how far blacks have come in this country. Don't just use the names of entertainers and sports figures that you like. Use the names of black people that were war heroes, that participated in our political system. Some that became business owners and others that participated in all other parts of American life. There are many.”

klemon0320 on Dec 5, 2013 at 17:45:15

“The difference it makes is that I get tired of hearing people blame the USA for something that didn't start here and ended long ago. We have come a long way and still have a long way to go, but it will happen faster if you get that chip off your shoulder and stop being sensitive about being black. I can't do anything about my skin color and I can't do anything about yours either. We can't move forward if we keep looking backward.

I don't mention what I consider to be "required performance". I am not aware of any black war heroes that did anything that I would not have expected from a person of any race in the military service of my country. I do not know how many blacks have been awarded the CMH. As far as political service, I have a rather low opinion of most politicians of any race. Business owners? Well, people of all races are expected to earn a liviing. Of cource they participated. They are expected to participate. I singled out people whose contribution I thought was special the others are just average joes just like me.”

“Racism does exist in all races. But when one race has political and economic power over a particular race or races. The racism becomes institutionalized. Such as using slavery as an industry.”

klemon0320 on Dec 4, 2013 at 22:19:03

“We both know what slavery was, and we both know that slavery no longer exists in this country. Although the United States of America was guilty of participating in the institution of slavery, it was not our invention. It existed before there was a USA, It existed before there were colonies on this continent. We are all left with the mess to try to clean up. I know we have a long way to go, but we have made progress. In my life time, Blacks have been integrated into professional sports. Who could imagine sports without the black superstars of today? Who could imagine music without the contribution made by blacks? Little by little the black race is taking it's rightful place as an equal. Although slavery was an ugly thing, I think it would have been terrible if Michael Jordan had been born in Africa, or Ray Charles, or thousands of others. I thank God they were born here, but it's sad how they came to be born here.”

“If you're going to put this solely in legal terms. Then I guess all employees at WalMart should just stand by, or call security and wait until they get there to solve the matter. Here's a hypothetical for you. What if one of the people getting assaulted on WalMart property is the manager of the store or even another WalMart employee? Should that employee just call someone or intervene? Also. What WalMart does in other areas may be irrelevant to a discussion of liability. But it also points to how little WalMart thinks of it's employees. To fire someone for helping one of their customers? Come on now.”

msbeal on Oct 20, 2013 at 01:20:08

“We not discussing what people SHOULD do.  We're discussing what is an employer's legal liability for the unauthorized actions of their employees.  They can go out there and play hero but Wall Mart has the right to dismiss someone for not following company policy, assuming it's well published.   What if it were a grandpa and grandma grocery store and some minimum wage late night clerk goes outside and tackles a suspected shoplifter by mistake, against the store's policy, and racks up a million in medical bills.  Should grandpa and grandma lose their store and their entire life savings because of this?”

“You're talking about a multibillion dollar company that takes out insurance policies on it's employees without them even knowing it.
Also. So the employees are supposed to just stand by or just walk away if they see a WalMart customer being assaulted on WalMart property? Really?”

msbeal on Oct 18, 2013 at 17:40:02

“I'm not defending Wall Mart per se. You tell me the answer. Is Wall Mart liable for the actions of their employees who assumes a role they're neither trained, equipped or required to handle?

What if that employee got killed or that woman. Would Wall Mart be liable for those deaths? I believe there is a line that when people cross it, they're on their own time and no one is liable for their actions except that person.

What if an employee walked out back and committed suicide, or mugged someone and there was no evidence that Wall Mart could have predicted this behavior in this person?

Wall Mart could have some contributory negligence in this matter - poor lighting, poor customer security, etc.

BTW, what Wall Mart does in other areas is irrelevant to this discussion of liability. Also, I suspect store policy is to contact the security personnel immediately.”
