It existed before there was a USA, It existed before there were colonies on this continent. We are all left with the mess to try to clean up. They can go out there and play hero but Wall Mart has the right to dismiss someone for not following company policy, assuming it's well published. What if it were a grandpa and grandma grocery store and some minimum wage late night clerk goes outside and tackles a suspected shoplifter by mistake, against the store's policy, and racks up a million in medical bills. Should grandpa and grandma lose their store and their entire life savings because of this?”

“I'm not defending Wall Mart per se. You tell me the answer. Is Wall Mart liable for the actions of their employees who assumes a role they're neither trained, equipped or required to handle?
What if that employee got killed or that woman. Would Wall Mart be liable for those deaths? I believe there is a line that when people cross it, they're on their own time and no one is liable for their actions except that person.
What if an employee walked out back and committed suicide, or mugged someone and there was no evidence that Wall Mart could have predicted this behavior in this person?
Wall Mart could have some contributory negligence in this matter - poor lighting, poor customer security, etc.
BTW, what Wall Mart does in other areas is irrelevant to this discussion of liability. Also, I suspect store policy is to contact the security personnel immediately.”
