No Ninth Circuit En Banc Review for Josh Wolf

Josh Wolf, the freelance videographer who has refused to turn over unpublished tapes of a San Francisco anarchist demonstration to the federal government, drew a bad panel in his appeal, but he will get no relief from the other Ninth Circuit judges either. This leaves the Supreme Court, not a happy prospect for Mr Wolf.

The motion of the ACLU to file an amicus brief ISO appellant's petition for rehearing en banc is granted. The panel has voted to deny the petition for panel rehearing. The full court has been advised of the petition for rehearing en banc and no judge has requested a vote on whether to rehear the matter en banc. (See Fed. R.App.P.35) The petition for panel rehearing and the petition for rehearing en banc are denied. The motion to reinstate bail is denied as moot. No further filings shall be accepted in this case.
