She'll then make the case that she almost won the 2008 nomination, but it was snatched from her by (choose an excuse: media bias, misogyny, evil Obama, snipers, vast right-wing conspiracy, vast left-wing conspiracy, vast centrist conspiracy, locusts...).

In fact, signatories to one of the Geneva conventions are required to prosecute any person, regardless of nationality, against whom they have credible evidence of war crimes. (That's how Pinochet was tried in Europe.) This is probably the only way Bush et al might be tried. The United States does not fully recognize the jurisdiction of the World Court, so any effort to prosecute American politicians there likely would get very messy. Any effort to prosecute them in the USA for their violations of U.S. law could be prevented by Bush's likely pardons of everybody involved but himself. It's conceivable that Cheney will become president for the last few minutes of Bush's term in order to pardon Bush for his violations of U.S. law.
