Stop-and-Frisk Targets Minorities -- Creates Culture of Fear in New York

The New York City Police Department's (NYPD) Stop, Question-and-Frisk Program, known as "Stop-and-Frisk," must end. The safety of our communities cannot be purchased at the price of the civil liberties of the law abiding citizenry of New York City (NYC). Unfortunately, the current Stop-and-Frisk policy has invaded the personal security of citizens, and its efficacy remains debatable. The current program results in fear and insecurity among minority communities which have been disproportionately affected, further exacerbating their historically fragile relationship with the NYPD. I understand that there is a definitive need for law enforcement to protect the city it serves from gun violence and other violent crimes that plague our communities. However, it is imperative that we find more creative, efficient and effective methods that increase community involvement; create trusting partnerships between the community and law enforcement; and reduce the need for draconian style policies based on racial profiling and discrimination.

According to the NYPD, its mission is to "enhance the quality of life in [NYC] by working in partnership with the community and in accordance with constitutional rights to enforce the laws, preserve the peace, reduce fear, and provide for a safe environment." The Stop-and-Frisk program counters this premise as its consequences reduce the overall quality of life for the law abiding citizen or Legal Permanent Resident (LPR) and the community at large. It jeopardizes the constitutional rights of those who are stopped, questioned and searched with very limited cause; and it produces an environment of fear, mistrust and animosity between our communities and the law enforcement, creating a more precarious environment for all.

The current Stop-and-Frisk program gives the individual police officer almost complete discretion in obstructing the movement of individuals in order to conduct spot-checks. According to the New York Civil Liberties Union (NYCLU), in 2011, the NYPD stopped an estimated 684,330 New Yorkers. Approximately 90 percent of those stops were fruitless and did not result in an arrest or summons. Moreover, 53 percent of those stopped were Black, 34 percent were Latino and 9 percent were White. "Furtive movements," was the number one reason reported for the stops. This is undeniably vague reasoning, especially to justify the often aggressive tactics and use of physical force during stops.

Proponents of the program point to a correlation between the crime rate and the racial disparity with those stopped and frisked to support the efficacy of the program. However, the numbers just don't add up. According to a CUNY John Jay School of Criminal Justice 2010 report, in raw numbers, out of 308,101 stops of Black individuals in 2008, 617 guns were recovered; out of 135,026 stops of Hispanic individuals, 121 guns were recovered; and out of 57,650 stops of White individuals, 42 guns were recovered. Stops were somewhat more efficient in recovering other types of weapons, especially among Whites. For every 1,000 White individuals frisked in 2008, officers recovered 36.6 knives or other non firearms. The equivalent return for Hispanics and Blacks was 23.7 and 20.8, respectively. This is a low outcome for the large number of individuals stopped and searched for that year. The same report suggests that in 2009, while the number of stops increased, 1.3 percent of the stops resulted in the discovery of a weapon; 6% of stops resulted in an arrest; and 6.2 percent resulted in the issuance of a summons.

There is no doubt that Stop-and-Frisk does not yield the desired results and it is apparent that it disproportionately targets minority communities. But the policy is not solely a racial issue. It speaks to the "police state" that New York City is quickly becoming, using fear and intimidation as a means to keep people "safe." The acceleration of the program, in addition to recent allegations of spying on Muslim communities in New York and New Jersey, indicate that the NYPD is taking their role as a "paramilitary force" too far. It is clear that the NYPD needs to be reminded of its covenant with the public. We must stand together and demand that New York's "Finest" protect and serve our community with the respect and dignity that the people of New York deserve and pay for.

I call on Mayor Bloomberg, Commissioner Kelly, the Department of Justice and the U.S. Commission on Civil Rights to immediately look into the conduct of the NYPD concerning Stop-and-Frisk. It is a policy that goes against the very principles this country was founded on. This program is an assault on our communities and an affront to our collective humanity.

Perhaps it would be better to "Stop and Pat 'em on the Back" - and add a "How u Doin?" If such a concept is too difficult to follow -- there are many good people looking for work in law enforcement who would love a tough job.....jcg

I suggest that NYC Police take a different approach -- Stop-and-Pat 'em on the Back and say "how ya doin?" Community policing should NOT be replaced with Community Animosity" If that is too tough, there are many who are qualified for, and want your job....jcg

I was stopped one night while driving a friends Mercedes in Harlem and she was on the passenger side. The cops kept asking her if she was ok, as if I had carjacked or kidnapped her. everytime she said she was ok, he would as another question.

I looked towards her to ask for the registration and insurance, the cop interrupted me and told me to look straight ahead and be quiet. They took her to the back of the car and questioned her even more, to make sure that this N wasn't causing her any harm.

He had the nerve to tell me to have a goodnight and get home safe. I wanted to say, "I will if I can get past you racist Bs."

Ever since the death of Amado Diallo,people have been afraid of NYPD! Yes it's TRUTH!! Under tenure Guiliani's the police have become vigilante with the "shoot them up,shoot them up mentality" All at the cost of innocent lives lost. If that is what you call safer streets by unjustified killings! I would call it a failure. And no other Mayor have place any constraints on their Conduct..Shame! Shame!

In addition to that it's unconstitutional. Doesn't matter if you are standing on the corner. The police must have probable cause to do what they are doing. I live in the suburbs of NY and refuse to live back in the city. Each and every time I am in the city I witness the constant abuse of it's citizens. Some of the officers are criminals with a badge themselves. They need to stop! There is more undercover crime and drug use in the suburbs where they live,but decide to prey on innocent people. I fear NYPD..I am not justifying any bad behavior,but I speak to what I see they do for no justifiable reasons. New laws needs to be enacted to govern the conduct of NYPD. They are out of control!

If you compare the crime stats from Dinkin's tenure to the crime stats of Guiliani's tenure, you begin to see that proactive policing has cleaned the city up. We spend significant time in NYC and appreciate how much cleaner and safer the city has become vis-a-vis 20 years ago... This is not to excuse those blatant abuses of authority that probably occur, yet I'm sure that most residents of all races and walks of life appreciate the police and what they do.

Stastics that show "53 percent of those stopped were Black, 34 percent were Latino and 9 percent were White" seem to indicate little racial dispairty. The city's population in 2010 was 44% white (33.3% non-Hispanic white), 25.5% black (23% non-Hispanic black), and 12.7% Asian. Hispanics of any race represented 28.6% of the population. Non-Hispanic whites made up 10.7% of the population and, according to the article, 9% of the stop and frisks.

The article does not say that and whites make up 44% of the cities population.

White Americans of non-Hispanic origin make up 35.1% of the city's population. There are 2,918,976 non-Hispanic whites residing in the city. Much of New York City's European American population consists of individuals of Italian, Irish, German, Russian, Polish, English, and Greek ancestry."

Stop and frisk is a helpful police tactic. There may be some officers that do not use the tactic appropriately. If this is the case then it should be investigated by Internal Affairs. As a taxpayer, I should not have to walk in the street to avoid a group of young people hanging outside blocking the sidewalk when they should be at home studying.

First off people need to take responsiablity for their actions, if your hanging on the corners all night the police would like to know why you are there just as I would wonder as a citizen why are they hanging and allowed at that to saturate the corners all hours of the night? After all NYC is a state that never sleeps! I as a AA have never been harrased by police minding my own business here in chicago, I do believe with a heavy heart our dress codes, ungroomed appearance and contant lack of knowledge to go inside and do your dirt hurts many AA males which in turn promts peoples head and authority to look even closer and then zoom in on them, if your not there you can't be part of the problem and many that complain are people whom have constant run in's with the law. We need to take personal responsiablity for every action and stop using our failures and doing what I want to do attitude recklessly and imposing them on others who do not act that way. It really saddens me to see our people suffer but we must learn how to act, own, money manage, preserve self and look towards the future and then we can not go wrong promised a lady named Nannie Helen Burroughs said it best google 12 thing a negro must do to better himself. If we do not learn from the past we are destine to fail!

While I can agree that there is a level of disrepect amongst our young people like never before, realize, to a racist cop it doesn't mattter your attire if they feel they want to pick on someone. Black men in the Jim Crow era and before weren't wearing pants down to their knees; They weren't even allowed to look a white person in the eye, and even still they were lynched just for being black. Shooting an unarmed black man on the basis of "he looks suspicious" is just another form of modern day lynching. It is a vicious cycle with one side having his own self- perceived entitlement- mindset, and the other side knowing that they are considered an endangered species. It shows that for many it doesn't matter that you be well educated, honorable, respectful hardworking, you will still be treated as subservient.

I lived in nyc for almost 20 years and have never had an bad encounter with a police officer. I've never been stopped and searched and I've lived in some very undesirable neighborhoods. On the contrary, I always felt a bit safer when I did see a few cops on the street or on the train. What would this city be without them. I'm not defending a system that has obvious problems like the NYPD have, but lets not forget, the majority of the officers are a decent bunch of people who are simply doing a damn good job,

There is no doubt that Stop-and-Frisk does not yield the desired results ???? 780 guns taken off the streets in one year,and no telling how many lives saved.684,330 stops, I am sure the same thugs that plague these neighborhoods were stopped multiple times.I guarantee you law abiding citizens in these neighborhoods like the police presence.

You really don't seem to have any concept of reasonable cost to get a return in security. America has millions of guns and taking 780 is not even what police get from gun amnesty programs which can easily bring in over 1000 guns. You don't harass 1000 innocent people to get 1 gun off the street. Law abiding people are the ones getting harassed if you had not noticed the tiny percentage of arrest.

I cannot believe that a city like NY, with a population so in favor of personal freedom, is not outraged at the conduct of the NYPD. Police should have no right to frisk you for the probable cause of having a heartbeat. My most recent visit to NYC was this year, and I had two run-ins with the local police (nothing serious--a traffic ticket). I have never in my life met a ruder, more heavy-handed police department. My advice NY--get rid of Bloomberg and Ray Kelly, and go from there.

On the subject of "walking a beat" and "whining" maybe Ray Kelly and the unions representing the NYPD rank-and-file uniform officers, detectives and sargeants (supervisors) NEED to re-assign the SEVERAL thousand of their able-bodied non-restricted members working, in many instances, alongside NYPD civilian employees who receive far lower salaries and benefits. I know from personal observation that many of these desk jockey civilian attired cops "whine" like cranky children when they have to OCCASIONALLY put on the uniform but "whine" even louder about cost of living increases and bonuses and the slow to arrive annual "uniform allowance." I also know of several desk jockey officers who openly admitted to not carrying their service revolvers to and from their NYPD commands because "they are afraid of guns" and who religiously refrain from stepping up when they observe acts of disorderly conduct while on and off duty.

In general the police in America treat citizens far worse than police abroad. America is excessively authoritarian and police brutality is out of control. We have the worlds largest prison population, along with the largest per capitia prison population in the world. To put it simply we suck at law enforcement here.

This is not an indictment of police, it's a indicator of our willingness to treat our fellow citizens like crap.
