Class Action Suit Filed Against Olive Garden

An Olive Garden employee in Fayetteville, N.C. tested positive for hepatitis A a few weeks ago, potentially exposing thousands of customers to the disease. As a result, health officials have reported that about 3,000 people have received immunizations. Now a class action lawsuit has been filed by the firm Marler Clark, a Seattle-based law firm that specializes in foodborne-illness litigation. The complaint claims that patrons suffered from "lost wages, medical expenses, 'fear of harm and humiliation' and physical pain and injury."

The lawsuit seeks damages of over $10,000; other people can join as co-plaintiffs. Meanwhile, immunizations will continue to be offered at the Cumberland County free clinic until August 22.

Marler Clark has worked on hepatitis A exposure before from restaurants including Carl's Jr., Chi-Chi's, Chipotle, Friendly's, McDonald's, Quizno's, Subway, Taco Bell, among others.
