Virginia Valdez Won't Get Jail Time Despite Trying To Cut Off Husband's Penis

An elderly California woman who tried to sever her husband's penis in 2011 won't see any time behind bars.

Virginia Valdez, 72, of Palm Springs, was sentenced Friday to three years of probation and 420 hours of community service as part of a plea deal she signed in December, according to the Desert Sun. As part of the agreement, she confessed to felony assault with a deadly weapon, a charge that could have landed her in jail for up to nine years.

Her husband, Cesar Valdez, said the sentence doesn't match the crime.

"[This was] a horrific, personal, mental and physical act that I will never be able to forget,” he told NBC News (video above). "I’m a Vietnam veteran, I’m a Gulf War veteran I served in various capacities in enforcement agencies and I left unscathed, and yet I went home and then a horrific crime was perpetrated against me."

On Dec. 3, 2011, Virginia Valdez was "massaging the intimate areas of the victim such as his testicles and inner thigh" when she told her husband that she was getting up to brush her teeth, according to arrest reports at the time. Instead, she grabbed a pair of scissors and cut his penis in an apparently random attack.

Cesar Valdez and his high-profile lawyer, Gloria Allred, have said the attack was completely unprovoked. The pair had been married for 30 years and shared two children.

In an interview after the sentencing on Friday, Cesar went on to say that he's a victim of a double standard because he's a man.

"[My client] is left with some resentment against the criminal justice system because he feels that if he had been a woman victim of domestic violence that the case would not have been permitted to be delayed for so long and that the punishment for Virginia would have been harsher," Allred said.

In addition to her sentence, Virginia Valdez was slapped with a 10-year restraining order.
