Manager Of Safety Charles Garcia Fires Another Officer For Injuring Bystander, Breaking Rules

Unauthorized Use Of Military Ammo Tanks Police Officer

Denver Police Officer Robert Fitzgibbons was issued a termination order by Manager of Safety Charles Garcia for use of unauthorized military ammo that injured an innocent bystander.

According to the Denver Post, an investigation found some of Fitzgibbons's bullets fired near Club Vinyl on Broadway were unauthorized military "tracer" bullets. Fragments of these bullets hit Diamond Demmer, who was nearby when Fitzgibbons and another officer were attempting to disarm a suspect. Her injuries were reportedly not life-threatening.

According to Garcia, Fitzgibbons was fired for violating departmental rules and mayoral executive orders regarding firearms and other conduct.

Police union president Nick Rogers says Fitzgibbons will appeal his termination. Nine Denver police officers have been fired since March.

The Denver District Attorney's Office won't be pressing criminal charges since the investigation found that the officers were justified in using force, but emphasized in a letter that procedures are "designed to protect officers and citizens."
