The anchor will fill the 3 p.m. slot once occupied by Smith before his abrupt departure from the network in October.
Andrew Napolitano acknowledged that, if he were in the House, he would vote to impeach the president.
"This is someone who said white supremacy is a hoax," Democratic National Committee Vice Chair Michael Blake said.
