Judge Rules New York Can't Order Fast Food Restaurants To Display Calorie Contents

Mayor Bloomberg's effort to force fast food restaurants to prominently display the calorie content of their menu items suffered a setback this morning when a federal judge ruled that the regulation exceeded the city's authority.

"This would have really been just punishing the good guys," the executive vice president of the New York State Restaurant Association, E. Charles Hunt, told The New York Sun today of the city's attempted regulation.

The ruling, however, is not a complete victory for the state restaurant association, which brought suit challenging the 2006 regulation by the city's Department of Health and Mental Hygiene. In the decision, Judge Richard Holwell of U.S. District Court in Manhattan offered city officials a blueprint for how to fix the regulation to make it legal.
