All 10 Democrats on the Senate Judiciary Committee pressed Michael B. Mukasey, President Bush's nominee for attorney general, on Tuesday for a clear-cut statement that the interrogation technique known as waterboarding, which simulates drowning and has been used by the C.I.A. against terrorism suspects, is illegal.

In his confirmation hearings last week, Mr. Mukasey, a retired federal judge from New York, declined to say if waterboarding was torture or was otherwise illegal; he insisted he was not aware of how the technique was carried out.

It's funny that drown proofing is a training exercise but waterboarding is torture. Get a grip people. Our own soldiers go through worse in their training exercises.

What will Mukasey do about this now that it has
become public to a certain extent...

I believe SHRUB did not need gonzo or karl rove
any longer - the new PNSD #51 & all the other presidential executive orders/national security
directive decisions/military orders ETC.

When Mukasey said that if the president came up
with something that Mukasey said was in essence
UNCONSTITUTIONAL & if he (Mukasey) could not change the presidents' mind - Mukasey said he would resign...

Now to me that is not the type of U.S.A.G. we the American people need after the tremendous amount of problems Gonzo left or imputed or better yet imprinted upon our nation...

For starters if Mukasey believed he was right if this scenario ever came to fruition which likely will come into fruition & quite often -the job of the U.S.A.G. is to determine if any CRIMINALITY is or will result from something being UNCONSTITUTIONAL in Mukaseys' eyes...

To just CUT & RUN AWAY FROM THE U.S.A.G. post
for which he would be confirmed to fulfill - is
& will be counter-productive...

In all honesty if the U.S.A.G. deems that anything is amiss or UNCONSTITUTION in nature that tells someone with any type of LEGAL INTELLIGENCE & REAL KNOWLEDGE of the U.S. CONSTITUTION -- that the president is violating
that which HE SWORE TO UPHOLD...

So that would mean that the U.S.A.G. would have to consider filing criminal charges & a possible ARREST WARRANT / INDICTMENT if the violations warranted that kind of action...

That is the type of U.S.A.G. that America needs
from here on out - not someone who is just going to kiss this president or the next presidents' ass...

THAT IS & WOULD BE CRIMINAL IN ITSELF...

Mukasey has stated that the president is above the law. That's a more important issue than torture but the Senators are not asking the tough questions. Any nominee who thinks the president is above the law cannot support the Constitution and should not be confirmed.

Why aren't the Dems DEMANDING that Mukasey agree to appoint a special prosecutor - or SEVERAL special prosecutors - to look into a number of glaring instances of illegalities?? No one will be held accountable until they are hauled before a court of law facing criminal charges.

That is the main point. What is this committee going to do? Look like they're pressuring him on torture, say they're satisfied when he answers, and then send him to the whole Senate? But in the meantime, as you say, he will get a free ride on the question presidential powers.

Waterboarding causes brain injury. It only takes a few moments for brain cells to die without oxygen. Repeatedly subjecting someone to oxygen deprivation (you think you are drowning) will damage that person's brain. That is permanent injury. Even by their own horrid standards, a "technique" that leads to permanent injury is torture.

That's like telling him what lie to tell them the new documents detail 100,000 pages of them that Bush ordered the harsh treatment at Gitmo and Abu Gharib..and Rumsfeld knew about this long before the pictures got spread all over the World..

Once again some Democratic Senators are attacking on the wrong front. The real trouble with Mukasey is that he avers that our president does not have to obey all laws, including those which the president may think are unconstitutional. Mukasey should not be confirmed until he takes that back unequivocally. Unfortunately the Democrats will timidly cave in.
