Mukasey, 66, was the White House's first choice to replace Gonzales.

Besides Schumer and Feinstein, Democrats voting to confirm Mukasey were: Sens. Evan Bayh of Indiana, Tom Carper of Delaware, Mary Landrieu of Louisiana and Ben Nelson of Nebraska. Of the Senate's two independents, Joe Lieberman of Connecticut voted for confirmation and Bernie Sanders of Vermont voted against.

Not voting were Democratic presidential candidates Joe Biden of Delaware, Hillary Clinton of New York, Chris Dodd of Connecticut and Barack Obama of Illinois. All four had said they opposed Mukasey's nomination.

Republican presidential candidate John McCain of Arizona also was absent, as were GOP Sens. Lamar Alexander of Tennessee and John Cornyn of Texas.

None of the candidates who opted out of this vote should have a chance to be president. None of the people who allowed him to get approved as attorney general should be re-elected. This country is in the hands of maniacs and cowards.

We need to Impeach Bush and Cheney. It is our only hope. Take action now. Insist that Congress act on HR333 - the articles of impeachment - introduced by Dennis Kucinich.

Being an Orthodox Jew like our new Attorney General-- I don't think anyone used the anti-semitic card-- not nowadays -- we're doing well- we have Schumer, Chertoff, Feingold, Coleman, Feinstein, Boxer, Spitzer, Kissinger, Albright, Spector, and the list goes right on to some who--if they ever had their D.N.A. tested-- may be surprised to find out they're really Jewish!

Perhaps also an explanation for the yes-vote of, otherwise oh sooo pro-constitution, leaders Feinstein and Schumer.

Earlier today, I referenced Greg Sargent's piece at Talking Points Memo (here: http://tpmelectioncentral.com/2007/11/why_didnt_senators_running_for_president_vote_on_mukasey.php) regarding the mysterious absense of the presidential candidates at this very important vote.

At first it puzzled me. Why would the Democratic leaders in the Senate insist on a vote minus these important voices? And then it occurred to me that this tactic provided a perfect cover for Biden, Dodd, Clinton and Obama.

Whatever happened, it was pretty shoddy work by the Senate all the way around.

As an obama supporter, I must say I am quite disappointed.

I don't think he had anything to lose by voting against this guy. He is the same guy that said the president could act above the constitution in certain circumstances and does not know if water boarding is torture.

Those two reasons were enough to be against. I am also disapointed in Dodd too. I thought he was leading the fight agaist this guy. Well, Obama is still it for me!

Schumer insisted he supported Mukasey because Mukasey promised to uphold any resolution Congress passes declaring that waterboarding is torture.

So the onus is on Congress now to declare waterboarding torture.

I think Schumer owes it to us to introduce that legislation, pronto.

What Happened to the Senate's "60-vote Requirement"?

'Every time Congressional Democrats failed this year to stop the Bush administration (i.e., every time they "tried"), the excuse they gave was that they "need 60 votes in the Senate" in order to get anything done. Each time Senate Republicans blocked Democratic legislation, the media helpfully explained not that Republicans were obstructing via filibuster, but rather that, in the Senate, there is a general "60-vote requirement" for everything.

How, then, can this be explained?

"The Senate confirmed Michael B. Mukasey as attorney general Thursday night, approving him despite Democratic criticism that he had failed to take an unequivocal stance against the torture of terrorism detainees.
