U.S. Sen. Joe Biden, D-Del., said Sunday a special counsel should be named to investigate the destruction of videotapes of CIA terror suspect interrogations.

CIA Director Mike Hayden has disclosed the tapes were destroyed by an underling without consulting CIA legal counsel. Hayden contends their disposal was legal and necessary to protect the identity of the interrogators.

I guess he means there is now no choice but to go after the people who ordered the torture, you know the higher ups like um.. him and er uh .. the President and Secretaries of defense at the time of the criminal acts.Yup that must be what he is suggesting. Don't you think?

Which is the bigger potential crime:

a) The interrogation techniques on the tapes?

b) The destruction of the tapes?

or...

c) Possible allegations by the torture victim (terrorist though he may be) of how the US government, the Pakistani government, or the Saudi government were involved?

If shithead Biden calls for a 'Special Counsel' to investigate the destruction of the CIA tapes, he should get all the officials The 9/11 Commission, authors of THE 9/11 REPORT, to testify.

Those CIA tapes are referrenced in nearly every single chapter of THE 9/11 REPORT.

I agree with Joe Biden as this adminstration is going to be spinning like a washing machine if there is not a special counsel/investigator assigned to look into this. The white house in various shade of dirty white has not been clean and honest and has minpulated at such levels they cannot be trusted and any mutual investigation will always be partisan for the republicans.

"...Joe Biden, a Democratic presidential candidate who chairs the Senate Foreign Relations Committee, cited Michael Mukasey's refusal during confirmation hearings in October to describe waterboarding as torture.

The US Justice Department and the CIA's internal watchdog announced Saturday they would conduct a joint inquiry into the matter. That review will determine whether a full investigation is warranted.

"He's the same guy who couldn't decide whether or not waterboarding was torture and he's going to be doing this investigation," said Biden, who noted that he voted against making Mukasey the attorney general.

Speaking on ABC's "This Week," Biden of Delaware asserted that the "easiest, straightest thing to do is to take it out of the political realm, appoint a special prosecutor and let them decide, and . . . call it where it is. Is there a criminal violation? If there is, proceed. If not, don't."

Taken from Nov. 1st Democracy Now "Opposition to Attorney General nominee Michael Mukasey is growing, after the retired federal judge refused again to declare the practice of waterboarding as a form of torture. On Wednesday Senate Majority whip Dick Durbin of Illinois and Democratic Senator Sheldon Whitehouse of Rhode Island announced that they will join Democratic Senator Joe Biden of Delaware in voting against Mukasey"s nomination.

All three serve on the Senate Judiciary Committee, which will vote on Mukasey"s nomination on Tuesday. A party-line vote by the Democrats on the Judiciary Committee could block Mukasey"s nomination from reaching the Senate floor, but the remaining Democrats on the committee have declined to say how they will vote.

The controversy over Mukasey centers on his comments about the interrogation practice known as waterboarding, which is widely considered a form of torture."

Please note: Joe Biden didn't miss a trick - he was also working in his job as Senator (something Obama has yet to do). Thank God for Joe Biden - but other Democrats did cross over and confirm the nomination - sure to come back and haunt them now. Once again Joe Biden is Right!!!

These were public statements Joe Biden made in August of 2007 in Newsweek and Democracy Now.

"Sen. Biden Suggests Criminal Charges Against Bush Officials
Impeachment has been making headlines recently in the city of Kent, Ohio. Democratic Presidential candidate Senator Joe Biden has suggested criminal charges could someday be filed against members of the Bush administration. In a recent interview with Newsweek, Biden said there are alternatives to the impeachment of President Bush. Biden said: "I think we should be acquiring and accumulating all the data that is appropriate for possibly bringing criminal charges against members of this administration at a later date."

Joe Biden has publicly stated repeatedly before the CIA tapes turned up missing that he will prosecute anyone who knowingly ordered torture for the past 8 years. Please note the above article in Democracy Now was written in August of 2007 from a quote from Newsweek of the same time period. Joe Biden has stated that on day 1 of his administration, he would close Guatanomo Prison and begin these investigation. He said in November on his campaign trail on C-Span in Iowa, before any of this news on the destroyed tapes hit the press. Joe Biden hasn't been idle, has been thinking about this for some time, and on-top of Bush/Cheney tactics. He's been keeping a "list and checking it twice, gonna find out whose naughty or nice...Joe Biden's coming to town."

The 'others' - Dems and Reps alike, are content to keep the investigation 'in house'. Biden, on the other hand, is calling for an independent counsel. He's as sick of the duplicity as we are, and is willing to have the secrets brought to light in order to find the truth, and hold the guilty parties responsible.

No one else is agreeing with him - he's standing alone in this request, but he's not backing down. We owe him our gratitude.

I'm with you, Senator. There's been no accountability and the Dems look weak and do-nothing. Apparently impeachment was taken off the table so no really good hearings could go forward--how does that make us look? If some Dems are implicated, so be it. They would pale in comparison to the actions of the Bush admin. The American people feel that something was done wrong yet everything is hush-hush. It's criminal and extremely upsetting to those of us who worked so hard so that the law would come into effect once again. It's like nothing makes sense anymore.

I have written the Biden campaign requesting that Joe Biden start investigations into the new revelations in the NIE report to find out when the President really knew about them. I also think his suggestion to have an independant hearing on the destroying of the CIA tapes is good. We all need to express our support of Joe Biden for President.

It's interesting that the honorable Senator doesn't have confidence in the Attorney General, as that is who appoints the Special Counsel, and who establishes the jurisdiction of the Special Counsel: it is the Attorney General who provides the factual statement of the matter to be investigated. It is the Attorney General who may request "that the Special Counsel provide an explanation for any investigative or prosecutorial step, and may after review conclude that the action is so inappropriate or unwarranted under established Departmental practices that it should not be pursued."

Sorry, this shit just won't fly... Wasn't Tenet awarded the Medal of Obfuscation by the Pres.? I would love to see Bush/Cheney tied up with something during the last part of their terms (if only to keep them out of causing more trouble). I believe we need to dig into the NIE reports present and past to further this desire to tie their hands, and possibly gag them too!

Save our money!

Why bother with any 'special council investigations' if the guilty motherfuckers will only be let free afterwards? Apparently we have not learned the lesson that Bush/Cheney will get away with every goddamn crime they commit.

Let's just stop throwing our money away on these investigations.
