A federal magistrate ordered the White House on Tuesday to reveal whether copies of possibly millions of missing e-mails are stored on computer backup tapes.

The order by U.S. Magistrate Judge John Facciola comes amid an effort by the White House to scuttle two lawsuits that could force the Executive Office of the President to recover any e-mail that has disappeared from computer servers where electronic documents are automatically archived.

I will tell you as a professional in this business that copious backup-sources must exist.

And furthermore: federal disclosure laws (from the Federal Record right on down) simply require that information be kept; that it be part of the public record. If that information is NOT there, especially if it has been deleted and whether-or-not a backup source exists ... A CRIME HAS BEEN COMMITTED.

Simply put: the laws of our land, are laws. Laws are there to be enforced. There are no exceptions, regardless of rank or privilege.

Love to see this go anywhere, but given the record of cooperation by this WH, don't see any emails being turned over. Probably too incriminating. They will fight this to the SCOTUS.
Besides, the election noise machine will distract this from being a big story. Haven't heard about the NIE, CIA, FBI too much since last week. No real reporting on the net neutrality bill. Nothing on the gaining support for Kucinich's Cheney impeachment bill.
It's Barack-Brittany week! TOO BAD- won't get to see Bushco get what's coming to them.
