A judge said Wednesday that he was leaning toward allowing Dan Rather's $70 million lawsuit over his being fired by CBS to proceed.

"I concluded there was enough in the complaint (by Rather) to continue with discovery (pretrial research)," state Judicial Hearing Officer Ira Gammerman said at a hearing on CBS' motion to dismiss the case.

The judge did not issue a final ruling on CBS' motion, but he suggested the parties try to agree on the scope of pretrial discovery _ just in case _ and told them to return to court Jan. 23 for a conference.

Rather, whose last months at CBS were clouded by a disputed story on President Bush's Vietnam-era military service, says his employers made him a "scapegoat" to placate the White House after questions arose about the story.

No one has a chance to stand up and fight against the Bush Crime Family. Harriet Miers was put in charge to clean up GWB's military
record. Too bad the public did not catch on.
After being offered 1 million for anyone who
could state they served with Bush, aside from the one colonel, did not bring forth anyone
and that should have been the clue. And from there on it went straight down though roughly 29 % in this country still support this criminal. Rather's suit probably will be settled for the truth would embarrass our nation.

I hope Dan Rather prevails against the shabby treatment he got at CBS.

As an aside, Rather has been producing some great investigative journalism in one-hour segments on HDTV. I have watched almost everyone and found them compelling...

I have to correct the claim about "questions arose about the story". The questions arose about the documents, not the story itself. Bush tacitly agreed that if fake documents were used to present truthful facts, that it would be acceptable. He was referring to the reports from Iraq that fake stories were planted in the Iraq newspapers by USA sources who bribed the sources to print the stories there. Bush was claiming the stories were true just the sources were not. It was coincidental that these two events were simultaneous. Bush just couldn't see the parallel, the forest through the trees so to speak.

I totally agree with Rather's lawsuit. This brings this entire fiasco to light on the other hand, CBS will settle because this goes straight to the White House.

the facts of George Bush's going AWOL by not showing up for his pilot's physical have never been in dispute. By skipping his physical he threw away hundreds of thousands of dollars of taxpayer money that went into his training, and wasted a position many not so privileged soldiers could have built a career on. SO the only reasons those fudged documents were put into Rather's hands were to distract from the established truth, discredit the story and Rather, who was the only journalist to stand up to Bush Sr on his involvement (as former head of the CIA) in Iran/Contra. After Rather's admirable show of journalistic ballsiness back then, the Bush royal family blacklisted Rather for interviews. I hope this trial finally reveals the plot behind these forged papers to take revenge on Rather and distract brain-dead americans from the real story.

I appreciate Rather's efforts to expose the Chimpster-in- Chief's pathetic "service" in the country club unit of the National Guard. At great personal risk, he exposed on TV some of the many lies GW Bush has promoted.

GWB was allowed to evade the draft, and then allowed to evade what little he was required to do in the Guard. With his Dad as former CIA director, and with his family's staggering wealth, I am sure Chimpy felt he was totally protected in his self-spun cocoon of lies and fantasy.

Thanks to fearless journalists like Dan Rather, Americans were able to get at the truth about GW's sad history in the military.

There has been a disinfo campaign afoot attempting to destroy Dan Rather's credibility, but longtime observers know Dan is good. It is too bad there are so few like him in our country these days. Most are so worried about maintaining their lavish lifestyles that they wouldn't dare say anything truthful about monkeyman.

If the judge is honest, and cannot be blackmailed or bought off, Rather has a chance at justice.

I would love to see this go to trial. Perhaps we can finally get some form of truth here. Rather got the shaft, Bush people NEVER denied the contents of the documents, just that they were not the original. Unless this judge is in someone's pocket, it SHOULD go to trial. I'm with Rather. He got screwed all the way around.

I too am pissed at the media (again) for just letting this drop. Chickenshit Bush lapdogs that they are.
